RESOLUTION OF THE CITY COUNCIL

A RESOLUTION VACATING
AN UNUSED PORTION OF A
DEDICATED DRAINAGE AND UTILITY EASEMENT
AT 627 AND 629 NORTH F11121DALE ROAD
WITHIN THE PLAT OF LAUIRIMT ADDITION
SECTION 36, TOWNSHIP 11u", RANGE 23
IN THE CITY OF ORONO, MINNESOTA

WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, on June 26, 1987, Tea Q. Feig and Timothy D. Johnson
filed a petition with the City of Orono requesting vacation of a portion of
drainage and utility easements originally dedicated within the plat of
Laurent Addition, legally described as follows:
An easement for drainage and utility purposes as shown on the recorded
plat of LAURENT ADDITION, being 5 feet on each side of the Easterly
and Southerly lines of Lot 1, Block 1, LAURENT ADDITION, not including
that for -ion of the 10 foot drainage and utility easement adjoining
the Northerly lines of. Lots 1 and 2, and not including that portion of
the 10 root drainage and utility easement adjoining the westerly lines
of Lots 1 and 2.
WHEREAS, after due published and posted notice, a public hearing
was held before the Orono Planning Commission on July 20, 1987, regarding
said vacation ,and all persons interested were giv^n an opportunity to be
heard; and
WHEREAS, after due standing and consideration, the Planning
Commission recommended approval of the requested vacation and the Council
of the City of Orono finds that said vacation, as proposed, is in keeping
with the public interest in consideration of the following findings:
1. The vacation does not affect access to or use of any adjoining
property.
2. The City has not and does not intend to develop, improve or use
the portion of dedicated drainage and utility easement described
above.
3. The portion of dedicated drainage and utility easement as it
exists serves no public purpose.
4. The portion of dedicated drainage and utility easement, as a
result of a concurrent lot line rearrangement no longer coincides with
the boundary between the properties at 627 and 629 North Ferndale
Road.

NOW, THEREFORE BE IT RESOLVED, that the petition of Ted Q. Feig
and Timothy D. Johnson is hereby granted and that the portion of dedicated
drainage and utility easement legally described above is hereby vacated.
The granting of the petition is subject to the following condition:
Prior to filing of this Vacation Approval Resolution with Hennepin
County, the property owners of 627 and 629 North Ferndale Road shall
grant to the City a new drainage and utility easement 5' either side
of the recently revised mutual lot bounuary.
Adopted by the City Council of the City of Orono, Minnesota at a
regular meeting held July 27, 1987.
