Dayton (hereinafter "the applicant") ·is the owner of the property located at 1655 Bohn's Point Road within the City of Orono (hereafte r "City") and legally described , as fol lows: Lot 6, Auditors Subdivison 349, Tracts D, E, F, G, H & I Registered Land Survey No. 565 , WHEREAS, the applicant has applied to the City for a Conditional Use Permit per Municipal Zoning Code Section 10.20, Subdivision 3 (G). to permit a guest apartment within a newly · constructed detached garage. NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of Orono, Minnesota: FINDINGS 1. This application was revi ewed as Zoning File No. 926. 2. The property is locat e d in the LR-lB Single Family Lakeshore Residential Zoning District. 3. On June 17, 1985, the Orono Planning Commission reviewed the application as propos e d and recommended approval, finding that the application met the intent of Section 10.20, Subdivision 3 (G) of the zoning code and the compre- hensive int e nt of the single family lake shore residential district. 4. The City Council has consider e d this application in- cluding the findings and r e commendations of the Planning Commission, reports by staff and comments of the applicant and the effect of the propo s ed use on the health, safety and welf a re of th e community. Pa g e 1 of 3 City of ORONO RESOLUTION OF THE CITY COUNCIL NO. 1791 ' , 5. ·The City Council finds that granting a Conditional Use Permit to allow the guest apartment to be constructed within the detached garage structure will not be detrimental to the .health, safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other 'danger to neighboring properties, nor will it depreciate surrounding property values and the proposed level of use of the property wi 11 be in keeping with the intent and objec- . ti ves of the Zoning Code and Comprehensive Plan of the City. CONCULSIONS, ORDER AND COND-ITIONS Based upon the above findings, the Orono City Council hereby grants a Conditional Use Permit per Municipal Zoning Code _Section 10.20, Subdivision 3 (G) to permit a guest apartment within the detached garage on the property, subject to the following conditions : \ 1. Guest apartment located within the second floor of the detached garage may never be rented, but is for the ex- clusive use of owners, their guests or their employees. 2. 'The guest apartment must be served by an independent sewer connection to ~he municipal line. 3. Violation of or non-compliance with any of the items and conditions of this resolution shall constitute a violation of the Zoning Code, shall a utomatically terminate any authority granted herein, and shal 1 be punishable as a misdemeanor. 4. The undersigned owner has read, understood and hereb~ agrees to the terms of this resolution and on behalf cf himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of . the property.
