TO MUNICIPAL ZONING CODE
SECTION 78-1288
AND A CONDITIONAL USE PERMIT

SECTION 78-1286 AND 78-1250
FILE NO. 09-3425
WHEREAS, Cinda Collins, a single person (hereinafter "the applicant")
represents the owners of the property located at 650 Big Island within the City of Orono
(hereinafter the "City") and legally described as follows:
Lots 6, 7, 8, 25 and 26, PLEASANT VIEW LAKE MINNETONKA, Hennepin
County, Minnesota (hereinafter the "property"); and
WHEREAS, the applicant has made application to the City of Orono for
an after-the-fact variance to Orono Municipal Zoning Code Section 78-1288 to allow
12.5% hardcover within the 0-75' setback zone where only 2.6% is permitted for the lake
access stair in order to allow an existing replacement retaining wall, lakeshore
patio/walkway and lake access stair; and
WHEREAS, the applicant has made application to the City of Orono for a
conditional use permit pursuant to Orono Municipal Zoning Code Section 78-1250 to
allow grading within the 0-75' setback zone.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zoning File 09-3425.
2. The property is located in the RS, Seasonal Recreational District, which
requires a minimum lot area of 5.0 acres. The applicant's property is a
legal lot ofrecord and has 1.0 acres in total area.

3. The Planning Commission reviewed this application at a public hearing
held on January 19, 2010 and recommended approval of the requested
after-the-fact variance and conditional use permit based on the following
findings:
a. City Code 78-1282 allows for the installation of stairs, lifts and
landings in place of major topographic alterations on steep slopes.
b. The changes made to the stair system, lakeside patio/walkway and
retaining walls are nearly an in-kind hardcover replacement of the
previously existing lakeside deck, retaining walls and stair.
c. The newly constructed retaining walls have been partially screened
with native grasses.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the applicant and the public, and the effect of the proposed
variance and conditional use pennit on the health, safety and welfare of
the community.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance and conditional use permit would not
adversely affect traffic conditions, light, air nor pose a fire hazard or other
danger to neighboring property; would not merely serve as a convenience
to the applicant, but is necessary to alleviate a demonstrable hardship or
difficulty; is necessary to preserve a substantial property right of the
applicant; and would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants an after-the-fact variance to Orono Municipal Zoning Code Section 78-1288 to
allow 12.5% hardcover within the 0-75' setback zone where only 2.6% is pe1mitted for
the lake access stair to allow an existing replacement retaining wall, lakeshore
patio/walkway and lake access stair; and a conditional use pennit pursuant to Orono

Municipal Zoning Code Section 78-1250 to allow grading within the 0-75' setback zone,
subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicant and
annotated by City staff, attached to this Resolution as Exhibits A & B. Any
amendments to the site plan which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardcover in the 0-75' zone shall not increase above 12.5% or 1,555 s.f. per the
construction plan and survey as depicted on Exhibits A & B. Applicant is advised
that any future requests to increase hardcover or change the nature of
existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concurrent reduction in existing
hardcover.
3. Applicant must submit a complete after-the-fact building permit/land alteration
permit on or before June 30, 2010.
4. An engineer's opinion of the construction of all walls 4-feet and above as well as
a revised planting plan, outlining additional native vegetative screening for the
retaining walls, are required to be submitted with the building permit application.
5. Due to the fact that there were no retaining wall plans prior to construction and
the City had no opportunity to review the walls during the construction, the City
assumes no liability regarding the integrity of the walls as constructed.
6. Authorities granted by this resolution run with the property not with the applicant,
but are permissive only and must be exercised by obtaining a building permit for
the new construction within one year of the date of Council approval, or the
variance and conditional use permit will expire on that date (February 8, 2011).
7. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
tenninate any authority granted herein, and shall be punishable as a misdemeanor.
8. The undersigned owners have read, understand and hereby agree to the terms of
this resolution and on behalf of the owners and the owners' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of the
property.
