(#8) ZONING FILES #1606, #1660 & #1659 BIG ISLAND INC., RECORD LOTS 12 & 19, BIG ISLAND CONDITIONAL USE PERMIT/VARIANCE -RESOLUTION #3006 VACATION -RESOLUTION #3007 Mr. Thomas Judd was present for th~ review. Gerhardson explained the applicants request a conditional use permit and variance to allow day use activities with some overnight camping, and to allow structural repairs to a deck located within _the lakeshore protected zone. Applicants are also requesting the vacation of the dedicated right-of-way. Mabusth explained that the portion to be vacated runs between the two parcels owned by applicant and together the parcels equal the 5 acre minimum lot requirement. She also noted that the Planning Commission requested conditions to be incorporated within the resolution of approval. Butler asked if the concerns of the adjacent neighbor, Erickson, have been satisfied. Mabusth noted that all concerns have been addressed and that the City has received no further input from either the Ericksons or their attorney. Butler felt that the use was in keeping with the zoning for the property, but she felt that the use should be properly inspected. Goetten asked about the deck to be constructed. 5 MINUTES OF THE REGULAR ORONO COUNCIL MEETING -AUGUST 26, 1991 ZONING FILES #1606, #1660 & #l~ag = eoNfi Jabbour noted that it is a steep hill and the deck is actually a launching pad which is very necessary. It was moved by Butler, seconded by Jabbour, to approve Resolution #3006, granting a conditional use permit and variance for day use activities for property located at Record Lots 12 and 19, Big Island and for the reconstruction of the deck within the 0-75' zone; and to approve Resolution #3007 approving the vacation of the public right-of-way within the subject property. Ayes 4 , nays o. (#9) ZONING FILE #1665 THOMAS MCCARTHY, 1424 BALDUR PARK ROAD VARIANCE -RESOLUTION #3008 Thomas McCarthy and his builder, Mi chi al Mu l aron i, were present for this application. Callahan explained that this matter has returned from the Planning Commission with a unanimous recommendation for approval. Mabusth noted that applicant's amended plan proposes a relocated detached garage. She referred to the lot coverage ordinance exception which states that no matter what size the lot is, a property is allowed 1 ,500 s .f. for the principal residence and garage. The applicant proposes an amended application with 1,499.9 s.f. of total area combined for residence and proposed garage. The Planning Commission had recommend that the proposal be amended by removing 31 s.f. of hardcover in order to satisfy the guidelines of this ordinance exception. It was moved by Butler, seconded by Jabbour, to adopt Resolution #3008, granting requested variances to permit the replacement of an existing deck within the lakeshore protected area and the construction of a 24'x22' detached garage within the street yard for property located at 1424 Baldur Park Road. Ayes 4, nays o. (#10) ZONING FILE #1666 MICHAEL HILBELINK, 2180 PROSPECT AVENUE - RENEWAL VARIANCE -RESOLUTION #3009 Michael Hilbelink was present for this matter. Gerhardson noted this is renewal of a variance application with an amendment to the original resolution noting the placing of appropriate controls for drainage control have been added to the resolution and appropriate easement documents have been executed. Butler proposed the area to the northwest of the temporary fencing be posted with "No Parking/Fire Lane" signs and make this area the drive to the loading area. It was moved by Jabbour, seconded by Goetten, to release the $5,000 cashiers check to the Art Center finding all conditions of the Developer's Agreement have been ·met. Ayes 5, nays 0. Application #1606 was approved as presented, subject to the conditions set forth in the staff memo dated July 5, 1991. The Planning Commission added the following: 1. Annual Joint Use Dock License to be limited to 15 slips. 2. Fire rings shall be subject to special protection such as those established for Big Island Vets Camp (supply of sand, water, blanket, etc.). 3. Applicant shall be responsible for submitting all proposed changes in by-laws related to membership to City for review. B. Application #1659 -Vacation of _20' unimproved alley. The Planning Commission recommended unanimous approval based on the following findings: 1. The City found no public use or interest in the unimproved 20' right-of-way. 2. The DNR concurred with vacation request finding no interest in the part of the DNR/State in maintaining the 20' wide public access to lake. 3. Based on the pattern of owners.hip of the properties of the abutting properties, the unimproved right-of-way no longer serves as access. Approval of the vacation is subject to applicant executing a special lot combination as already discussed above. c. Application #1660 -Variances. The Planning Commission unanimousoly approved variances as proposed that would allow repairs to existing swimming dock/deck located within the lakeshore protected area subject to the hardships noted in staff memo of July 8, 1991 as set forth by applicant in applicant's addendum. Mabusth, Building & Zoning Administrator Date: July 3, 1991 Subject: #1659 Big Island Inc., Record Lots 12 & 19, Big Island Vacation -Public Hearing Pertinent Ordinance - Section 10.12 -Applicant proposes vacation of unimproved dedicated right-of-way as shown on Exhibit B. List of Exhibits - A -Application B Plat Map C Property Owners List D Wetland Map E Letter to DNR F -Section of Orono Parks & Proposed Trail System Based on earlier review comments of staff, applicants were advised that the area of the unimproved alley could not be included within the dry buildable area needed to satisfy the 5 acre standard for a day-use conditional use permit. Required= 5 acres Existing= 4.74 acres Area of Unimproved Right-of-way= .28 acres Total Area= 5.02 acres Staff has reviewed the location of the dedicated right-of- way in relation to the current ownership pattern, usage, topography and adjacent wetlands and finds no public use for the subject area. If there is a zoning density change at some time in the future and new lot lines are defined, the City will acquire drainage and utility easements at that time. The Park Commission was asked to review the vacation request at their July 2nd meeting. Staff has been advised that the Park Commission did not address the vacation of the 20' alley and potential use of the area for a bike trail. This application will be rescheduled at the Park Commission meeting of August 6th. The DNR has been asked to respond to the proposed vacation of the 20' wide alley as it provides a public access to the lakeshore. Vacation of all right-of-ways that provide public access to the lake must be reviewed by the DNR. If staff receives no written comments from Ceil Strauss by your meeting date, staff will contact her office for conceptual direction. Zoning File #1659 July 3, 1991 Page 2 of 2 In regard to the Park Commission's review of the vacation petition, staff would ask that you review Exhibit F -a section of the comprehensive park/bike trail system as developed by the Park Commission and approved by the Council. There are no trail systems shown on Big Island, only the Veterans Camp. The Hennepin County Preserve Park is not designated. It would appear that the Park Commission had not considered bike trails on Big Island. Staff will contact the Chairman to see if this is even a valid consideration for the Park Commission's review. Pending final determinations from the DNR, staff would recommend the complete vacation of the 20' alley as platted in the rearrangement of Lot 1, Kitchel's Subdivision of Govt Lots 5 and 6 finding no public use for the unimproved right-of-way. Zoning File #1659 August 6, 1991 Page 3 Additional Comments and Planning Commission Recommendations Staff advised the Planning Commission that the DNR representative (John Stein) was contacted for comments concerning the proposed vacation. Mr. Stein concurred that in light of the current pattern of ownership and 5 acre minimum lot size for Big Island properties that the existing access serves no public purpose. The DRN would support the proposed vacation of the 20' wide alley. As for the bike trail issue, as with the Jeff Johnson's application, we have enclosed copies of the bike trail system approved by the Park Commission and adopted by the Council. There are no bike trail systems proposed within Big Island. The Planning Commission recommended unanimous approva 1 of the proposed vacation. The DNR is asked to review and comment to determine if they find any opposition to the City approving the vacation of the platted alley. 'I'he City of Orono's Planning Commission will be reviewing this request at their July 15 meeting. We would appreciate your preliminary comments before that meeting. The rights of individuals on whom the data is stored or to be stored shall be as set forth in this section. Subc:L 2. Iriformation required to be given individual. An. individual asked to · supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; {b) whether he may refuse or is legally required to supply the requested data; (c) any known consequence arising from his supplying or refusing to supply private or confidential data; and (d) the identity of other persons or entities authorized by state or federal law to receive the data. This. requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. Aceess to data by individual. Upon request to a responsible authority, an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon his further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he. desires, shall Se informed of the content and meaning of that data. After an individual has been shown the private data and informed o! its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual hes been collected or created. The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority may require the requesting person to pay the actual costs of making, certifying, and compiling the copies. - The responsible authority shall comply immediately, if possible, with any request made pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays, Sundays and legal holidays, if· immediate compliance is not possible. If he cannot comply with the request within that time, he shall so inform the individual, and may have an additional five days within which to comply with the request, excluding Saturdays, Sundays and legal holidays. Subc:L 4. Procedure when data is not aeeurate or complete. An individual may contest the accuracy or completeness ·of public or private data concerning himself. To exercise this right, an individual shall notify in writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (a) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or (b) notify the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. .
