RESOLUTION OF THE CITY COUNCIL ��kESH�4�' NO. 4 � 6 5 A RESOLUTION GRANTING A CONDITIONAL USE PERNIIT PER MiTNICIPAL ZONING CODE SECTION 10.03, SUBDIVISIONS 19-21 . FILE:#2524 • WI�REAS, W. Duncan MacMillan and Craigbank Associates, (hereinafter "the applicants") are the owners of the properties located at 1700 Fox Street and 1820 Fox Street within the City of Orono (hereinafter "City") and legally described as follows: � Lot 2, Block 1, HI Acres Two, Hennepin County and that part of the Northeast Quarter of the Southeast Quarter of Section 3, Township 117 North, Range 23 West of the Fifth Principal Meridian, Hennepin County, Minnesota (hereinafter "property"); and � WHEREAS, the applicants have applied to the City for a conditional use permit to permit land alteration of greater than 500 cubic yards and to allow grading within 5' of the � property line for relocating a driveway across a commonly owned property 1'ine per Section 10.03, Subdivisions 19-21. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #2524 for property located at 1700 Fox Street and 1820 Fox Street. 2. The property is located in the RR-1B, One Family Rural Residential Zoning District. 3. The property owners of 1700 Fox Street will file an easement in favor of the 1820 Fox Street property for the purposes of access. 4. The existing driveway is at a 13% slope without a significant landing to Fox Street. The new drive would begin at 2% for the first 50' and then an 8% drive would continue to the house. The easement is 30' in width (legal description attached as Exhibit A). 6. The proposed grading would not impact existing or future septic sites on the properry due to disturbed soil and slopes. 7. The City Council finds that granting a conditional use permit to allow grading within 5' of the property line and to allow land alteration of greater than 500 cubic yards will not be detrimental to the health, safety or general welfare.of the public, will not adversely affect light, air nor pose a fire hazazd or other danger � to neighboring properties, nor will its use depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. 8. The City Council has considered this application including the fmdings and recommendations of the Planning Commission, reports by staff and comments of . • the applicants and the affect of the proposed use on the health, safety, and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findirigs, the Orono City Council hereby grants a conditional use permit per Municipal Zoning Code Section 10.03, Subdivisions 19-21, to permit grading within 5' of the property line and land alteration of greater than 500 cubic yards, subject to the following conditions: 1. The applicants shall file an access easement'in favor of the 1820 Fox Street property over the 1700 Fox Street property. 2. The existing curb cut located on the 1820 Fox Street property shall be closed within 30 days of completion of the existing driveway. 3. The applicants shall obtain a land alteration permit from the City for grading, per the site plan attached to this resolution as Exhibit B. 4. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the Zoning Code, sHall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
