COUNCIL ACTION -MOTION:
Council granted approval of the conditional use permit and variance application per the
findings and conditions of the resolution sent to you prior to the meeting. The resolution for
1781/1782 has been executed by Mr. Carlson. It is noted that Mr. Pegelow has not executed
the resolution for 610 Big Island. In order to complete the filing of the resolution, it will be
necessary for Mr. Pegelow to make arrangements to sign the original copies at the City offices
at his earliest convenience. As soon as this is completed the resolution can be filed against the
chain of title of the property.

Hurr arrived at 7:42 p.m.
Mabusth explained this application has been under consideration
over the past 5 years. Last month the Counci I approved the vacation
application for the Ryans (one of the original 10 applicants). The
first phase of the vacation of Forest Boulevard for eight property
owners was approved by Counc i l in May of 1988. During the second
application Nelson questioned the issue of access to his property .
At the time the City vacated Oak Place, it failed to maintain
access to Ne I son's residence and an easement over sewer Ii nes.
Easements wi l I now be necessary over four properties, of which one
owner is not w I I Ii ng to _grant such easement. It is recommended
Counci I approve vacation of the remaining parcels included in this
application as the vacation wi 11 have no impact on the Nelson
situation.
Jabbour questioned why the process has taken so long and encouraged
staff to expedite the process.
Mabusth stated this Issue is not in the hands of staff, but rather
a legal matter.

David Car I son was present for this app I i cation.
Mabusth explained at the time the survey was done for the property
owners of 600 (Lot 3) and 610 (Lot 2) became aware that they did
not own the lakeshore that they historically had been using. Mr.
Carlson then asked them to participate in a lot I ine rearrangement
to correct the riparian issue and other mutua I I y benefiting I ot
I ine adjustments. Any approval of the lot I ine rearrangement must
address the proposed substandard side setback of the existing cabin
on Lot 2. Applicant has adv i sed the structure wi 11 be removed. She
noted both new structures wi 1 1 be located in the f l oodplain , as are
the existing structures. Because the areas of both seasonal cabins
are over 800 s.f. in area, an on-site septic system will be
required. The subdivision code requires anytime a private or pub I i c
easement is created, subdivision approval is necessary. Easements
wi I I be provided for Lots 1 and 2 sharing the septic system.
Be I I ows noted the I arge I oft space proposed for the new cabin and
the potential for bedroom usi expansion.
Mabusth stated covenants would have to be executed to restrict the
use of the cabin to a two bedroom use.
Carlson said because of the cost and the value of the land, he felt
the size of the structure was warranted.
Kelley stated the Commission is concerned with the preservation of
the land and the lake and could not consider monetary concerns .
Car I son indicated the subdivision has been proposed to meet the
setback and hardcover requirements. He said he has proposed to go
up instead of out to meet that criteria. He added the loft area
wi 11 be used as a play area for his children. He noted he has
eliminated al I the problems in the area but the encroachment of the
floodplain and the need for an average setback var i ance.

Kelley commended Carlson on coordinating a joint septic system.
Gwen Meyers, daughter of a neighboring property owner, noted their
concern that Carlson proposes a large structure for the lot, and
the area does not warrant that size.
Mr. Meyers asked about Hennepin Parks' intent to create a park on
Big Island.
Jabbour explained past Counci Is felt that a regional park would be
feasible on Big Island, but it currently is felt that the land
should remain residential and the City Counci I plans to amend the
Comprehensive Plan to reflect that attitude.

Paul Boyke and Mark Gronberg were present for this application.
Gaffron explained the application has been revised to provide only
one riparian lot, therefore the standards for measuring the width
of the homestead I ot have changed. The homestead I ot abuts the
out lot along its east boundard as required. Another concern was the
driveway and the effect it would have on the drainage in the area.
He stated the applicant proposes reducing the height of the drive

COUNCIL ACTION -MOTION:
The Council conceptually voted approval of the above referenced
conditional use permits and variance applications that would allow the
reconstruction of new seasonal dwellings on proposed Lots 1 and 2.
Approval resolutions will be drafted for the future meeting at which time
the final subdivision will be approved by Council. Staff must ask that
with the submittal of the final subdivision information that applicant also
provide a date for the razing of the seasonal cabin on proposed Lot 2.
Copies of the approval resolution will be sent to applicant before the
meeting. Please contact Jeanne Mabusth (473-7357) if you have any

This letter-0 is to confirm our discussion of September 28 1 1992,
concerning the construction of a cabin on Big Island in Lake
Minnetonka (27-133P).
The building site is within the flvudplain of Lake Minnetonka, i.e.
below ·the elevation of 931.5'. Therefore, the new cabin must be
dohstructed with the lowest floor at or above the regulatory flood
p.1~otection elevation (RFPE) , which is at least 9'.52. 5'. (Check with
the city of orono on the minimum ~levation; they may bl?c more
stringent than the minimum ~tate requirement.)
You indicated that fill would not be used to elevate the structure..
Therefore, the cabin in.uat be seou:cely anchored by a foundation
designed by either a certified archit~ct or engin~er which allows
water to flow freely beneath the structure • . /

In addition to the points above, the foll 1ng DNR concerns should.
be noted:
1. The vegetation and topography should be retain~d in a natural
state in the 37.5 1 shore impact zone of Lake Minnetonka.
2. The ordinary high water {OH:W) level of 929.4 1 (NGV:D, 1929) for
Lake Minnetonka should be noted in future plans and plats. It
is not clear whether the shoreline indicated is at the OHW or
not. The 929.4 1 contour should also be shown since that is
the critical elevation for building setbacks, limits of DNR
authority, etc.
3. Appropriate ~rosion control measures should be tak~n during
the construction period.· The Mirmi::ascta construction site
Erosion ahd sediment Control Planning f!andbook (Board of Wat~r '
& Soil Resourc~s and Association of Metropolitan Soil and
Water Conservation Districts) guidelines, or their equivalent,
should be followed,

4. If construction involves dewatering in excess of 10,000
gallons per day or 1 million gallons per year; the contractor
will need to obtain a DNR appropriations permit. You are
advised that it typically takes approximately 60 days to
process thevpermit application.

purpose and intended use of the requested data within the collecting state agency,
political subdivision, or statewide system; (b) whether he may ref use or is legally

David Carlson is making application proposing:
1. A lot line rearrangement.
2. A seasonal dwelling replacement.
3. Installation of a new septic system and drain field,
The property is referred to as 610 and 620, Big Island. (See
attached illustration.)
The property known as 620, Big Island is owned by David Carlson.
The property known as 610, Big Island is owned by Charles L.
Pegelow. Lot No. 18,Pleasant View at Lake Minnetonka, which is
adjacent to the Pegelow Property, is owned by Dr. George Adams.
David Carlson has a purchase agreement to purchase the Pegelow
property on a Contract for Deed contingent to the approval of
the ,subject proposal.
David Carlson is requesting approval to remove the existing
cabin on the property known as 620, Big Island and to build a
new cabin. Blue prints for the new cabin are attached. Land use
and zoning variance applications are being submitted.
A new septic system has been designed to meet all regulations
and will be shared by cabins on parcels 610 and 620, Big Island.
Two current outhouses will be eliminated. Details of the
installation as well as site evaluation and test reports are
attached.
A new well will be installed on the 620 parcel as illustrated on
the drawings. No well will be located within 75 feet of the
septic system.
On Pegelow's property (610, Big Island parcel), there is an
existing cabin that David Carlson will tear down and replace
with the now existing cabin on the 620, Big Island property, or
build a new cabin. Both cabins (on 610 and 620) will have frost
footings.
The owner of Lot 18, Pleasant View at Lake Minnetonka, has a
stairway from his cabin that encroaches the Pegelow property
(610, Big Island). David Carlson has made arrangements to deed
to that Ol;rner a strip of land providing him more shoreline and
eliminating his encroachment on other property.
Land use applications, zoning and variance applications and a
Class III Subdivision application together with required
materials and information have been submitted.
