Application Summary: The applicant is requesting a Conditional Use Permit to place a

WHEREAS, Albert & Cheryl Trapanese, husband and wife, (hereinafter "the
applicants") are the owners of the property located at 3220 Bohn's Point Lane within the City of
Orono (hereinafter the "City") and legally described as follows:
Lot 1, Block 1, Bohn's Point Addition, Hennepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono for a variance
to Orono Municipal Zoning Code Section 10.24, Subdivision 5(B) to place a 25'x 35' detached
garage 20' from a street side lot line where a 35' setback is required. Additionally, the applicants
have requested a conditional use permit in order to construct a detached accessory structure on a
property which is considered a "through lot" by City Ordinance.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #03-2932.
2. The property is located in the LR-1 B Zoning District, which requires minimum lot area of 1 acre
and minimum lot width of 140'. The area of the property is 1.44 acres (62,835 s.f.) and defined
lot width is 183.51'.
3. The Planning Commission reviewed this application at a public hearing held on August 18, 2003
and recommended approval of the side street setback variance as well as approval of the
conditional use permit, based on the following findings:

a) The property has frontages in the front and rear of the property making it a through
lot.
b) The detached garage is considered an accessory structure, and
c) The variance of 15' is supported by the hardships of the location of the existing
driveway, the proximity to the house, the densely wooded rear yard, and the fact that
the lot is a comer lot.
d) The location of the proposed detached garage will be setback so as to meet a 20'
street side yard setback.
e) The proposal will not have a negative impact on light, air or open space in the
neighborhood.
f) Vegetative screen and privacy fence along Bohn's Point Road should be
maintained to avoid future visual impacts as viewed from Bohn's Point Road.
g) Density of the vegetation on the lot should be kept such that the visual impact
from County Rd 51 is minimized.
h) No access to Bohn's Point Road should be allowed for proposed garage.
4. The City Council has considered this application including the findings and recommendations of
the Planning Commission, reports by City staff, comments by the applicants and the public, and
the effect of the proposed variances on the health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar to it and do not
apply generally to other property in this zoning district; that granting the variances would not
adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring
property; would not merely serve as a convenience to the applicants, but is necessary to alleviate
a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the
applicants; and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants
a variance to Orono Municipal Zoning Code Sections 10.24, Subdivision 10 to allow a 20' setback
where a 35' setback is required, and a conditional use permit for the construction of a detached
garage/accessory structure on a through lot, subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicant, attached to this
Resolution as Exhibit A. Any amendments to the site plan which are not in conformity with
City codes will require further Planning Commission and City Council review.
2. Vegetative screen and privacy fence along Bohn's Point Road are to be maintained to
avoid future visual impacts as viewed from Bohn' s Point Road.
3. Density of the vegetation on the lot shall be kept such that the visual impact from County
Rd 51 is minimized.
4. No access to Bohn's Point Road shall be allowed for proposed garage.
5. Authorities granted by this resolution run with the property not with the applicants, but are
permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance and conditional
use permit will expire on that date (August 25, 2004).
6. Violation of or non-compliance with any of the terms and conditions of this resolution shall
constitute a violation of the zoning code, shall automatically terminate any authority granted
herein, and shall be punishable as a misdemeanor.
7. The undersigned applicants have read, understood and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs, successors and assigns,
hereby agree to the recording of this resolution in the chain oftitle of the property.
Adopted by the Orono City Council on this 25th day of August 2003.

approval of the requested variances and conditional use permit contingent upon the
requirement that a vegetative screen and privacy fence be maintained along Bohn's
Point Road, sufficient vegetation and trees must be maintained to pro~ide screening

Waataja reported that the applicant requests the following variances to construct a new
residence on a lot subject to a 75' creek setback:
1. Lot area variance to allow a residence reconstruction on a .455 acre lot when 2 acres is
normally required.
2. Front yard setback variance to allow a front yard setback of 30' when 50' is normally
required.
3. Side yard setback variance to allow a side yard setback of 10' when 30' is normally
required.
4. Rear yard setback variance to allow a rear yard setback of 28' when 50' is normally
required.
5. Creek setback variance to allow structure to be setback 68' from the creek wheri 75' is
normally required.
6. Hardcover variance to allow 2.7% hardcover in the 0-75' zone when 0% is normally
allowed and to allow 43.75% hardcover in the 75-250' zone when 25% is normally
allowed.
Waataja explained that the property is .455 acres located in a 2 acre zoning district. Since
many of the lots in this neighborhood are substantially smaller than the required 2 acres, it
has been staff policy to review these properties against the setback requirements of the ½
acre zoning district, which is a 30' front and rear yard setback and 10' interior side yard ··
setback. The applicant is proposing 29.6' front yard setback, 10.6' side yard setback, and a
27.7' rear yard setback.
With regard to the creek setback variance, the Zoning Ordinance requires a 75' setback

building on a through lot requires a conditional use permit. The purpose of the
conditional use permit in this instance is to assure minimal visual impact on neighboring
properties and views from the road.

In 2000, the applicants remodeled the interior of the home. Upon applying for a building
permit for their attached garage in 2003, the applicants were notified by City staff that a
conditional use permit and variance were required in order to construct their garage as
proposed. Applications were then provided to the homeowner to begin the CUP and
variance process.
Conditional Use Permit Analysis
The subject property is a corner through lot. A conditional use permit is required to
construct any accessory structure on a through lot. The intent of the Zoning Ordinance is
to ensure that the project is reviewed to protect sight-lines from roadways and
neighboring properties.
The subject lot is heavily wooded. It was chosen by the owners for its wooded character.
Care was taken with the initial construction of the home to preserve as many trees as
possible. The proposed garage would utilize the existing driveway with a minimal 200
s.f. addition. A privacy fence runs along the eastern property line along Bohn's Point
Road and is heavily vegetated. The visual impact of the garage from Bohn's Point Road
is non-existent. Additionally, the location of the proposed garage is set back 180' from
County Road 51 when 35' would normally be required. The distance and the vegetation
minimize the visual impact of the garage from the road or from properties to the North.

The placement of the proposed garage was determined by the heavily wooded lot. The
proposed location would require no additional removal of trees and will require minimal
additions to the existing driveway, thus keeping the hardcover for the property well

This property is a comer, through lot, which requires a 35' setback on 3 sides of the
property. A 15' separation is proposed between the existing home and the proposed
garage, where only a 10' setback from the principal structure is required (10.03.12).
Even in meeting the setback from the principal structure, the side setback would not be
met. However, the vegetation and privacy fence screen the proposed building from
Bohn's Point Road on the east, and the building would meet the rest of the setbacks and
requirements for the District. Additionally, this detached garage meets the 15' setback
required in 10.03.9(E).
Hardship Statement
Applicant has provided a hardship statement in Exhibit B, and should be asked for
additional testimony regarding the application.
Hardship Analysis
In considering applications for variance, the Planning Commission shall consider the effect of the
proposed variance upon the health, safety and welfare of the community, existing and anticipated
traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of
property in the surrounding area. The Planning Commission shall consider recommending approval
for variances from the literal provisions of the Zoning Code in instances where their strict
enforcement would cause undue hardship because of circumstances unique to the individual
property under consideration, and shall recommend approval only when it is demonstrated that such
actions will be in keeping with the spirit and intent of the Orono Zoning Code.
To evaluate the visual impact of the proposed garage an on-site inspection was conducted
by staff which revealed unique circumstance of dense tree and vegetation coverage. Staff
finds that the maintenance of large trees and additional vegetation on site, the natural
location for the proposed garage, along with the homeowner' s desire to minimize
hardcover by utilizing the existing driveway would constitute a hardship in this case. At
15' from the principal structure the proposed garage meets the 10' setback required by

code. If the structure were moved 5' closer to the principal structure a side street
variance would still be required.

Staff would make the following recommendations in regards to the criteria for "undue
hardship" pertinent to this application:
1. "The property in question cannot be put to a reasonable use if used under
conditions allowed by the official controls."
In the opinion of staff this criterion is not met.
2. "The plight of the landowner is due to circumstances unique to his property not
created by the landowner."
In the opinion of staff this criterion is met.
3. "The variance, if granted, will not alter the essential character of the locality."

4. "Economic considerations alone shall not constitute an undue hardship if
reasonable use for the property exists under the terms of the Zoning Chapter."

5. "Undue hardship also includes, but is not limited to, inadequate access to direct
sunlight for solar energy systems. Variances shall be granted for earth sheltered
construction as defined in Minnesota Statutes, Section 1161.06, Subd. 2, when in
harmony with this Chapter."

Detailed Hardship Statement
The proposed garage location is requested for the following reasons:
1) To minimize the impact of hardcover

2) On the set back to Bohn's Point Road there is a 6 foot high fence with
growth on it. Thus decreasing the set back for the garage will be barely
visible fromBohn's Point Road.
3) The only way to avoid decreasing the set back would be to place the proposed
garage further back on the lot. However, there are two large trees that would have
to be removed to accommodate this.
4) The proposed plac~ment leaves a 15' separation from house to proposed garage.
The minimum separation by ccide is 10', but even if we moved it within 10• it still
wou~~ not be within the Bohn's Point Road setback .. The proposed 15' separation
would improve the appearance of the property.
In summary, since the variance that we are reqesting would not negatively impact the
appearan.ce from Bohn's Point Road due to the existing fence, and since the proposed
placement will save 2 large trees. minimize the impact of hardcover, and provide an
attractive appearance to the property, we feel that it would be a hardship to deny this
requested set back variance.

Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or to
be stored shall be as set forth in this section.
Subd. 2. Information required to be given individual. An individual asked to supply
private or confidential data concerning himself shall be informed of: ( a) the purpose and intended
use of the requested data within the collecting state agency, political subdivision, or statewide
system; (b) whether he may refuse or is legally required to supply the requested data; ( c) any
known consequence arising from his supplying or refusing to supply private or confidential data;
and ( d) the identity of other persons or entities authorized by state or federal law to receive the
data. This requirement shall not apply when an individual is asked to supply investigative data,
pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision in the
individual income tax or property tax refund instructions instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored data on individuals, and whether
it is classified as public, private or confidential. Upon his further request, an individual who is
the subject of stored private or public data on individuals shall be shown the data without any
charge to him and, if he desires, shall be informed of the content and meaning of that data. After
an individual has been shown the private data and informed of its meaning, the data need not be
disclosed to him for six months thereafter unless a dispute or action pursuant to this section is
pending or additional data on the individual has been collected or created. The responsible
authority shall provide copies of the private or public data upon request by the individual subject
of the data. The responsible authority may require the requesting person to pay the actual costs
of making, certifying, and compiling the copies.
The responsible authority shall comply immediately, if possible, with any request made
pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays,
Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request within that time, he shall so inform the individual, and may have an additional five
days within which to comply with the request, excluding Saturdays, Sundays and legal holidays.
Subd. 4. Procedure when data is not accurate or complete. An individual may contest
the accuracy or completeness of public or private data concerning himself. To exercise this right,
an individual shall notify in writing the responsible authority describing the nature of the
disagreement. The responsible authority shall within 30 days either: (a) correct the data found
to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete
