HomeMy WebLinkAboutResolution 4352 � , � � O� . • O O ��,. - C ITY of ORONO � � �� G'�� RESOLUTION OF THE CITY COUNCIL ��kEsH04�' NO. �- � � � A RESOLUTION APPR4VING A FOR PROPERTIES OF A LOT LINE REARRANGEMENT LOCATED AT 60 ORONO ORCHARD ROAD SOUTH � AND 45 SMITH AVENUE FILE NO. 2510 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and � � WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision of a lot line reanangement by Douglas Whiteley and Claudia Whiteley and David Hust and Heidi • Hust (hereinafter "the subdividers") of properties legally described as: Lots 57, 58, 77, 78, Orono Orchards, Hennepin County, Minnesota. and Lots 59, 60, 75, 76, Orono Orchards, according to the recorded plat thereof, EXCEPT the southeasterly 35.00 feet of said Lot 75, as measured at a right angle to the southeasterly line of said Lot 75, Hennepin County, Minnesota. � To be rearranged by transfer of property within the above described properties to as follows: E�ibit "A° � . � WIiEREAS, After due published and mailed notice in accordance with Minnesota � ' Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on August 16, 1999 at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the subdividers have completed all requirements of the City for a subdivision to rearrange the properiy lines between 60 Orono Orchard Road South and 45 Smith • Avenue. WI�REAS, At their regular meeting held on September 27, 1999, the Orono City Council considered the subdivision application of Douglas and Claudia Whiteley; and David and � Heidi Hust, noting the following findings of fact: 1. The property is located within the RR-1B, Single Family Rural Residential District requiring a minimum of 2 acres lot area. The existing lots are as follows: � 60 Orono Orchard Road 55,862.6 s.f. 45 Smith Avenue 52,350.2 s.f. 2. Both lots are scheduled for sanitary sewer installation. The rearrangement will not require drainfield sites on each lot. 3. Drainage and utility easements have been dedicated along interior property lines. • 4. Lots in the RR-1B district are required to be 200' wide at the front yard setback. Each lot increases 17' in width. The impact on the rear property width would be minimal with each lot only losing 17' in width at the rear. 5. The code defines subject lots as through lots. NOW, THEREFORE, BE IT RESOLVED, that the City Council of Orono hereby approves the lot line rearrangement of the above referenced property by the subdividers as shown on the certificate of survey by David E. Crook, a licensed surveyor, dated July 21, 1999 and revised September 20, 1999, attached Exhibit "B". The approval is subject to the following conditions: 1. The new legal description for Parcels A and B, as shown on the survey sited above, � shall read as follows: . Exhibit "A" 2. The aforesaid division shown on the attached Certificate of Survey shall be filed by the City of Orono with either the Hennepin County Recorder's Office or Registrar of Titles Office on or before March 27, 2000 together with a certified original copy of this resolution. 4. The approval granted by this resolution shall expire if the division has not been . filed by the date specified above. In that event, a new application shall be required for the City of Orono review. LEGAL DOCUMENTS required: a) Title Opinions addressed to the City. All owners, mortgage holders or others with properry interest indicated therein shall sign the plat and all other documents affected by such interest. • b) The subdivider must provide certified copies of all recorded easements currently affecting the property. c) Copies of Certificate of Survey for filing with Hennepin County.
