SH A RESOLUTION APPROVING � � COMPREHENSIVE PLAN AMENDMENT#7 WHEREAS,in June 1980,the City Council of the City of Orono (hereinafter "the City") adopted a Community Management Plan (hereinafter "CMP") to provide for the orderly development of the City. An integral part of the Plan provided that sewered areas of the City be included within the Metropolitan Urban Service Area(hereinafter "MLJSA"); and WHEREAS,the MUSA boundary originally adopted via Resolution No. 1135 on Apri114, 1980 was subsequently revised by Resolution No. 1337 on November 23, 1981;Resolution No. 2131 on February 23, 1987; Resolution No. 2437 on May 23, 1988; Resolution No. 3153 on August 10, 1992;Resolution No. 3283 on May 24, 1993;Resolution No. 3348 on October 25, 1993; and Resolution No. 3791 on October 28, 1996; and � • � WHEREAS,since 1962 the City of Orono has made a concerted effort to bring sewer to its nearly 40 miles of Lake Minnetonka shoreline, a majority of which has historically been developed residentially, with the result being that a high percentage of Orono's population resides in the defined Shoreland district, within 1000 feet of the Lake; and WHEREAS,one of the few shoreland areas remaining to be sewered is the northeast shore of Maxwell Bay and the southeast shore of Stubbs Bay, a 155-acre area with shoreline length of approximately 1.2 miles, zoned for 2-acre minimum lot size; and • WHEREAS,the existing residential subdivision known as"Farview"was developed in this area at a 2-acre density in the late 1970's. At that time Orono's septic system management program was in its infancy,and the level of espertise in the on-site industry regazding soil conditions as they relate to septic sites was not well developed. As a result, the septic systems installed within this subdivision may not have the longevity of current mound systems, and the adequacy of the alternate drainfield sites is not assured,hence it would be prudent to plan ahead for the potential need to provide this subdivision with sewer; and WHEREAS,on April 13, 1998 the City Council granted preliminary plat approval for a 7-lot residential plat of a 17-acre parcel at the east end of Maxwell Bay, known as "Little . Orchard" and located within the area subject to this amendment. The property being developed has retained its natural character with an undisturbed wooded shoreline,which the developer has demonstrated a commitment to preserve by granting a woodland preservation easement. While this property was initially intended to be served by septic systems,the City Council concluded in March 1998 that preservation and protection of the natural features of the site and the Bay would be best accomplished by providing sewer to this development,with no increase above the density that could be accomplished using septic systems; and WHEREAS, the City Council subsequently directed that staff draft a Comprehensive Plan amendment incorporating the entire shoreline of Maxwell Bay within the MUSA because the ability to provide sewer if additional lakeshore development occurs,or if existing systems become a problem, will help to ensure the long-term protection of Lake Minnetonka; and WHEREAS,pursuant to legal notice,the Orono Planning Commission held a public hearing on the proposed amendment on May 18, 1998 to receive public comments regarding the • proposed amendment, at which time all public comments were heard; and � WHEREAS, the Orono Planning Commission on May 18, 1998 recommended approval of the proposed amendment on a vote of 5 to 0; and WHEREAS, on May 26, 1998,the City Council reviewed the draft amendment and directed staff to submit the amendment to Metropolitan Council; and � WHEREAS,on June 26, 1998 Comprehensive Plan Amendment#7 was submitted to the Metropolitan Council for approval and written notice was sent to surrounding local units of government and other affected jurisdictions requesting written comment; and WHEREAS,no negative comments were received from the surrounding local units of government or other affected jurisdictions; and � WHEREAS, on July 2, 1998 the Metropolitan Council completed its review of � Comprehensive Plan Amendment#7 and determined that the proposed amendment is consistent with the Regional Blueprint, including the Regional Growth Strategy, and in conformance with metropolitan system plans; and • WHEREAS,on July 2, 1998 the Metropolitan Council indicated to the City via letter � Page 2 of 3 • � __- '• � O ' Y � - • O O ��b. - C ITY of ORONO � � '�' RESOLUTION OF THE CITY COUNCIL ��`9.kE p4L�'� . . The Metropolitan Council further indicated that because the amendment appears unlikely to affect policies and plans in other chapters of the Metropolitan Development Guide, further review of the amendment is waived. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orono hereby amends the Comprehensive Sewer Policy Plan element of the Orono Community Nlanagement Plan by incorporating into the plan the document entitled "Comprehensive Plan Amendment #7, Maxwell Bay Area MUSA Boundary" dated June 1998, and adds part XX��I - MaY�vell Bay Northeast to the Metropolitan Urban Service Area per the legal descriptions and maps attached hereto as Exhibit A, finding that: 1. The amendment meets the intent of the basic goals, objectives and policies set forth in the 1980 Comprehensive Management Plan. 2. � The amendment is consistent with the goals, objectives, needs and desires of Orono • residents. ' 3. The amendment is consistent with the planning goals and objectives of Orono's municipal neighbors. Adopted by the City Council of Orono,Minnesota this 9th day of November, 1998.
