Carlson 2400 Mayflower Ave. Minnetonka, MN 55343 --------------------------------- COPIES: Charles L. Pegelow 12215 45th Ave. N. Plymouth, MN 55442 TYPE OF APPLICATION: Variance/Conditional Use Permit ____________________________________________________________ , _______________ _ DATE OF MEETING: 4/12/93 VOTE: 4 FOR 0 AGAINST ------------------------------------------------ COUNCIL ACTION -MOTION: Council granted approval of the conditional use permit and variance application per the findings and conditions of the resolution sent to you prior to the meeting. The resolution for 1781/1782 has been executed by Mr. Carlson. It is noted that Mr. Pegelow has not executed the resolution for 610 Big Island. In order to complete the filing of the resolution, it will be necessary for Mr. Pegelow to make arrangements to sign the original copies at the City offices at his earliest convenience. As soon as this is completed the resolution can be filed against the chain of title of the property. ch MINUTES OF A REGULAR ORONO COUNCIL MEETING HELD APRIL 12, 1993 ZONING ADMINISTRATOR'S REPORT (#4) #1298 VACATION OF FOREST BOULEVARD -RESOLUTIONS #3256-#3262 Hurr arrived at 7:42 p.m. Mabusth explained this application has been under consideration over the past 5 years. Last month the Counci I approved the vacation application for the Ryans (one of the original 10 applicants). The first phase of the vacation of Forest Boulevard for eight property owners was approved by Counc i l in May of 1988. During the second application Nelson questioned the issue of access to his property . At the time the City vacated Oak Place, it failed to maintain access to Ne I son's residence and an easement over sewer Ii nes. Easements wi l I now be necessary over four properties, of which one owner is not w I I Ii ng to _grant such easement. It is recommended Counci I approve vacation of the remaining parcels included in this application as the vacation wi 11 have no impact on the Nelson situation. Jabbour questioned why the process has taken so long and encouraged staff to expedite the process. Mabusth stated this Issue is not in the hands of staff, but rather a legal matter. It was . moved by Mayor Ca I I ahan, seconded by Goetten, to adopt Resolutions vacating an unused portion of Forest Boulevard within the plat of Saga HI I I Revised as fol lows: #3256 Kel Jen, 1435 Park Drive; #3257 Hodges, 1447 Park Drive; #3258 Frieler, 1331 North Arm Drive; #3259 Denze I , 1 295 EI mwood Avenue; #3260 Perkins, 1265 Elmwood Avenue; #3261 Howel Is, 1423 Park Drive; and #3262 Regnier, 1205 Elmwood Avenue. Ayes 5, nays 0. (*#5) #1771 JAMES MARKOE, 340 NORTH ARM LANE - FINAL SUBDIVISION -RESOLUTION #3263 It was moved by Jabbour, seconded by Goetten~ to adopt Resolution #3263 for Application #1771 James Markee, 340 North Arm Lane, approving the plat of Markee Addition. Ayes 4, nays O. (*#6) #1781/#1782 DAVID CARLSON, 620 BIG ISLAND - VARIANCE/CONDITIONAL USE PERMIT -RESOLUTION #3264 It was moved by Jabbour, seconded by Goetten, to adopt Resolution #3264 for Applications #1781/#1782 for David Carlson, 620 Big Isl and, approving a variance to a I I ow a season a I dwe I I Ing :to. be constructed In front of the average lakeshore setback I ine and a conditional use permit to al low such construction within the flood plain. Ayes 4, nays 0. 2 MINUTES OF THE ORONO PLANNING COMMISSION MEETING HELD NOVEMBER 16, 1992 (#4) A) #1785 DAVID CARLSON, 600/610/620 BIG ISLAND - PRELIMINARY SUBDIVISION, CLASS II, LOT LINE REARRANGEMENT & CREATION OF EASEMENT B) #1781/#1782 -620 BIG ISLAND -VARIANCE/CONDITIONAL USE PERMIT C) #1783/#1784 -610 BIG ISLAND -VARIANCE/CONDITIONAL USE PERMIT PUBLIC HEARING 9:21 -9:39 P.M. The Affidavit of Pub Ii cation and Certificate of Mai i ng were noted. David Car I son was present for this app I i cation. Mabusth explained at the time the survey was done for the property owners of 600 (Lot 3) and 610 (Lot 2) became aware that they did not own the lakeshore that they historically had been using. Mr. Carlson then asked them to participate in a lot I ine rearrangement to correct the riparian issue and other mutua I I y benefiting I ot I ine adjustments. Any approval of the lot I ine rearrangement must address the proposed substandard side setback of the existing cabin on Lot 2. Applicant has adv i sed the structure wi 11 be removed. She noted both new structures wi 1 1 be located in the f l oodplain , as are the existing structures. Because the areas of both seasonal cabins are over 800 s.f. in area, an on-site septic system will be required. The subdivision code requires anytime a private or pub I i c easement is created, subdivision approval is necessary. Easements wi I I be provided for Lots 1 and 2 sharing the septic system. Be I I ows noted the I arge I oft space proposed for the new cabin and the potential for bedroom usi expansion. Mabusth stated covenants would have to be executed to restrict the use of the cabin to a two bedroom use. Carlson said because of the cost and the value of the land, he felt the size of the structure was warranted. Kelley stated the Commission is concerned with the preservation of the land and the lake and could not consider monetary concerns . Car I son indicated the subdivision has been proposed to meet the setback and hardcover requirements. He said he has proposed to go up instead of out to meet that criteria. He added the loft area wi 11 be used as a play area for his children. He noted he has eliminated al I the problems in the area but the encroachment of the floodplain and the need for an average setback var i ance. 1 3 MINUTES OF THE ORONO PLANNING COMMISSION MEETING HELD NOVEMBER 16, 1992 ZONING FILES #1781/1782/1783/1784/1785 -CONT. Kelley commended Carlson on coordinating a joint septic system. Gwen Meyers, daughter of a neighboring property owner, noted their concern that Carlson proposes a large structure for the lot, and the area does not warrant that size. Mr. Meyers asked about Hennepin Parks' intent to create a park on Big Island. Jabbour explained past Counci Is felt that a regional park would be feasible on Big Island, but it currently is felt that the land should remain residential and the City Counci I plans to amend the Comprehensive Plan to reflect that attitude. Bel lows asked about using a wood foundation in the floodplain. Carlson stated the M.C.W.D. approved foundation. is requesting an architecturally Rowlette stated the loft area is not a legal bedroom, and added, she has one in her home and it is not used as a bedroom. It was moved by Rowlette, seconded by Johnson, to recommend approva I for App I i cations #1785, #1781, #1782, #1783 and #1784, for David Carlson, for property involving 600, 610, and 620 Big Island, for a pre! iminary subdivision, Class II, lot I ine rearrangement and creation of easement, and variances and conditional use permit, per staff recommendations, and subject to the resolution indicating the loft area can not be used as a bedroom. Ayes 6, nays O. (#5) #1762 PAUL W. SOYKE, 793 NORTH FERNDALE ROAD - PRELIMINARY SUBDIVISION - CONTINUATION OF PUBLIC HEARING 9:39 -9:44 P.M. Paul Boyke and Mark Gronberg were present for this application. Gaffron explained the application has been revised to provide only one riparian lot, therefore the standards for measuring the width of the homestead I ot have changed. The homestead I ot abuts the out lot along its east boundard as required. Another concern was the driveway and the effect it would have on the drainage in the area. He stated the applicant proposes reducing the height of the drive and adding a retaining wal I which wi 11 actual improve the drainage situation in the area. Gaffron stated the applicant has provided adequate deta i I so that staff fee Is comfortab I e with the proposa I. 1 4 CITY OF ORONO P.O. Box 66 Crystal Bay, MN 55323 473-7357 TO: David R. The building site is within the flvudplain of Lake Minnetonka, i.e. below ·the elevation of 931.5'. Therefore, the new cabin must be dohstructed with the lowest floor at or above the regulatory flood p.1~otection elevation (RFPE) , which is at least 9'.52. 5'.
