MAYOR/COUNCIL REPORT Murphy stated while he was in Grand Island, Nebraska, he watched the local city council proceedings down there and that the setup for the council chambers was that each of the council members had their own separate screens and that their votes were all registered electronically. Murphy stated the unfortunate part of the meeting was that the council members had very little .eye contact with the audience. CITY ENGINEER'S REPORT City Engineer Kellogg had nothing to report . CITY ADMINISTRATOR'S REPORT 9. POLICE OFFICER CONTRACT FOR 2008-2009 Kiedrowski noted the City entered into new discussions with the police officers in late May and that the parties were able to agree on a number of items. The items in dispute were wages and health insurance costs . The police officers stated they are underpaid in relation to similar communities. As it relates to health insurance costs , the police officers believed that the costs are rising too rapidly , with the City indicating they have little control over what is happening in the health insurance market. Kiedrowski reported they were able to reach an agreement with the police officers on the wages by agreeing to a three percent increase on January I , 2008 and a three percent increase on January 1, 2009, as well as a market adjustment of .5% on July l , 2008 and July l , 2009 . The police officers had requested that they be allowed to discuss the health insurance issue further with the new city administrator . Kiedrowski noted the police officers have approved the proposal and that in his opinion the agreement is a fair one . Murphy complimented interim City Administrator Kiedrowski for handling the negotiations . A RESOLUTION GRANTING A CONDITIONAL USE PERMIT AND GRANTING A VARIANCE TO MUNICIPAL ZONING CODE SECTION 78-1404 FILE NO. 08-3262 Council Exhibit A WHEREAS, the City of Orono, a Minnesota municipal corporation, (hereinafter "Owner") is the owner of the property located at 2345 Blaine A venue within the City of Orono and legally described as: The east 132 feet of the north 200 feet of the south 495 feet of Lot 5, Block 9 Townsite of Langdon Park and Park, Navarro, all in Hennepin County, Minnesota (hereinafter "the Property"); and WHEREAS, Verizon Wireless (hereinafter "Lessee") has a lease that allows it to place an antenna facility on the Property; and WHEREAS, Matt Collins has made application on behalf of the Lessee to the City of Orono for a conditional use permit to place an emergency generator on the Property to serve the Lessee's existing facility; and WHEREAS, the application includes a variance to Municipal Zoning Code Section 78-1404 to allow structural coverage in excess of the allowed 15 percent; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on May 19, 2008, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS Page 1 of 4 1. This application was reviewed as Zoning File #08-3262. 2. The Property is approximately 0.65 acre in area and 112 feet in width. 3. The Property is occupied by the City's Navarre water tower and water treatment facility as well as a small park. The principal building, the water tower and the parking areas on the property do not comply with the required setbacks. 4. The Planning Commission reviewed this application on May 19, 2008 and on a vote of 5-0 recommended approval of the conditional use permit and variance, based on the following findings: a. The proposed generator is a reasonable adjunct to the wireless antenna facility. b. The design and location of the enclosure are compatible with the surrounding residential area. c. Most of the structural coverage results from the 7 foot high chain link fence around the water treatment facility. The fence is necessary to secure the facility. d. Because of the limited size of the water treatment facility, there is no location for the generator within the fenced area. 5. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed conditional use permit and variance on the health, safety and welfare of the community. 6. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right; and Page 2 of 4 would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby amends Resolution No. 5331 and grants a variance to Orono Municipal Zoning Code Section 78-1404 to allow an an emergency generator, subject to the following conditions: 1. Council approval is based on the plans submitted by the Applicant and attached to this Resolution as Exhibit A. Any amendments to these plans may require further Planning Commission and City Council review. 2. The Lessee maintaining the fence in good condition and repaired in a manner consistent with the original design. 3. The Lessee keeping the area within the fence free of noxious weeds and tall grass. 4. The Lessee obtaining necessary building permits. 5. Authorities granted by this resolution are permissive only and must be exercised by completing installation of the generator and screening fence before June 23, 2009, or the conditional use permit and variance will expire on that date. 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. Pertinent Zoning Ordinance Sections 78-348 Conditional Uses in LR-IC. Sec. 78-911. Purpose. In order to give the district use regulation the flexibility necessary to achieve the objectives of this chapter, in certain districts, conditional uses are permitted, subject to the granting of a use permit. Conditional uses include those uses generally not suitable in a particular zoning district, but which may under some circumstances be suitable. When such circumstances exist, a conditional use permit may be granted. Conditions may be applied to issuance of the permit, and a periodic review of the permit may be required. The permit shall be issued for a particular use and not for a particular person. Because of their unusual characteristics, conditional uses require consideration so they may be located properly with respect to the objectives of this chapter and the comprehensive municipal plan and with respect to their effects on surrounding properties. In order to achieve these purposes, the council is empowered to grant and to deny applications for conditional use permits and to impose reasonable conditions upon the granting of these permits. Sec. 78-916. Granting of permit. Survey Annotated by Staff to Show Structural Coverage Background Verizon Wireless leases space on the Navarre water tower for an antenna. The equipment is housed in a portion of the water treatment building specially constructed for it with additional equipment north of the garage building. Verizon wishes to add an emergency generator to provide electricity for the equipment and antenna during an outage. The natural gas powered generator would be approximately 80 inches high with a footprint of 40 inches by 9 foot 2 inches. It would be placed within a 12 foot by 15 foot fenced enclosure located about feet north of the. The fence would be eight feet high and constructed of 6 inch wide cedar boards with two inch spacing between the boards. Structural Coverage: Areas enclosed by fences taller than six feet are considered structures. Because of the fence around the water treatment facility is seven feet high structural coverage well over 15 percent. The enclosure would increase structural coverage. FILE 08-3362 May 19, 2008 Page 3 of 3 Current Use: The portion of the site north of the water treatment facility is a passive park. It contains three benches. The benches would remain usable. Adjacent Residential Structures: The generator would be a minimum of 100 feet from surrounding houses. Noise Level: When operating the generator produces 57 decibels of sound at 23 feet Literature from the Minnesota Pollution Control Agency describes this noise level as comparable to the sound of a business office. Issues for Consideration Apparently without realizing it Council granted structural coverage variances when it approved the addition to the water treatment building in 2002 and the erection of a seven-foot high fence around the water treatment facility. It is common for commercial sites to exceed the 15 percent structural coverage limitation. Because of the underground cabling required between the generator and the equipment and the needs of the water treatment plant the generator could not be placed in a permitted location within the existing fenced area. Are there any other issues or concerns with this application? Staff Recommendation Planning Staff recommends approval of the conditional use permit and the structural coverage variance subject to: 1. City Council approving the lease amendment. 2. The fence being maintained in good condition and repaired in a manner consistent with the original design. 3. The area within the fence being kept free of noxious weeds and tall grass. 4. Issuance of a building permit for the fence. A.1 05.07.08 E-1 GENERAL NOlES: An existing external buried ground ring should be found around the perimeter of the existing equipment shelter and/ or tower foundation. A lead shall be run from the generator base to the existing ground ring. An external buried ground ring shall be established around the generator and The ground ring shall be kept 24" from foundations The buried external ground ring shall consist of #2 solid bore tinned copper conductors. A minimum bend radius of 12 inches shall be maintained. Connections from the ground ring conductors to the ground rods shall be made by exothermic welds, brazed welds, or gas tight listed compression connectors pre filled with antioxidant compound. Ground rods shall be galvanized stee~ 10'-o" by 5/8"0, spaced 8'-0" to 15'-0" apart. Rod tops shall be driven to a depth of 6" below frost level. Rods and ring shall be kept 24 inches from foundations. All below grade connections shall be joined by exothermic welds or by gas tight UU67 fisted compression connectors. Connections shall Dai be coated with cold galvanizing compound. All connecting lugs shall hove two hole tongues. Lugs joined to solid conductors shall be joined by exothermic or brazed welds or shall be UL listed, 10,000 PSI, irreversible long barrel compression lugs or RECOGNIZED two hole screw on ring terminal. All lug connections and their mating surfaces must be cleaned to shiny metal and lightly coated with a non oxidizing type conductive grease or compound. All exothermic connections to galvanized materials shall hove the galvanizing ground off prior to making the connection. After the connection has been made, the joint shall be re-coated with a cold galvanizing compound. #2 Solid Bare Tinned Copper Lead. Leads from the generator frame sholl connect to the generator ground ring by one exothermic weld or by gos tight UL 467. fisted compression connectors. Leads from generator ground ring shall connect to the exisitng external round ring by one exothermic weld or by gas tight UU67 listed compression connectors Each vertical support pipe of the exterior generator ice shield bridge. The ice shield grating shall be jumpered to the vertical support pipes with #2 Solid Bare Tinned Copper at each vertical support pipe. Each ice shield grating shall be jumpered to each other with #2 Solid Bore Tinned Copper. NEW GROUNDING SHALL BE BONDED TO EXISTING LE"AD 1 lHAT IS FOUND AROUND EXISTING EQUIPMENT SHELTER OR TOWER.
