A RESOLUTION GRANTING PRELIMINARY APPROVAL OF A PLAT AT , 3995 NORTH SHORE DRIVE -FILE NO. 2588 WHEREAS,Robert Pieper,is owner of properry located at 3995 North Shore Drive, on May 9, 2000, filed a formal subdivision application with the City for approval of a two lot residential plat of properry legally described as: ` . Attached as"Exhibit A"; and � WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462358 et.seq.and the City of Orono's zoning,platting and on-site septic codes,the Orono Planning Commission held a public hearing on June 19,2000,at which time all persons desiring to . be heard concerning this application were given the opportunity to speak thereon; and WHEREAS,at their regular meeting held on July 10,2000,the Orono City Council , considered the subdivision application of Robert Pieper noting the following findings of fact: 1. The properly is located within the LR-1C Single Family Lakeshore Residential Zoning District requiring a minimum of 0.5.acre of dry contiguous buildable land within each newly created lot. 2. The property contains approximately 1.3 acres, of which 0.27 acres would be dedicated on the final plat as public right-of-way. 3. The proposed plat contains two lots each meeting or exceeding the minimum lot area . requirements for newly created lots in the LR-1C zoning district. 4. Lot 1 meets the minimum required width at the structure setback, 170'where 100' is required. Lot 2 has 188.57'of frontage along County Road 19 where 100'is required. 5. Several cabins exist on the property as individual rental units. They have existed as a non-conforming use. NOW,THEREFORE,BE IT RESOLVED,that based upon either one or more of the fmdings noted above,the City Council of the City of Orono hereby approves of the preliminary plat for Robert Pieper for the property located at 3995 North Shore Drive per the survey (Attached "E�chibit B"), by Milton E. Hyland, of Hy-Land Surveying, P.A. Land Surveyors., subject to the following conditions: ` 1. Public right-of-way shall be dedicated to the public for the north 33' located over County Road 19. 2. Lots 1 and 2 shall share a driveway and be subject to a Driveway Maintenance . Agreement and easement in favor of Lot 1 over Lot 2 to be recorded with the final plat. 3. A 20' drainage and utility easement shall be dedicated on the final plat along the • proposed north property lines of Lots 1 and 2 adjacent to County Road 19 for construction of a drainage ditch to connect the culvert drainage under the County Road to the existing drainage ditch. � ' 4. The culvert under the County Road is plugged and shall be reopened.The drainage shall be redirected into the drainage ditch to protect the building site on Lot 2. 5. Final Grading, Drainage and Erosion Control plans shall be approved by the City . Engineer prior to Final Plat approval. 6. Driveway access permit shall be issued by Hennepin County prior to Final Plat approvaL • 7. A letter of credit shall be offered to the City for 150% of the site improvements, improvements to be identified in a Developer's Agreement to be executed between the subdivider and City of Orono. 8. ' NO. � � � � 9. Only Lot 1 shall have lakeshore access. Lot 2 shall not be permitted lakeshore access. The following list of final submittals must be submitted to the Zoning Administrator two weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month: 1. Record plat drawings in the form of two (2)mylar copies and one(1)copy reduced to 1" =200'. Drawing to include: A. Lot lines platted per preliminary survey by Milton E. Hyland, of Hy-Land Surveying, P.A. Land Surveyors. � B. Dedication of "drainage and utility easements" 20' wide along the north property lines, l0'along south and east exterior property lines and 5'each side � of internal property line. C. Naming of plat. 2. Legal documents required: A. Title opinion addressed to the City. All owners,mortgage holders or others � with property interest indicated therein shall sign the plat and all other � documents affected by such interest. B. The applicant must provide certified copies of all recorded easements currently affecting the property. � C. Fees to be paid: Total due: 400.00* based on 2000 fee schedule A. Legal review and filing fees = $400.00 B. *Park dedication fee to be determined upon City Assessor's valuation of fair market value of the lots. Park dedication fee payment is due upon the filing of the final plat and associated'documents.
