A RESOLUTION GRANTING PRELIMINARY � � APPROVAL OF A PLAT AT 350 STUBBS BAY ROAD NORTH . -FILE NO.2592 WHEREAS, Mike Hilbelink and John Vogt,having interest in property located at 350 Stubbs Bay Road North;on September 26, 1997,filed a formal subdivision application with the City for approval of a two lot residential plat of property legally described as: Attached as "Exhibit A"; and . � WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et.seq.and the City of Orono's zoning,platting and on-site septic codes,the Orono Planning Commission held a public hearing on June 19,2000,at which time all persons desiring to • be heard concerning this application were given the opportunity to speak thereon; and : � WHEREAS,at their regular meeting held on July 10,2000,the Orono City Council considered the subdivision application of Mike Hilbelink and John Vogt noting the following findings of.fact: � , 1. The property is located within the RR-1B Single Family Rural Residential Zoning District requiring a minimum of 2 acres of dry contiguous buildable land within each ! newly created lot. ; . , 2. The property contains 7.32 dry acres, 6.91 wet acres for a 14.23 total acres. � i • ! 3. The proposed plat contains two lots each meeting or exceeding the minimum lot azea requirements for front and back lot standards. � I 4. The subdivision is a front/back lot subdivision requiring the back lot(Lot 2)to have ; 150% of the lot area for the zoning district. I 5. Lot 2 is 524' in width to the rear of the street setback line measured from the west � properry line and Lot 1 measures 361' in width. No. � � � � - � An existing residence and driveway are located on the property and would remain as a result of the subdivision. The existing structures meet required setbacks as defined in the Zoning Code. 7. Chris Pence, On-Site Systems Manager, has reviewed the septic reports and has approved the septic design indicating two conforming septic sites on each lot. NOW,THEREFORE,BE IT RESOLVED,that based upon either one or more of the findings noted above,the City Council of the City of Orono hereby approves of the preliminary plat for Mike Hilbelink and John Vogt for the property located at 350 Stubbs Bay Road North per , the survey dated 6-29-00(Attached"Exhibit B"),by Mark S.Gronberg of Coffin and Gronberg,Inc., subject to the following conditions: 1. Outlot A shall be platted 50'wide rather than the 30'proposed to accommodate a road should one be required in the fizture to provide access to additional lots without direct access to a road. Future use of Outlot A as a road shall require approval by the Orono City Council. • 2. Outlot A shall be used for driveway purposes only, serving Lots 1 and 2 as drawn on the preliminary plans dated 6-29-00. 3. Standazd drainage and utility easements shall be dedicated on the final plat 10'along exterior property lines and 5' along interior property lines. 4. Drainage easements shall be dedicated on the final plat and conservation and flowage easements shall be granted for all City of Orono protected wetlands as identified on the Wetland Inventory Maps. 5. Wetlands on the property,not identified on the Wetland Inventor�,Maps by the City of Orono but which are protected under WCA methods,shall be subj ect to a protective covenant filed in the chain of title of the affected property, as an advisory to property owners that the wetland is subject to WCA regulation and/or U.S. Army Corps of Engineers jurisdiction. 6. Covenants shall be filed in the chain of title for each lot as an advisory to future property owners that primary and secondary drainfield sites exist on the property and are protected. 7. Lots 1 and 2 shall both access Outlot A and be subject to a�Driveway Mainteriance Agreement to be recorded with the final plat. 8. The westerly 33'lying within the Stubbs Bay Road North right-of-way shall be dedicated on the plat to the public as a public right-of-way. , The following list of final submittals must be submitted to the Zoning Administrator two weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month: 1. Record plat drawings in the form of two (2)mylar copies and one(1)copy reduced . to 1" =200'. Drawing to include: A. Lot lines platted per preliminary survey by Mark S. Gronberg dated 6-29-00. • B. Dedication of"drainage and utility easements" 10' wide along all perimeter property lines and 5' each side of intemal property lines. C. Naming of plat. 2. Legal documents required: A. Title opinion addressed to the City. All owners,mortgage holders or others with property interest indicated therein shall,sign the plat and all other documents affected by such interest. B. The applicant must provide certified copies of all recorded easements currently affecting the property. C. Dedication of"drainage and utility easements" 10' wide along all perimeter property lines and 5' each side of internal property lines. � D. Driveway Maintenance Agreement ensuring Lots 1 and 2 access to properties and identifying obligation to property owners regarding maintenance of such driveway. � 3. Fees to be paid: Total due: $400.00* based on 2000 fee schedule . A. Legal review and filing fees=$400.00 � B. *Park dedication fee to be determined upon City Assessor's valuation of fair market value of 2 acre rural lot.
