RESOLUTION OF THE CITY COUNCIL

THE PLAT OF
LAURANNE WOODS
APPLICATION NO. 1116
WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development of
land within the City; and
WHEREAS, the City Cour.ci 1 has considered the application for a
subdivision replat by Paul Boyke, !`e subdivider; and
WHEREAS, on April 27, 1987, the City Council approved Resolution
No. 2166 granting preliminary approval for a replat of Lots 1 and 2,
"Brooks Green" at 793 and 795 North Ferndale Road; and
WHEREAS, the proposed plat contains two lots each exceeding the
2.0 acre minimum lot area requirement. Both lots require a variance
because they do not front on a public roadway. Lot 1 requires a variance
to the 200' lot width as measured at the rear of the 50' front yard
abutting the propusr-3 cul-de-sac; and
WHEREAS, the subdivision has been found to meet all other
standards of the RR-113 zoning district finding that each lot is of a size
and configuration that will allow its use as a single family residence to
be fully developed without the need of any variances; and
WHEREAS, Lot 1 has been demonstrated to contain suitable sites
for primary and alternate drainfields to serve the proposed single family
residence, and Lot 2 which contains an existing residence has been
demonstrated to contain a suitable alternate drainfield site to replace the
existing functional septic system if required at some future time; and
WHEREAS, Outlot A shown on the plat is dedicated for future use
as private roadway and cul-de-sac; and
WHEREAS, a proposed driveway within Lot 2 to serve Lot- 1 will
require that an access easement in favor of Lot 1 be granted over Lot 2 for
such driveway use; and
WHEREAS, Lot 1 contains a Designated Wetland over which a
Conservation and Flowage Easement was granted to the City as a condition of
the approval of the underlying plat of Brooks Green, and such easement
remains in effect; and

WHEREAS, Lot 2 contains a portion of a pond that is a Designated
Wetland and for which a Conservation and Flowage Easement is require•.l; and
WHEREAS, the existing house and garage on Lot 2 conform to all
required yard and setback requirements, and a house can be constructed on
Lot 1 that will meet the required 30' side (north and south) and 50' front
(east) yard and setback requirement; and
WHEREAS, the subdivider has completed all requirements of the
platting regulations of the City, including:
1. Completion of all the requirements of Resolution No. 2166.
2. Creation of a new private road right-of-way shown on the plat as
Outlot A, for future use as private roadway.
3. Concurrent with the creation of this Outlot, the Subdivider has
dedicated to the City a Road and Utilities Easement granting to the
City permanent access, improvement and utility easements over said
Outlot; the Subdivider has created non-exclusive ingress, egress,
drainage and utility easements over said Outlot in favor of all
abutting and/or benefiting lots including a declaration of certain
maintenance covenants wherein each of the abutting and/or benefiting
lot owners covenants and agrees to permanently maintain and pay the
cost of maintenance for said private road.
4. Dedication to the City of a Flowage and Conservation Easement
providing for limitations on the use of wetlands and/or drainageways
described therein and occurring within Lot 2.
5. Payment to the City of fee for the legal review and filing of the
plat easements and covenants in the amount of $150.00.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City
of Orono hereby approves the plat of Lauranne wuods, Hennepin County,
Minnesota; subject to the following conditions:
I. A variance is hereby granted for Lots 1 and 2 which do not font
on a public roadway as required.
2. A variance is hereby granted to the 200' lot width standards for
Lots 1 and 2.
3. The road outlot for future roadway use shall be privately owned
and maintained per the Declaration of Private Road Easement and
Declaration of Covenants for Maintenance of Same executed by the
developer.

4. Driveway access easement over Lot 2 shall be granted by developer
in favor of Lot 1, if such driveway is developed serving Lot 1.
5. The aforesaid plat shall be filed by the City of Orono with the
Hennepin County Recorder's Office on or before December 8, 1987
together with a certified original copy of this Resolution and
executed copies of the documents as noted above.
The approval granted by this Resolution shall expire if the plat
has not been filed by the date specified above. In that event, it will be
necessary to file a new application with the City of Orono for subdivision
review.

A RESOLUTION VACATING AN UNUSED PORTION
OF A DEDICATED DRAINAGE AND UTILITY EASEMENT
AT 793 AND 795 NORTH FERNDALE ROAD
WITHIN THE PLAT OF BROOKS GREE►f
SECTION 36, TOWNSHIP lie, RANGE 23
IN THE CITY OF ORONO, MINNESOTA

WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, on February 9, 1987, Paul & Virginia Hoyke filed a
petition with the City of Orono requesting vacation of a portion of
drainage and utility easements orginally dedicated within the plat of
Brooks Green, legally described as follows:
per Exhibit A, attached; and
WHEREAS, after due published and posted notice, a public
hearing was held before the Planning Commission on March 16 and April
20, 1987, regarding said vacation and all persons interested were
given an opportunity to be heard; and
WHEREAS, after due standing and consideration, the Planning
Commission recommended approval of the requested vacation and the
Council of the City of Orono finds that said vacation, as proposed, is
in keeping with the public inaerest in consideration of the following
findings:
1. The vacation does not affect access to or use of any
adjoining property.
2. The City has not and does not intend to develop, improve or
use the portion of dedicated drainage and utility easement
described above.
3. The portion of dedicated drainage and utility easement as it
exists :serves no public purpose.
4. The portion of dedicated drainage and utility easement, as a
result of the replat of Brooks Green will no longer coincide wi'h
the boundary between the properties at 793 and 795 North Ferndale
F.oad .

NOW, THEREFORE BE IT RESOLVED, that the petition of Paul 6
Virginia Boyke is hereby granted by the --ounci 1 of the City of Orono
and that the portion of dedicated drainage and utility easement
legally described above is hereby vacated. The granting of the
petition is subject to the following conditions:
1. As part of the replat of the plat of Brooks Green, the
applicants shall grant new drainage and utility easements 5'
either side of interior lot lines.
2. This resolution shall be filed only after Council approval of
the final plat of Brooks Green.
Adopted by City Council of the City of Orono, Minnesota at a
regular meeting held April 27, 1987.
