HomeMy WebLinkAbout#1659 Recorded Resolution 30075825854 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 3007 A RESOLUTION VACATING AN UNDEVELOPED ALLEY WITHIN THE PLAT OF REARRANGEMENT OF LOT 1, KITCHEL'S SUBDIVISION OF GOVERNMENT LOTS 5 AND 6 (SECTION 22, TOWNSHIP 117, RANGE 23) HENNEPIN COUNTY, CITY OF ORONO, MINNESOTA FILE NO. 1659 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, on June 20, 1991, Thomas A. Judd, an authorized representative of Big Island, Inc., filed a petition with the City of Orono requesting the vacation of an unimproved alley at a 20' width, legally described as fol lows: A 20' platted alley dedicated within the plat of the rearrangement of Lot 1, Kitchel's Subdivision of Government Lots 5 and 6 (Section 22, Township 117, Range 23), Hennepin County, Minnesota; and WHEREAS, after due published and posted notice, a public hearing was held before the Planning Commission on July 15, 1991 regarding said vacation and all interested persons were given an opportunity to be heard; and WHEREAS, after due standing and consideration, the Planning Commission voted to recommend approval of the requested vacation and the Council of the City Orono finds that said vacation, as proposed, is in keeping with the public interest in consideration of the following findings: 1. Existing 20' width of right-of-way would not meet current standards for development of a public road. 2. Based on the pattern of development in current ownership, there is no use of right-of-way for access purposes. TRANSFER ENT&R&D DEPT. Judd, an authorized representative of Big Is land, Inc., is hereby granted by the Council of the City of Orono and that the unimproved right-of-way legally described above is hereby vacated.
