��_--=� A RESOLUTION GRANTING A VARIANCE
TO MUNICIPAL ZONING CODE
SECTION 10.31, SUBDIVISION S (C)

WHEREAS, Willmar L. Tharkelson and Peter A. Thorkelson (hereinafter "the
applicants") are owners of the property located at 440 Big Island within the City of Orono
(hereinafter "the City") and legally described as follows:
Lot 1, Scri��er's Subdivision of Lot E Morse Island Park and Lot 6 and the
South Half of Lot 7, Morse Island Park Second Addition, Hennepin County,
Minnesota (hereinafter "the property"); and _ ;-�

WHEREAS, the applicants have applied to the City for an after-the-fact variance
to �lunicipal Zoning Code Section 10.31 Subdivision 8 (C) to permit an accessory structure to
be located 23' from the platted street right-of-�vay where 30' is required.
NO��', THEREFORE, BE IT RESOLVED by the City Council of Orono,
Nlinnesota:
FINDINGS
l. This application was reviewed as Zoning File #2627.
2. The property is located in the RS Recreational Seasonal Zoning District requiring
five acres in area. The property consists of 48,781 s.f. or 1.12 acres.
3. The applicants' son constructed a 12` x �4` accessory buiidin� an inC pr�pe�y
without obtaining the appropriate building permit and in a location not meeting
the required street setback.
4. The Orono Planning Commission reviewed this application on October 16, 2000
and voted 3 to 3 on a motion to recommend denial of the request. The
application was sent forward to the City Council.

�==�he City Council made the following findings of fact:
A. The topography of the property limits where the accessory structure can
be located on the property. The structure is in an appropriate location
based on the topography of the site.
B. The location of the accessory structure does not impact neighboring
properties or use of the right-of-way.
C. The angled orientation of the shed related to the right-of-wa}� results in
only the westerly corner of the shed encroaching into the required
setback.
6. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, liQht, air nor
pose a fire hazard or other danger to neighboring property; ���ould not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficult��; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
7. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicants and the effect of the proposed variance on the health, safety
and welfare of the community.
CONCLUS�C���, �R�ER t�.ND C�JN�ITInNS
Based upon one or more of the above findings, the Orono City Council hereby
grants a variance to Municipal Zoning Code Section 10.31, Subdivision 8 (C) to allow an
accessory structure to be located 23' from the platted street right-of-way where 30' is required.
1. Council approval is based on the site plan submitted by the applicants attached
to this resolution as Exhibit A. Any amendr�ents to the site plan ma�r require
further Planning Commission and City Council review.
2. Authorities granted by this variance run with the property not with the applicants,

�`_= ut are permissive only and must be exercised by application for a building
permit within one year of the date of Council approval, or this variance will
expire on that date (November 13, 2001).
3. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
4. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of themselves, their heirs, successors and
assigns, hereby agree to the recording of this resolution in the Chain of Title of
the property.
