SKETCH PLAN REVIEW
The applicant proposes dividing 2.7 acres into two lots►. The
pr_)perty consists of a main house, guest house and carriage house.
Mr. Scherbe,r requests A lot area variance for the lot with the
quest house and garage. The existing driveway serving the guest
house rune in an east -west direction and ideally a lot line continuing
along the southern e6ge of they driveway would be preferred. I would
advise against an area variance. The proposed lot line must meet
the setback of the accessory structure (10') and the main house
(10' side yard). The preliminary plan must ,chow a defined east -west
division line, setback of existing structures, dimensions and area
noted. Only the lot with the main house in t,, have riparian righLe.

Review of Preliminary plans - The applicant has complied with the
directions of the Planning Convnyssion and submitted a preliminary
plan designating the necessary 1 acre area for the northern lot..
All existing structures meet the necessary setback for the LR-lit
zoning district except for the shed. Applf..;ant must decade if shed
is to remain. If it in Lo remain at that location, the structure
will be recognized as a non -conforming use with a zero lot line
setback. Staff recommends for approval the subdivision of Paul
Schemer su;3ject to the following conditions:
I. Only one lot (southern lot) is to have riparian rights.
2. A park dedication Fee of $400.00 for the nrwly created residential
let (northern lot).
3. Existing accesses to remain - northern lot to deed zccess easemprit
in favor of southern lot - owner wishes to retain loop driveway.
4. If shed is to remain, structure will be designated as a non-
conforming use.

MINUTES OF A PLANNING COMMISSION MEETING HELD ON OCTOBER 15, 1979
The Planning Commission met on the above (late.
Present were the followinq members: Chairman
Wilson, McDonald, Hannah and Jobbour. Mabut; t:h
repremented the City staff.
Wilson announced the Public. Information Meeting.
Mabustl: stated she had the Affidavit of
Publication and Certificate of Mailing. The
applicant was not represented. Hannah expressed
concern that if the gar.acle was to be divided
with the carriage house, the main house would
not have a garage and would have difficulty
meeting the zoning setbacks to construct a new
garage. Mabusth stated there wns sufficient
room to the south of the main house for a
detached garage.
Present were Mr, and Mrs. Lauer, 1430 Bohns Point
Road, whose main concern was sn existing access
easement which was not shown an the plat
presented by the applicant He showed an earlier
survey which dill indicate the easement. After
discussion, it was decided that the platting would
not affect the easement, however, a reyuireemsent of
approval could be proof of the easement as a part
of the title. Mabusth requested that the Lauers
and Mr. Rhodes write a letter to the City regarding
them concerns with the easement.

PRELIMINARY SUBDIVISION
The Planner's review adds the following comments:
1. The park fee should not be char(jed as there is an existing
dwelling on bc)t.h lots.
2. Each lot han—,arat&, actually existing access. Any
mutual easement for reciprocal. use should be a private
matter of no concern to the City.
3. Mr. Lauer's concern for the easement across the north
part of the property is natural. The easement is developed
as a gravel drive and though poorly maintained, is a
secondary access to the Lauer property. I would suggest
requiring this easement to be platted as an outlot so the
access will be visible on the plat and will be lass likely
to be encroached upon in the future. The City could ignores
the easement and assume that it, will carry through with
validity, but the outlot method will assure the intent of the
easement in providing access to the otherwise land -locked
Lauer lot.
4. The encroaching shed is of minimal value and easily moved anti/or
removed.
5. The mr.:st serious question was apparently not disc sried by the
Planning Commission. The neighboring house at 14d0 Hohns Point
is shown as encroaching on this property. We have a survey on
file showing a 50 ft. setback for the original construction
in 1962, plus other permits for a 24 x 24 addition and
conversions without surveys, but nothing to indicate such an
encroachment.
The Scherbe*r's surveyor should recheck and confirm or clrir-
up any encroachment.
If there is encroachment, I suggest that at least 10 feet of
side ,Ard be platted and sold to the neighbor to resolv, this
problem. Such a sale would not adversely affect this property.
6. Bohns Paint Road should be platted and dedicated 33 feet from

They advise Council that it is difficult to deny such
ap;,lications when there are no objections from
neighbors and variances for setback on antenna height
are not required.

ground discussion and recommendation.
It should be noted that the house, and the proposed
antenna location, is can a substantial rise and that
the tower will, therefore, be visible over the top
of the trees and across Long Lake.

The City has received and is reviewing a proposed subdivision of the
property immediately north of your home. As part of the dorutnentation
required for that. review, a certificate of survey was prepared and is
attached for your information.
The survey discloses a problem in that tome of the improvements on
your property are shown to be encroachirg onto tha Seherber uroperty.
I suggest, that you review this matter with Mr. 5cherber to cietei>nine
whether or not this encroachment actually exists and what steps can
be taken to resolve the Apparent title defect which appears to affect
both properties.
if the survey is correct and some encroachment exists, I suggest that
an expeditious solution would be to realign the property line enough
to provide a reasonable setback. Thi- has b`en mhown on the attached
survey copy. The aeomplishment of tt j realignment can be done as
part of the plat that Mr. 5cherber is undertaking. The City is
,waiting your reply bafore completing this subdivision.

I an contacting you on behalf of Mr. Paul Scherber. owner of the property
located at 1410 i 1420 Bohn's Pt. Rd. within the Village of Orono, which has recently
been before you end obtained your preliminary approval for subdivision. subject to
several -!oaditions, referring to vour notice,Cur.trol No. 508 an the meeting of
October 30, 1979.Mr. Scherber is in agreement with all the conditions set forthwith
the exception of the planning Department's recommendad solution to the lest condition
ie; Sell or grant to the Solomonson Property that land which hie nhr:lb fence presently
occupy due to an onc:roac.hment, plus an additional 10 feet. to allow more proper
setbacks to be created for the benefit of said property. It in Mr. 9cherber's
sincere opinion that although ideeliattcly from the point of view of the Solkmonson
property and.the planning dept. this would be a very desirable solution, yet he finds
it would be highly detrimental to his property for several reasons. The fcct that i!
would hinder possible future plans for expansion of the horse and or the addition of
a garage. which will have to be placed on that end of the home due to setback require-
ments, by sight and peace of mind being that a fence, hedge or other obstructions
night be placed there, which woula awkwardly jut into what is now a smooth and free
flowing lawn.not to mention the obvious quantit3 of land just lost from the ysrd.There
are also certain financial effacts to take into consideration, due to the alteration
presently and in the future upon any resale.
Having need of council approval to complete this subdivision, which has boon
totally within all the requirements of the village statues and regulations, Mr.
Scherber has felt that the village has possibly applied undue pressure upon him to
accept total responsibility for this encroachment situation. Yet the problem exists
whether or not the subdivision is completed. also examining the origination of the
problem, the responsibility would not Its with the party who had been trespassed
upon but with the trespassor and the 3overnini, body which was to onforce the zoning
and not back requirements at the time building permits were issued and construction
was being completed. Mr. Scherber does not want to pinpoint blase, @ruts a legal
entanglement with his neighbors,or draw on the patience of the Village Council too
heavily, realising that nun@ of you readtng this, were involved with what happened
then. He would sincerely appreciate your acknowledging the merits of, and ,accepting,
his proposed solution. He is willing to grant, without cost, to the Solomonson
property, that land contained in "out lot A" on the Accompaning survey. which will
allow the minimun 3 ft. setback required by the State without all the possible
turmoil that can soawtimee result out of boundary disputes i+nd uithaut It being
too detrimental to his own property and well being.
I believe Mr. Scherber has been very objective in his consideration of this
situation and oleo very generous with the proposed solution. It may not be the
most ideal, viewed strictly by set back requirements, but I sincerely believe it
to be most fair to all parties concerned in obtaining an eq Atable solution.

determination of South Property Line
The Scherber application received preliminary approval from Council
at their October 30, 1979 meeting. One point was left unresolved
that the applicant and his neighbor, C. Bruce Solomonson, agree
upon a transfer or sale of a piece of land to provide a minimal
setback for Solomonson's encroaching structure. Planning Cni"ission
is asked to make a recommendation concerning what the minimal setback
should be. Mr. Solomonson is agreeable to any setback the City deems
necwssary (nos, letter dated January 4, 1980). Mr. Scherber wants a
3' setback, the minimal setback required by the Building Code. Staff
has suggested a 10' setback, the minimal required by the Zoning Co..*.
Review of hardships ci ad for applicant (sea David Carlson's letter
received in this office on January 15, 1980):
1. !finder future expansion of main structure or on attached garage.
2. Aesthetics of existing yard.
3. Negative financial effect - resale.
4. Unfair to expect Scherber to bear full responsibility for
encroaching structure.
MTNUTES OF A PLANNTNG COMMISSION MEETING HELD ON .,ANUARY 28, 1980
The Planning Commission met on the above. date. Present ATTENDANCE
were the following members: Chairman Wilson, Adams, 7:30 P.M.
Hammerel and Jabbour. Mabusth represented the City st,eff..
Mabusth advised the Planning Lommission that their PAUL SCHF.RBER
recommendation was sought concerning the realignment 1420 Bohns Pt.
of the south property line for the Scherber eubdi, ision. ,U,BpZTON
The State Building Code requires a minimal 3' setback (�508)
from the property lino Gefnre structural modifications
are required. The Orono Zoning Code requires a 10'
setback for accessory structures. Mabusth noted that
the proposed plan did show a setback for the garage of
10' and the shed and ,fence were setback 3' from the
property line. Dave Carlson, representing the applicant,
reviewed Mr. Scherber's position. Mabusth noted for the
record Mr. Solomonson's letter in which he states that
he would abide with any decision the Council deems
necessary.
Frahm arrived. 7:40 P.M.
Adams moved to recommend approval of the proposed lot
line realignment as a reasonable solution in consideration
of the other alternatives; to approve the creation of
Outlot A allowing a 3' setback from the encroaching shed,
under the express condition that Scherber will transfer
Outlot A to Mr. Solomonson. Outlot A must be legally
combined with Mr. Solomonson's residential lot. It
should be noted that the setback created b) this sub-
division is unique to that shed. Motion seconded b-
Hacmaerel. Vote: Ayes (5) , Nays (0) . Motion passed
unanimously.
Wilson noted for the record that the ex.sting condition
was not a result of Scherber's doing and that the
maximum required of Scherber by the Planning Commission
was a 3' setback but that the Council han the option
to leave the lot line as is anJ require the removal
of the shed.
Mr. Haefele and Mr. Martin were present. Mabusth R. HAEFELE
reviewed for the applicants the responses from Hennepin E. MARTIN � R.
County Highway Department and the Public works Director. HASSEL
The Planning Commission was to determine if the area of Navarre Ln
Navarre Lane to be vacated although no longer used as a VACATION
public roadway still involved any put,lic interest. (1528)

Adams made a motion to recommend approval of the proposed lot
