Item: 2. Background: Accessory buildings are buildings that are subordinate to the principal building (on the same lot). The City Code regulates accessory buildings through a variety of standards, including size restrictions, placement, oversize buildings, and the installation of plumbing fixtures. Included in the presentation is additional information regarding Accessory Dwelling Units (ADUs), water - oriented accessory structures, and the associated definitions. Commissioners will review the current accessory building regulations and discuss the intent and goals of the regulations. A principal use may be either permitted or conditional. • Accessoryusemeans a use, building, or structure subordinate to and serving the principal use or building on the same lot and customarily incidental to the principal use or building. • Buiidingmeans any structure having a roof which may provide shelter or enclosure of persons, animals or chattel; and when the structure is divided by party walls without opening, each portion of such building so separated shall be deemed a separate building. • Private Garagemeans a detached accessory building or portion of the principal building, including a carport, which is used for storing passenger vehicles, and trailers. 5 Size Restrictions No accessory building shall exceed 1,000 square feet of footprint area, except that accessory buildings in excess of 1,000 square feet shall be considered oversized and will be allowed under the following conditions: Lot Area (acres) 0-1.99 Maximum Allowed Cumulative Total of All Accessory Building Footprint Areas on a Property (square feet) 2,000 2,400 2,800 3,200 2.00-3.00 3.01-3.50 3.51-4.00 4.01-4.50 3,600 4.51-5.00 4,000 5.01-6.00 4,400 6.01-7.00 4,800 7.01-8.00 5,200 8.01-9.00 5,600 9.01-10.00 6,000 10.01-11.00 6,400 11.01-12.00 6,800 12.01-13.00 7,000 13.01-14.00 8,000 14.01 or more 1.30% of lot area Building Placement and Materials • Accessory buildings on lake lots must meet the principal building setback if the garage doors face the street • All buildings on the same lot must be separated by a ten -foot setback. • With the exception of the RR-1A and RR-1 B districts, an accessory building may not be located street ward of the principal building. • Accessory buildings less than 1,000 square feet in RR-1A & RR-1 B districts may be street ward of the home if principal building setbacks and the exterior materials provisions in 6.12.7080(b) are met. • Accessory buildings and principal buildings shall be consistent in design and color. Exception: accessory buildings less than 120 square feet in area or are located on 2+ acre lots two acres in area or larger. 7 Oversize Accessory Buildings Only one oversized accessory building (OAB) shall be permitted on any property. An OAB is defined as an accessory building larger than 1,000 square feet. Any OAB shall be subject to the following conditions: a) Principal building setbacks must be met. b) OAB may not be closer to the front lot line than the home on the property. c) The maximum height for an OAB shall be 30 feet or the defined height of the home on the property, whichever is less. v: 4 4 M'i*41*r� FIF-IMMA 1.1 Water Connections are Permitted The provision of outside sillcocks and indoor water supply shall be allowed in any accessory building Toilet and Sinks are Permitted Installation of a toilet and/or sink in any accessory building shall be subject to the provision of municipal sanitary sewer or a conforming sewage treatment system designed to handle the anticipated flows from such fixtu res. Performance standards. No property within a single-family residential district shall have more than one dwelling unit, except an ADU maybe permitted as an accessory use to a single-family dwelling when the following requirements are met: a) The property must be located within the R-1A, R-16, LR-IA, 1-11-113, LR-1C, LR-IC-1, RR-1A, or RR-16 Zoning Districts. b) An ADU, attached or detached, shall only be permitted on lots one acre or greater in area. DETACHED ADU ATTACKEDADU c) No more than one ADU shall be permitted on a lot or parcel. d) Total floorarea of an ADU shall be no more than 50 percent of the primary dwelling unit's total floor area. The total floor area of an ADU shall not be less than 300 square feet. e) The ADU shall not have separate utility connections. The primary residence and ADU must be served by shared municipal water, sanitary sewer, gas, and electric utility services. If not served by municipal sewer and water, the primary residence and ADU shall meet the private well and septic requirements of this Code. f) An ADU shall be designed and maintained so as to be consistentwith the architectural design, integrated materials, style, appearance, and characterof the primary residence as a single-family residence. g) A minimum of two off-street parkingspaces (enclosed or on a driveway) shall be required for the ADU. h) ADUs must be constructed on a permanent foundation with no wheels. i) The property shall only have one address. The ADU may not be addressed separatelyfrom the primary residence. j) The ADU may not be subdivided or otherwise segregated in ownershipfrom the primary residence structure. Oro�� ® or l ERIOR (CONVERTED GARAGE) ADU kNTERIOR (UPPER FLO 10 Water -Oriented Accessory Structures Shoreland Overlay District Standard Water-orientedaccessorystructure orfacilitymeansasmall, abovegroundbuildingorotherimprovement, exceptstaifways, fences, docks and retamingwalls, which, because of the relationship of its use to a surface water feature, reasonably needs to be located closer to public waters than the normalstructure setback. Examples of such structures and facilities include boathouses, gazebos, screen houses, fish houses, pump houses, lock boxes, and detached decks. The only water -oriented accessory structures allowed to be located nearer the ordinary high-water level than the normal structure setback shall be: 1. One lockbox no greater than 20 square feet in area and no higher than 48 inches in height; 2. One flagpole setback from side lot lines a distance no less than the required principal structure side yard setback for the zoning district; and 3. One pumphouse no greater than 20 square feet in area and no higher than 48 inches in height. 11 0 s �7kE5Hp0.4. Building vs Structures Buiidingmeans any structure having a roof which may provide shelter or enclosure of persons, animals or chattel; and when the structure is divided by party walls without opening, each portion of such building so separated shall be deemed a separate building. Buiidingfootorintmeans the outline of the total area covered by a building's perimeter at the ground level (to the block/foundation) (1) Carports, covered porches and other similar building features which have no exterior walls shall be included as part of a building footprint by drawing a straight line between the outer edges of all support structures (and the main building if applicable). (2) The outer edge of building protrusions, bay windows or other similar features that extend outward from a building and are less than four feet from the ground shall be considered as part of the building footprint. Structure means anything which is built, constructed or erected, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some definite manner, which requires a location on, below or above the ground, land or water, or attached to something having a location on the ground, land or water. 12 C�oNO Points of Discussion kE5 H00 100- Do you feel the current regulations meets the needs of most properties? 001.
