Murphy inquired whether the picture that is included in Council's packet is what will be constructed and what color the structure would be painted. Curtis stated the applicant is present and can answer questions. The applicant would also like to address the setback issue with the Council. Erickson stated it is a metal building and that it would be brown and a dark beige . Erickson stated the southern boundary is close to 100 feet and that he has spoken to the neighbor to the south about the building and that the neighbor does not have a problem with the location. Curtis noted that neighbor did contact Staff on Friday. McMillan inquired why the location was being changed. Erickson stated the land in that area is flatter and that he would be removing a couple of trees . Erickson stated the building would be located 125 feet from the west and 100 feet from the south. Rahn moved, McMillan seconded, to adopt RESOLUTION NO. 5609, a Resolution Granting a Conditional Use Permit and Variance for the Property Located at 720 Big Island, with the language in Item 3(d) of the resolution being amended to read a setback of 125 feet from the west and 100 feet from the south VOTE: Ayes 5, Nays 0. 11. SUAD AZHARI TRUST, 1745 FOX STREET-SUBDIVISION RENEW AL - RESOLUTION NO. 5610 Mark Gronberg, Surveyor, was present. Gaffron stated the issue on this application is that replacement of the existing septic system was required within two years of filing final plat. The original deadline for filing would have been July of 2007 but this subdivision renewal would extend that to July of 2009. Murphy inquired whether the septic system is failing at the present time. Gaffron stated it is nonconforming due to the separation and to his knowledge the septic system is not failing. P AGE 10 MINUTES OF THE ORONO PLANNING COMMISSION MEETING Monday, April 16, 2007 6:00 o'clock p.m. (#07-3278 John Terrance Homes, Continued) Gaffron inquired whether the motion approves reinstating the language but not to make the specific changes that the applicant is requesting Kroeger stated it would approve the requested changes but without the limit on the square footage. Kempf stated he was very concerned when this proposal initially came before the Planning Commission because of the lack of information that was provided, but that a large number of his concerns have been answered tonight and that he is fairly confident at this point that this project will succeed. Berg seconded the above motion. VOTE: Ayes 6, Nays 0. (Recess taken at 9:16 -9:23 p.m.) 9. #07-3279 ARTHUR ERICKSON, 720 BIG ISLAND, CONDITIONAL USE PERMiff, 9:23-9:36 P.M. · Arthur Erickson, Applicant, was present. Curtis stated the applicant is requesting a conditional use permit in order to construct an accessory building larger than 500 square feet as permitted by code . The applicant originally met with Staff and discussed a proposal to construct a 2,000 square foot accessory building on the property to house their large watercraft and lawn maintenance equipment. Following discussions with Staff, the applicant decided not to apply for a variance to construct the 2 ,000 square foot building and instead request the conditional approval instead for two 1,000 square foot buildings. However, after reviewing the site plan, Staff has concluded that two 1,000 square feet buildings placed ten feet apart will appear very much as one building. In referring to the mainland regulations regarding accessory building sizes and the applicant's property area, Staff finds that it may be reasonable to allow construction of a 2 ,000 square foot building. Having said this, the location of the closest adjacent property owner is 100 feet from the proposed buildings. The Planning C01m11ission may want to consider requiring an additional setback from the western property line. Similarly, the applicant has a considerable amount of acreage and perhaps an additional setback from the rear lot line is appropriate as well. Staff recommends approval of the variance to allow a single 2,000 square foot building to be constructed on the property with any additional conditions the Planning Commission deems appropriate. Kempf inquired what the other accessory buildings consist of. Erickson indicated the other marking on the overhead is depicting some stairs. Kroeger inquired whether the applicant would prefer one building rather than two. Erickson stated he would prefer the one larger building. Zullo inquired why the building is not being constructed closer to the residence. Erickson indicated they did not want a shed that was in the middle of the property but wanted to keep it close enough to the house so it could be accessed fairly easily. Zullo stated she does not agree with the location of the building given the amount of available land and that the adjoining property owner might not want to look at this structure. Curtis noted the City has not received any letter from that affected neighbor. Curtis stated the property is well shielded from the adjoining properties. Kempf noted there is a house located fairly near this property line and that given the amount of space available on this lot, the building is proposed for the most densely populated corner. Erickson stated the location was also chosen due to the hilly topography. Kempf inquired whether there is another service road running from the garage. Erickson stated there is a path road going down to the lake. Erickson indicated there are also some trails on the property. Kempf indicated he is not opposed to the building but that he would like to see it relocated. Berg asked if the building is approximately 125 feet from the lot line. Curtis stated it is. Berg inquired whether there are wetlands on the property. Erickson stated there are wetlands to the south and to the east. Erickson stated the proposed location makes it accessible from the house. Zullo inquired whether it could be moved to the other side of the lot. Erickson stated the land drops off considerably and it would be somewhat difficult to access the structure. VOTE: Ayes 6, Nays 0. 10. #07-3280 VOGUE ICF HOMES ON BEHALF OF TOM PARKER, INC., 1348 AND 1350 REST POINT ROAD, VARIAN CE, 9:36 -10:36 P.M. John Vogstrom, Vogue ICF Homes; Thomas Parker, Applicant; and Darren Hahn, Architect, were present. Turner stated the applicant is requesting the following variances to allow the construction of two new, nearly identical residences on adjacent lots: 1. A lot area of 0 .3 3 acre when one acre is required; 2. A lot width of 67 feet when 140 feet is required. 3. A hardcover of 29 percent in the 75-250 foot zone when the maximum is 25 percent; 4. A defined height of 32 feet when the maximum is 30. Three stories when the maximum is two and a half stories. These lots are located in Rest Point Park, which was platted in 1903. The house on 1348 was removed in 2003. The house of 1350 would be replaced . Until purchased by the current owner, each lot had a different owner. The proposed houses would be identical inside but would have different exterior treatments and roofs. Due to the topography of the lots, the basements are considered stories. The upper levels do not satisfy the definition of half story so the houses are three stories when the maximum is 2 ½ stories. At the 30 foot street setback, existing grade is five feet below street level for both lots. In the next 15 feet, they both drop another two feet. 1350 is then flat to the existing house. This house is a walkout, with the walkout cut into the bluff. 1348 drops another four feet. Both houses would have sport courts under the garages . The regular basement floor of both houses would be nine feet below street level. This would be one foot below existing grade for 1350 and one to two feet above existing grade for 1348. The garage floors would be on foot above street grade. Peak height would be about 32 feet above the street for both houses. The defined building height (the measurement from existing grade at the front of the house to halfway between the highest window and the highest peak) would be 32 feet. The maximum is 30 feet. Planning Staff recommends approval of the hardcover, lot width, and lot area variances subject to compliance with the City Engineer's recommendation regarding drainage. The applicant would like to construct a large accessory building to house their large watercraft and lawn maintenance equipment. RS District standards permit one-1,000 s.f. accessory building and another building not to exceed 500 s.f.. After discussions with staff the applicant decided not to apply for a variance to construct a single 2,000 s.f. building and instead requested conditional approval for two-1,000 s.f. buildings. The applicant's property is very large and has significant vegetative tree cover. Their request for two accessory buildings 1,000 s.f. each was in fact at the direction of staff after reviewing the RS regulations. However, upon reviewing the specifics of the application staff feels that allowing a 2,000 s.f. building to be constructed on this property is a reasonable request. Therefore staff has re-directed the scope of the application back towards a single large building. On the mainland a property of this size would be permitted a building of at least 3,000 s.f. based on the table within zoning code section 78-1434. Planning Commission Recommendation On April 16, 2007, Planning Commission voted 6-0 to recommend approval of the size variance and conditional use permit, subject to locating the building approximately 125' from each of the south and west lot lines. Planning Staff Recommendation Approval of the variances per the attached Resolution. COUNCIL ACTION REQUESTED Adopt or amend the attached Resolution. A RESOLUTION GRANTING A CONDITIONAL USE PERMIT AND AV ARIAN CE TO MUNICIPAL ZONING CODE SECTION 78-566 FILE NO. 07-3279 WHEREAS, Gerald A. Erickson Jr., et al, (hereinafter "the applicant") is the owner of the property located at 720 Big Island within the City of Orono {hereinafter the "City") and legally described as follows: Attached as Exhibit A, (hereinafter the "property"); and WHEREAS, the applicant has made application to the City of Orono for a variance and conditional use permit pursuant to Orono Municipal Zoning Code Section 78-566 to allow construction of an accessory building 2,000 s.f. in area where 1,000 s.f. is the maximum size. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 07-3279. 2. The property is located in the Seasonal Recreational District which requires a minimum lot area of five-acres. 3. The Planning Commission reviewed this application at a public hearing held on April 16, 2007 and recommended approval of a conditional use permit and variance based on the following findings: a. The property contains 754,176 s.f. in area or approximately 17 acres. b. A residence has existed on the property for many years. c. The 2,000 s.f. accessory building will not be visible from beyond the property lines as the lot is heavily vegetated. Page 1 of 5 d. The proposed structure will be set back an additional distance, at least 125 feet, from the side and rear property lines. e. The proposed structure complies with all setback requirements. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of. the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a conditional use permit and variance to Orono Municipal Zoning Code Section 78-566 to allow construction of a single 2,000 s.f. accessory building, subject to the following conditions: L Council approval is based on the site plan submitted by the applicants and annotated by City <staff, attached to this Resolution as Exhibit B. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Hardcover on the property shall not increase above the permitted levels outlined within Zoning Code Section 78-1288. Per the proposed plan as depicted on Exhibit B, the hardcover is proposed at 1.1% within the 0-75' zone; 1.3% within the 75'-250' zone; 1.9% within the 250'-500' zone; and 1.4% within the 500'-1000' zone. 3. The building may not exceed 2,000 s.f. in area and may not be located closer than 125' to rear and side lot lines. Page 2 of 5 4. The applicant acknowledges there will be no further accessory building approvals without reduction or removal of existing buildings on the property. 5. The applicants agree by executing this resolution and covenant that the property will be bound by the following conditions: a. The accessory building will not be used for a home occupation unless specifically approved by the City or if allowed by City Code. b. The accessory building will not be used as a dwelling; and c. The accessory building will not be rented, leased or otherwise provided for use as a dwelling under any circumstances. d. No future subdivision will be approved that places the structure within a lot that has no principal structure, exceptthat the city in its subdivision approval may grant a finite time period in. which the oversized accessory structure may remain without a principal structure, in order that a principal structure may be constructed. At the end of this time period, the oversized accessory structure must be removed if no principal structure has been constructed. e. If the property is subdivided, the oversize accessory structure and principal structure will be located together within a lot that meets the minimum lot area requirement for the given size of accessory building. f. In subdivision approval, the setback required for the oversize accessory structure shall remain. 6. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (April 23, 2008). 7. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 8. Within any RS seasonal recreational district, no accessory structure or use of land shall be permitted unless a permitted or conditional use is first established on such land, except as allowed in section 78-564(2). The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. In reference to the RS requirements regarding accessory buildings, does the Planning Commission feel that the number of additional accessory buildings on the property should be reduced? 2. Are there any other issues or concerns with this application? Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required · to supply the requested data; (c) any known consequence arising from his supplying or refusing to supply private or confidential data; and (d) the identity of other persons or entities authorized by state or federal law to receive the data. HARDCOVER ORDINANCE -In 1975, the Orono City Council adopted an ordinance limiting the percentage of lot area that can be covered with impervious surface ("hardcover") such as roofs, driveways, sidewalks, etc. on properties located within 1,000 feet of a lake. Studies have shown that sediments, oils, and debris carried into the lake from highly urbanized areas have a detrimental impact on the quality of water in the lake. The intent of Orono's ordinance is to ensure that rainfall run-off will be cleansed by filtering through grassed or vegetated yard areas before entering the lake.
