A RESOLUTION APPROVING THE PLAT OF TONKAWA SHORES 2ND ADDITION - FILE NO. 2577 WHEREAS,the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and VVHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; ancl . WHEREAS,the City Council has considered the application for a subdivision of a 31ot plat by Render Development, Inc. (hereinafter "the subdivider"); and WHEREAS,the subdivision has been found to meet the density requirements of the LR-1C zoning district; and � • WHEREAS,the subdivider has completed or will complete all requirements of the platting regulations of the City prior to release of plat for recording, including: 1. Completion of requirements of Resolution No. 4377, the resolution granting preliminary approval of the subdivision. 2. Dedication on the plat of standard perimeter drainage and utility easements. 3. Vacation of all drainage and utility easements on the plat of Tonkawa Shores. 4. Rededication to the City of a Flowage and Conservation Easement over those portions of wetlands and conservation outlots as depicted on the plat. 5. Dedication to the City and to the owners of lots in Tonkawa Shores 2nd Addition drainage and utility easements over all detention areas and drainageways within the plat providing for limitations on the use of these areas and shown on the plat as � drainage and utility easements. 6. Reexecution of a Subdivider's Agreement providing for the installation of improvements required as a condition of subdivision approval, sanitary sewer, • Page 1 of 4 � �.:'• . - � O ' V • O O ��b. - CITY of ORONO ,� _� �� �,'ti RESOLUTION OF THE CITY COUNCIL � ��kESH�4��' � NO. � � � � landscaping and posting of security to ensure that these required improvements are completed to the City's satisfaction, the design of said improvements subject to approval of the City Engineer and letter of credit subject to approval of the City Attorney. , NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the plat of Tonkawa Shores 2nd Addition,Hennepin County,Minnesota(Copy of Plat is attached to this resolution as Exhibit A), subject to the following conditions: 1. The private road shall be privately owned and maintained per the appropriate access easementlmaintenance documents to be executed by the developer. Ownership and maintenance of the private road has been established by execution of a Homeowner's � Association consisting of the owners of lots within Tonkawa Shores 2nd Addition.• 2. Subdivider shall concurrent with road construction, construct stormwater • management improvements generally as shown on the Preliminary Grading,Drainage and Erosion Control Plan reviewed and approved by the City Engineer subj ect to any revisions of said plan as may be required by the City Engineer. A final Gradin�, Draina�e & Erosion Control Plan must be apnroved bv the Citv En i� n�er prior to release of fina�lat for filin�. Erosion control shall be maintained over all disturbed areas until natural groundcover is restored, adhering to guidelines found in 'Best Management Practices for Protecting Water Quality in Urban Areas'. 3. No building permits will be issued until the private road base work and all • improvements as referenced in the Developer's Agreement for Tonkawa Shores is approved. 4. Prior to City release of the plat for filing, applicant shall provide evidence of fee ownership of the property in a form acceptable to the City Attorney, and applicant � shall meet any other title requirements as may be required by the City Attorney. 5. Applicant shall provide all documents noted in this resolution and the resolution approving the preliminary plat in a format acceptable to the City Attorney prior to release of the plat for filing. • Page 2 of 4 I �� °� • � � 6. - CITY of ORONO �, � ti � . '� RESOLUTION OF THE CITY COUNCIL ��9kE �4��'G � NO. _� r� � � SI3 6. All access to Lots 1, 2 and 3 shall be via Outlot A, Tonkawa Shores. No direct access to Tonkawa Road or North Shore Drive shall be permitted. A private easement e�cists across the property to the south of Lot 1 for access to the preexisting property. The City of Orono recognizes the access easement is required to the adjacent property to the west. However access for Lot l, Tonkawa Shores 2nd Addition shall be required only from Outlot A, Tonkawa Shores. No temporary or permanent access shall be permitted via the driveway easement to North Shore Drive for any lots in Tonkawa Shores 2nd Addition. 7. The aforesaid plat shall be filed by the City of Orono with either the Hennepin County Recorder's Office or Registrar of Titles Office on or before November 8, 2000 together with a certified original copy of this resolution and executed copies of � the easements, deeds and fmal copy of the plat noted above. The approval granted by this'resolution shall expire if the plat has not been filed by the date � specified above.
