SPECIAL LOT COMBINATION
AGREEMENT
THIS INDENTURE is made and entered into this ___ day of ____ _
2010, by the CITY OF ORONO, MINNESOTA, a municipal corporation, its successors and
assigns (hereinafter referred to as "City"), and CHRISTOPHER JOHNSON BOLLIS and
GAIL BOLLIS, husband and wife (hereinafter referred to as "Owner").
WITNESSETH:
WHEREAS, Owner is the fee owner of ce1iain real prope1iy in the City of Orono,
Hennepin County, Minnesota, legally described as follows (and hereinafter collectively referred
to as the "Properties"):
PARCEL ID NO. 22-117-23-41-0002 (Torrens)
That part of Government Lot 3 lying South of the most Southerly line of Tract B,
Registered Land Survey No. 1294 and North of the Westerly extension of the Northerly
line of Lot 8, Morse Island Park, Section 22, Township 117, Range 23, Hennepin County,
Minnesota (hereinafter described as "Parcel A"); and.
PARCEL ID NO. 23-117-23-32-0072 (Abstract)
Lots 9, 10 and 11, Morse Island Park, Hennepin County, Minnesota (hereinafter
described as "Parcel B"); and
WHEREAS, Parcel A and Parcel B are contiguous, but are in different school districts
which prevents the combination of the parcels into one legally described lot or parcel, and/or for
the same or other reason the Hennepin County Assessor cannot combine Parcel A and Parcel B
into one parcel for tax purposes; and
WHEREAS, Owner has applied for a tax parcel combination of the Properties; and

WHEREAS, no building permit, variance or conditional use permit shall be issued for
any purpose on any record lot composed of two or more tax parcels unless the owner of such
record lot shall apply for a formal combination of all commonly owned property into one tax
parcel, which shall be executed and filed in the chain of title of each separate parcel; and
WHEREAS, notwithstanding the above it is the intent of the Owner and the City that
Parcel A and Parcel B are and shall henceforth be continued in common ownership by the same
person or persons, and further that Parcel A and Parcel Bare intended to be used and/or
developed in common by Owner as they were in fact one parcel instead of two.
NOW, THEREFORE, for and in consideration of the sum of One Dollar ($1.00) and
other valuable consideration, Owner hereby covenants, grants, gifts, quit claims and conveys to
the City the right to restrict, and Owner hereby agrees to restrict, limit and preclude the
ownership, use, improvement and development of the Prope1iies according to and under the
conditions and covenants herein contained, as follows:
1. The City and Owner agree that the Prope1iies shall henceforth be contained in common
use and ownership even if recorded as a separate lot or parcel, and that the Properties will not be
conveyed, sold, leased or otherwise encumbered except together as if they were a single parcel.
2. The City and Owner agree that there is no distinction in use between Parcel A and Parcel
B and therefore Parcels A and B may be used or developed for any principal use as may be
permitted in the zoning district, subject to all performance standards and approvals required
therefore.
3. The City shall not issue any building permits, zoning variances or conditional use permits
for any structure or use on the Prope1iies inconsistent with the covenants contained herein.
4. Owner hereby grants to the City the right to enter upon the Prope1iies for the purposes of
inspection and enforcement of the covenants contained herein, and to cause to be lawfully
removed from the Properties, without any liability, any structures, uses, substances and natural or
unnatural materials inconsistent with the covenants contained herein.
5. In addition to any other remedy the City may have, the covenants and restrictions
contained herein may be enforced by injunction. Owner(s) who are in possession of the
Prope1iies shall pay to the City all costs and expenses including attorney's fees incurred by the
City in enforcing the terms if this indenture.
6. The terms and conditions of this indenture may be modified, amended or extinguished
and thereafter Parcel A and Parcel B may be subdivided, sold separately or reduced in paii only
upon application by Owner(s) to the City for approval of a "Subdivision" in accordance with the
subdivision ordinance of the City in effect at the time of such application.
7. Owner agrees that recording of this indenture shall not vest any property rights in the
Prope1iies and that any zoning of development authorities granted herein or hereinafter because
of this indenture shall remain subject to future regulation, modification and/or limitation by the

City or other regulatory bodies in accordance with legally applicable and enforceable zoning or
other ordinances of the City.
8. The City does not intend that the public should have any interest in the Properties by
virtue of this indenture or otherwise, except as hereinabove set f 01ih.
9. All provisions hereof shall run with the land and shall extend to and bind the heirs,
successors, representatives, grantees or assigns of the respective pmiies hereto.

recorded right away. The owner doesn't need to sign them.

Application Summary
Lot area variances are requested for five Big Island properties.
Background
In 1983 the minimum lot size on Big Island was increased from two acres to five acres. As part of the
process Record Lots were established based on ownership and use. Lots less than five acres in size
were designated buildable or unbuildable. To maintain the buildable status prope1iy owners were
offered the oppo1iunity to apply for a lot area variance. About a year ago Staff began to review the
files on Big Island properties as the first step toward updating the Seasonal Recreational zoning
district regulations. Five unprocessed applications for the lot area variance were found . One, for 340,
was approved in January in conjunction with the vacation ofMassassoit Avenue. Mr. Bruntjen
applied after he was informed of the elgibility of his combined properties .
Planning Commission Recommendation
On February 16, 2010, Planning Commission voted 5 to Oto recommend approval of the variances.
Planning Staff Recommendation
Approval of the variances per the attached Resolutions.

Big Island and is zoned RS Seasonal Recreational: That part of Lot B, Morse Island Park lying
northerly of a line drawn from a point on the west line of said Lot B distant 554 feet south of the
Northwest comer of said Lot B, to the Northwest comer of Lot 38, said Morse Island Park,
Hennepin County, Minnesota and;
WHEREAS, in adopting the RS Seasonal Recreation zoning district regulations
the City Council reviewed ownership, development and use patterns on Big Island and
determined that all the above described property combined is and shall hereinafter and
henceforth be one "Record Lot" as defined by Orono Code Section 78-568; and
WHEREAS, an application was filed for a lot area variance as outlined in Orono
Code Section 78-563(a)(2); and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held
a public hearing on February 16, 2010, at which times all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #10-3448.
2. The Planning Commission reviewed this application on February 16, 2010, and on a vote
of 5 -0 recommended approval of the variance.
3. The above described property is less than the minimum lot size required for new lots in
the RS district, but this Record Lot is being used and may be used in the future for any

permitted use in the RS District without adverse affect upon public health, safety, or
welfare.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance to the above
described Record Lot subject to the following conditions:
1. This Record Lot including all the above described property shall henceforth be
continued in common ownership by the same person or persons. It shall not be
subdivided, sold in parts, reduced in area or otherwise separated without approval
of a subdivision by the City. This condition shall not preclude future sale or
transfer of the complete Record Lot as a single unit or the merging by tax parcel
combination of this Record Lot with one or more other Record Lots as long as the
merging results in a reduction in the number of Record Lots.
2. Granting this variance means this Record Lot may be used for one-family
seasonal recreational use without a structure or the existing dwelling may be used,
improved, enlarged, or replaced without requiring further City Council review of
lot size, but subject to compliance with all building permit, setback hardcover, on-
site sewage treatment and other performance standards for development in the RS
District.
3. Violation of or non-compliance with any of the terms and conditions of this

WHEREAS, in adopting the RS Seasonal Recreation zoning district regulations
the City Council reviewed ownership, development and use patterns on Big Island and
determined that all the above described property combined is and shall hereinafter and
henceforth be one "Record Lot" as defined by Orono Code Section 78-568; and
WHEREAS, the following property, also known as 250 Big Island or Record Lot
67, is situated on Big Island and is zoned RS Seasonal Recreational: Lot 16, Morse Island Park,
Hennepin County, Minnesota and;
WHEREAS, in adopting the RS Seasonal Recreation zoning district regulations
the City Council reviewed ownership, development and use patterns on Big Island and
determined that the above described property is and shall hereinafter and henceforth be one
"Record Lot" as defined by Orono Code Section 78-568; and
WHEREAS, an application has been filed for a lot area variance for the
combined Record Lots 63 and 67 as outlined in Orono Code Sections 78-563(a)(2); and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held
a public hearing on February 16, 2010, at which times all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #10-3452.

2. The combined area of Record Lots 63 and 67 is 0.57 acre.
3. The intent of Section 78-568(8), based on an examination of Ordinance 246, is that if two
or more contiguous record lots listed in Section 78-568(7) as unbuildable are combined to
a create a parcel of at least 0.50 acre then the combined record lots are eligible for a lot
area variance as outlined in Section 78-563.
4. The Planning Commission reviewed this application on February 16, 2010, and on a vote
of 5-0 recommended approval of the variance.
5. The above described property when combined is still less than the minimum lot size
required for new lots in the RS district, but the combined Record Lots is may be used in
the future for any permitted use in the RS District without adverse affect upon public
health, safety, or welfare.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance to the above
described Record Lots subject to the following conditions:
1. These combined Record Lots, including all the above described property, shall
henceforth be continued in common ownership by the same person or persons
even if recorded as separate lots or tax parcels, and it shall not be subdivided, sold
in parts, reduced in area or otherwise separated without approval of a subdivision
by the City. This condition shall not preclude future sale or transfer of the
combined Record Lots as a single unit or the merging by tax parcel combination
of the combined Record Lots with one or more other Record Lots as long as the
merging results in a reduction in the number of Record Lots.
2. Granting this variance means the combined Record Lots may be used for one-
family seasonal recreational use without a structure or a seasonal dwelling may be
constructed without requiring further City Council review of lot size, but subject
to compliance with all building permit, setback, hardcover, on-site sewage
treatment and other performance standards for development in the RS District.
3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor

Sec. 78-568. Lot area requirements. (underlining added for emphasis)
Within any RS seasonal recreational district, no new lot or parcel shall be created less than
5.0 acres in dry-buildable lot area exclusive of any wetlands. Within any RS seasonal
recreational district, the following provisions shall govern the buildability, use and/or
subdivision of each existing record lot:
(1) Record lot definition. For purposes of the RS seasonal recreational district, a
"record lot" shall mean all the contiguous or abutting land owned in common by the
same person or persons as of November 9, 1981, or at any time such common
ownership may occur thereafter, including one or more separately platted lots or
unplatted parcels of land, and/or one or more separately identified tax parcels.
Because of the unique circumstances and actual use patterns existing on the islands,
also included within the definition of a "record lot" is commonly owned land that is
contiguous except for being separated only by platted unopened public right-of-way.
Each record lot shall be considered in its entirety to be one lot for zoning purposes.
(2) The effective date for determination of common ownership is November 9, 1981,
the date of adoption of Ordinance No. 238, establishing a moratorium on
development, including land subdivision, on the Lake Minnetonka Islands. Common

ownership as of that date has been and shall be determined by the deeds of record at
the county recorder's office. This definition shall not preclude the city from
recognizing or enforcing the common ownership/lot of record provisions of
Ordinance No. 172, or any other similar prior ordinance.
a. The council has identified and establishes 69 record lots on Big Island,
Mahpiyata Island and Deering Island as listed by record lot number in the
left-hand column of subsections (4), (5), (6) and (7) of this section. Each
such record lot shall include all land identified by all tax parcel property
identification numbers (PIDs) grouped together following the record lot
number.
b. Within 60 days after January 13, 1983, the owner of each record lot shall
be notified in writing at his last recorded address of the classification of
each record lot, including all tax parcels determined to be included in such
record lot. All existing uses in the RS district are identified in the record
lot inventory, subsections ( 4), ( 5), ( 6) and (7) of this section, and all such
uses have been deemed to be seasonal in nature. The notice shall provide
that in order to receive the benefits of the automatic lot area variances
granted by subsections (6) and (8) of this section, the owner shall on a
form provided by the city acknowledge the record lot and shall apply for
combination of all separate tax parcels pursuant to subsection (2) of this
section. Any record lot owner may appeal the record lot classification or
use determination to the council with no application fee required within
six months of the effective date of this division. The record lot inventory
shall be considered accurate and final for all properties except those found
on appeal to have a demonstrable cause for change or adjustment.
c. Notice of record lot establishment shall be filed by the city in the chain of
title of each property.
(6) Substandard buildable record lot inventory. The following record lots are
established, each of which is determined to have a dry-buildable lot area of less than
5.0 acres per owner, which lot area is substandard pursuant to the minimum lot area
requirements of this section. However, based upon individual lot surveys and existing
lot development patterns, the record lots listed are granted lot area variances and are
recognized by the council as buildable lots. Each of the following record lots may be
used for one-family seasonal recreational use or for a single permitted seasonal
dwelling, which may be either the existing dwelling, a replacement dwelling, or if
vacant, a new dwelling, without further council action or review, subject to strict
compliance with all setback, hard cover, on-site sewage treatment and other
performance standards for development in the RS district, including tax parcel
combination pursuant to subsection (2) of this section ....
(7) Substandard unbuildable record lot inventory. The following record lots are
established, each of which is approximately one-third acre in area or smaller, which
lot area is too small to accommodate any form of new permanent use without
available services such as municipal sewer. Each of the following record lots are

therefore determined by the council to be unbuildable and may not have structures or
buildings erected unless a variance to this section shall be issued by the council.
However, one-family seasonal recreational use without structures pursuant to section
78-564(2) shall be permitted subject to strict compliance with all on-site sewage
treatment performance standard requirements for the RS district. Record lots are
identified by record lot number, and each includes all property identified thereafter by
the listed tax parcel property identification numbers ....
(8) Substandard unbuildable record lot exception. Any new record lot resulting from
future combination for ownership and tax purposes of any two or more adjacent
record lots listed in subsection (2)* of this section with each other and/or with another
vacant or undeveloped record lot, which total dry-buildable acreage meets or exceeds
one-half acre, will be granted an automatic lot area variance and will be recognized
by the council as a buildable lot as if it had been listed under subsection ( 6) of this
section. Each such new record lot may be used for one-family seasonal recreational
use without structures, or for a single permitted seasonal dwelling without further
council action or review, subject to strict compliance with all setback, hard cover, on-
site sewage treatment and other performance standards for development in the RS
district, including tax parcel combination pursuant to subsection (2) of this section.
*Subsection (2) is a requirement that Record Lots be combined into one tax parcel
before any permit or variance is granted, making this pr.ovision nonsensical.
However, Ordinance 246 (the primary source of this code provision) has here
Subsection (g), a list of Substandard Unbuildable Record Lots. In subsequent
recodifications Subsection (g) became Subsection (7).

Background
The required notification of Big Island property owners was done in 1983. However the lead
staff person left the city's employ that fall. In 1986 a second notification was done. About a
year ago staff began to update the records of Big Island properties.
Unprocessed applications for the "automatic lot area variance" were found in the files of 130,
750, 350 and 460 Big Island. With the applications for 130 and 750 there was also an
application for a conditional use permit to allow the cabin to be used more than 180 days a
year. That is no longer the situation. There appear to have been some issues with the septic
system for 350. It was replaced in 2009. 460 and 470 Big Island were involved in a lot line
rearrangement that was not approved until 1992.

130, 750, and 350 have always been one tax parcel each so no combinations are required.
470 was originally four tax parcels. At the time of the lot line rearrangement three of the
four were combined. The fourth is in a different school district and cannot be combined with
the others. A special lot combination will be required.
460 Big Island was included in the public hearing notice but subsequently the owner asked
that the property not be considered for a lot area variance at this time.
240/250 Big Island qualifies for a lot area variance under 78-568(8). There are only two sets
of lots that would qualify under this provision. The other set is not in common ownership.
Combined these two Record Lots total 0.56 acre. The property is still three tax parcels so a
tax parcel combination is required.

Turner stated the City of Orono is requesting lot area variances for the following five Big Island
properties:
1. 130 Big Island (Record Lot 10), Lani S. Pennington
2. 750 Big Island (Record Lot 62), Christine Deggendorf
3. 350 Big Island (Record Lot 61), V.C. McClellan and C.A.H. Clancy
4. 470 Big Island (Record Lot 22), Christopher Johnson Bollis
5. 240/250 Big Island (Record Lot 63 and Record Lot 67), Fred A. Bruntjen
The required notification of Big Island property owners was done in 1983. However, the lead staff person
left the City's employ that fall. In 1986 a second notification was done. About a year ago Staff began to
update the records of Big Island properties.
Unprocessed applications for the "automatic lot area variance" were found in the files of 130, 750, 350,
and 460 Big Island. With the applications for 130 and 750 there was also an application for a conditional
use permit to allow the cabin to be used more than 180 days a year. That is no longer the situation. There
appear to have been some issues with the septic system for 350. It was replaced in 2009. 460 and 470
Big Island were involved in a lot line rearrangement that was not approved until 1992.
130, 750, and 350 have always been one tax parcel each so.no combinations are required. 470 was
originally four tax parcels. At the time of the lot line rearrangement, three of the four were combined.
The fourth is in a different school district and cannot be combined with the others. A special lot
combination will be required. 460 Big Island was included in the public hearing notice but subsequently
the owner asked that the property not be considered for a lot area variance at this time.
240/250 Big Island qualifies for a lot area variance under 78-568(8). There are only two sets oflots that
would qualify under this provision. The other set is nofin common ownership. Combined, these two
record lots total 0;56 acre. The property is still three tax parcels so a tax parcel combination is required.
Planning Staff recommends approval of the lot area variances:

FOR RECORD LOT NO. 22 ----PURSUANT TO ORDINANCE NO. 246,
MUNICIPAL ZONING CODE SECTION 10.31
BE IT RESOLVED by the City Council of Orono, Hennepin County,
FINDINGS
1. That Samuel A. Mccloud is (clr/f/.) the owner(,s)/tax-
payer(~) of record of the following described property located within
the RS Seasonal Recreational Zoning District of the City:
Exhibit "A" attached hereto.
2 . That in adoption of Ordinance No. 246, the City Council reviewed
ownership, development and use patterns on the islands and has deter-
mined that all the above described property combined is and shall
hereinafter and henceforth be one "RECORD LOT 11 as defined in Section
10. 31 of said ordinance.
3. That all the above described property when combined as one RECORD LOT
is still less than the minimum lot size required for new lots in the
RS District, but that this RECORD LOT is being used and/or may be used
in the future for any permitted use in the RS District without adverse
affect upon public health, safety, or welfare.
CONCLUSION
The City Council of Orono hereby gran~s a lot area variance to
the above described RECORD LOT based on the above findings and subject to
the following conditions:
1. This RECORD LOT including all the above described property combined
shal 1 henceforth be continued in common ownership by the same person
or persons even if recorded as separate lots or tax parcels, and it
shall not be subdivided, sold in parts, reduced in area or otherwise
separated without application for and approval of a subdivision by the
City. This condition shall not preclude future sale or transfer of
the complete 11 RECORD LOT" as a single unit.
2. Granting this variance means this RECORD LOT may be used for one-
family seasonal recreational use without a structure; or a single new
seasonal dwelling may be built; or an existing seasonal dwelling may
be used, improved, added-onto or replaced; all without requiring
further City Council review of lot size, but subject to strict com-
pliance with all building perm{t, setback, hardcover, ~n-site sewage
treatment, and other performance standards for developm e nt in the RS
District.

3. g this variance shall not vest any rights in the property other
than as specifically provided in Ordinance No. 246, ·and shall not
preclude a future City Council from amending, modifying or otherwise
limiting development rights and/or performance standards in the RS

4 . The undersigned has read and understood the terms of this resolution
and on behalf of himself, his heirs, successors and assigns, agrees
that the above described property constitutes a single RECORD LOT;
agrees that the RECORD LOT use may be so limited by the City; and
agrees to the recording of this resolution in the chain of title of
the property.
