To. fulfill the requirements for your Certificate of Occupancy and to comply with the requirements
of your variance approval (Resolution No. 4 708) a hardcover compliance inspection of your property
was completed by City staff on April 3, 2003.
It appears to City staff that the hardcover in the 250-500' zone may significantly exceed the 30%
limit for that zone. The attached sketch on a copy of your approved site plan indicates the apparent
areas of excess hardcover. I am also attaching the hardcover worksheets submitted with your
building permit for reference.
Due to the shape of the driveway areas which make calculation of the hardcover difficult, you must
provide an as-built survey of the 250-500' zone in order to verify the extent of the overage. You will
be required to remove any excess hardcover over the 30% limit. If you believe the driveway as
originally approved is not workable, a revised plan meeting the 30% limit should be submitted.

The Orono Planning Commission met on the above date with the following members present:
Chair Elizabeth Hawn, Commissioners Jeanne Mabusth, William Stoddard, Dale Lindquist, Daniel
Kluth, and Alternate David Rahn. Commissioners Sandra Smith and Janice Berg were absent. The .
following represented City Staff: Planning Director Michael Gaffron, Zoning Administrator Paul
Weinberger, Zoning Administrator Wendy Botten berg, and Recorder Jackie Young. City Council
Representative Jay Nygard was present.
Chair Hawn called the meeting to order at 6:30 p.m .

Application Summary: The applicants own the subject property and are requesting a lot width
variance and an accessory building variance to construct a new residence on the lot.
A lot width variance is required due to the lot being 102' wide where 140' is required in the LR-1B
zoning district.
An accessory building variance is required because Orono zoning code does not permit an accessory
building on a property without a principal structure. Currently there is an existing accessory building
(pump house-shed) located on the property without a primary structure . A variance was granted in
1988 to allow the accessory building to remain on the property. The applicants have submitted
building plans for a new residence and the accessory building will remain.
1. Section 10.24, Subdivision 5 (B): Lot Width: The lot is 102 feet wide where 140 feet is the
minimum lot width for the LR-1B zoning district for new construction.
2 . Section 10 .03, Subdivision 9: (Accessory Buildings): No accessory buildings or structure shall
be constructed on any lot prior to the time of construction of the principal building to which it is
accessory.

A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 10.24, SUBDIVISION 5 (B) AND
SECTION 10.03, SUBDIVISION 9,
FILE NO. 01-2719
WHEREAS, David A. Dalvey and Jodi F. Dalvey, (hereinafter "the applicants") are
the owners of the property located at 1520 Bohn's Point Road within the City of Orono (hereinafter
"the City") and legally described as follows:

WHEREAS, the applicants have applied to the City for variances to Municipal
Zoning Code Section 10.24, Subdivision 5 (B) to permit new residential construction on a lot that
is 102 feet wide where 140 feet is required and Section 10.03, Subdivision 9 to permit an accessory
structure on a lot without a principal structure.
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on October 15, 2001, at which time all persons desiring to be
heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #01-2719.
2. The property is located in the LR-1B Zoning District, where 43,560 s.f. or 1 acre is
the minimum required lot area. The property consists of approximately 36,753 s.f.
or .84 acres.
3. The Orono Planning Commission reviewed this application on October 15, 2001 and
recommended approval of the proposed variances based upon the following findings:

A. The property has been developed with a residential use since at least 1967.
B. The site plan indicates the proposed setbacks 10' to the side property lines
and the house would be outside of the 75' lakeshore setback. The entire
house would be located approximately 145' from the lakeshore, which meets
the intent of the Comprehensive Plan for new structures.
C. The pump house-shed accessory building is in good structural condition.
D. Variance approval was granted for the accessory building in 19 8 8.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variances will not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variances on the health, safety and
welfare of the community.
CONCLUSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants
variances to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to allow new residential
construction on a lot that is 102 feet wide and 140 feet is required and Section 10.03, Subdivision
9 to allow an accessory structure on a lot without a principal structure. Approval is subject to the
following conditions:
1. Council approval is based on the site plan submitted by the applicant attached to this

resolution as Exhibit B. Any amendments to the site plan may require further
Planning Commission and City Council review.
2. It is the intent of the City Council that any further variances to develop the lot would
not be looked upon favorably.
3. Authorities granted by these variances run with the property not with the applicants,
but are permissive only and must be exercised by application for a building permit
within one year of the date of Council approval, or these variances will expire on that
date (October 22, 2002).
4. Violation of or non-compliance with any of the terms and conditions of these
variances shall constitute a violation of the zoning code, shall automatically terminate
any authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read, understood and hereby agree to the terms of
this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.
Adopted by the City Council of the City or Orono, Minnesota at a regular meeting held on
the 22nd day of October, 2001.

Pertinent Code Section:
1. Section 10.24, Subdivision 5 (B): Lot Width: The lot is 102 feet wide where 140 feet is the
minimum lot width for the LR-1B zoning district for new construction.
2. Section 10.03, Subdivision 9: (Accessory Buildings): No accessory buildings or structure shall
be constructed on any lot prior to the time of construction of the principal building to which it is
accessory.
Application Summary: The applicants own the subject property and are requesting a lot width
variance and an accessory building variance to construct a new residence on the lot.
A lot width variance is required due to the lot being 102' wide where 140' is required in the LR-1B
zoning district.
The lot is approximately .84 acres and the minimum lot area requirement is 1 acre. A lot area
variance is not required to construct a new residence, because the lot meets 80% of the required area
per Section 10.24, Subdivision 5(8).
An accessory building variance is required because Orono zoning code does not permit an accessory
building on a property without a principal structure. Currently there is an existing accessory building
(pump house-shed) in the 0-75' setback area, that will be located on the property without a primary
structure. The applicants have submitted building plans for a new residence and the shed is proposed
to remain.

In addition, not indicated on the survey, is a barbeque cooker on the property located in the 0-75'
setback area. The cooker is in good condition and the owners would like it to remain. The pump-
house shed and barbeque cooker are a combined hardcover of392 s.f. (5.04%) in the 0-75' setback
area. In 1988, the previous owners were approved for an after-the-fact lakeside deck. A condition
of the approval was to remove part of the pump house and 158 s.f. of the patio in front of the cooker
and other hardcover in the 75-250' setback area. While removing hardcover the applicant's son
removed more hardcover than was necessary in the 7 5-25 O' setback zone. The owner then went back
to the City Council wanting to amend the hardcover allowance on the property and was granted
approval to keep the cooker and pump house on the property and at their original size. (392 s.f. or
5.04%) (Exhibit F).
The detached garage on the street side of the property does indicate a bathroom with plumbing.
When staff met with the builder and owner it was stated that the bathroom would be roughed in at
construction time and at a later date if/when the owner wishes to put in the bathroom a conditional
use permit will be applied for.
An average lakeshore setback variance is not required in this application because the proposed
residence is behind the setback line measured from the second story deck ( considered structure) on
the adjacent property to the north and the comer of the residence on the adjacent property to the
south.
Statement of Hardship:
This is an existing lot which was platted prior to current zoning standards.
Issues for Consideration:
1. The lot was platted prior to current zoning requirements.
2. A residence exists on the property.
3. The pump-house shed and barbeque cooker are in good structural condition.
4. The proposal meets requirements for structural lot coverage and yard setbacks.
5. Other issues raised by the Planning Commission.
Staff Recommendation:
Staff recommends approval of the requested variances.

Dear Jodi & David:
We understand that you are applying for several variances in connection with your potential
construction at 1520 Bohns Point Road. You have shown us a survey dated 2-22-01 from Coffin
& Granburg which shows the location of a new house on the site of the old house. With reference
to that drawing which will be included along with this letter in a Request for Variance
Application submitted to the City of Orono on September 18, 2001, we agree to support your
request for the following two variances.
MINIMUM LOT WIDTII:
We understand the City of Orono requires a minimum lot width of 144 feet and that your lot is
only 100 feet wide and consequently you are requesting a variance from the City of Orono.
Without a variance, you cannot build on the lot per City of Orono statutes. We agree to and
support your request for a variance so that you may build on the lot
MINIMUM SETBACK REQUIREMENT:
We understand the City of Orono has a setback requirement which prevents the construction of
any foundation or hardcover (patios, decks, etc.) to the East of a straight line drawn between the
easternmost point of the foundation/hardcover of the house at 1500 Bohns Point Road and the
easternmost point of the house at 1540 Bohns Point Road. We understand that you intend to
position the proposed new house further from Lake Minnetonka from where the existing house
foundation currently sits, but ahead of the straight line between the two neighboring homes.
Without a variance, you would need to move the house away from the lake another 15 to 20 feet
to comply. This distance does not impact our view of the lake and because the new house will be
fur.her back, actually would improve our view if we had such a concern. We agree to and
support your request for a variance so that you may position your house as shown on the
survey plan.
You agree to use your best effort to keep us apprised of any future changes, which may impact
our properties and further agree to share your current site plan survey drawings with us in the
future should we so request.

Planning and Zoning Administrator Gaffron presented the plan as
proposed by the applicants. He explained that the Brandenburgs
were going to rebuild a~d slightly revise an existing second
story deck and 3-season porch. They would also be revising the

The applicant was-ptesent for this matter.
-Ctty-1'.~or Bernhardson explained that the Council
had previously granted an after-the-fact permit for construction
of a lakeside deck. There were to be some hardcover trade-offs
made as a condition to the approval. While removing har~cove~ to
conform with the Council's directives, applicant's son removed
more hardcover than necessary in the 75-250' zone. Mr. Kirchner
does have a shed and barbeque area in the 0-75' zone that were
slated for removal, but have not yet been removed. Applicant
would like to retain those two items, which would caus~ a net
increase in 0-75' hardcover from 3.56% to 4.9%.
Mr. Kirchner stated that approva 1 of the origina 1
application involved reducing hardcover by the amount they
intended to add in the lakeshore yard. Applicant planned to not
only do that but to also decrease the hardcover back by the
garage. When Mr. and Mrs. Kirchner returned home from their
vacation, they discovered that part of the walkway to the lake
was removed. Mr. Kirchner added that the walkway was a main
source for water runoff to the lake.
It was moved by Councilmember Goetten, seconded by
Counci lmember Callahan, to approve the amended request for
hardcover removal, per staff recommendation. Motion, Ayes=5,

Dear Jodi & David:
We understand that you are applying for several variances in connection with your potential
construction at 1520 Bohns Point Road. You have shown us a survey dated 2-22-01 from Coffm
& Granburg which shows the location of a new house on the site of the old house. With reference
to that drawing which will be included along with this letter in a Request for Variance
Application submitted to the City of Orono on September 18, 2001, we agree to support your
request for the following two variances.
M1NIMUM LOT WIDTH:
We understand the City of Orono requires a minimum lot width of 144 feet and that your lot is
only 100 feet wide and consequently you are requesting a variance from the City of Orono.
Without a variance, you cannot build on the lot per City of Orono statutes. We agree to and
support your request for a variance so that you may build on the lot.
MINIMUM SETBACK REQUIREMENT:
We understand the City of Orono has a setback requirement which prevents the construction of
any foundation or hardcover (patios, decks, etc.) to the East of a straight line drawn between the
easternmost point of the foundation/hardcover of the house at 1500 Bohns Point Road and the
easternmost point of the house at 1540 Bohns Point Road. We understand that you intend to
position the proposed new house further from Lake Minnetonka from where the existing house
foundation currently sits, but ahead of the straight line between the two neighboring homes.
Without a variance, you would need to move the house away from the lake another 15 to 20 feet
to comply. This distance does not impact our view of the lake and because the new house will be
further back, actually would improve our view if we had such a concern. We agree to and
support your request for a variance so that you may position your house as shown on the
survey plan.
You agree to use your best effort to keep us apprised of any future changes, which may impact
our properties and further agree to share your current site plan survey drawings with us in the
future should we so request.
