ESH A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONING CODE SECTION 10.03. SUBDIVISION 9(D), ' ' � � FILE NO. 2613 WHEREAS, James R. Renckens and Debra A. Renckens, (hereinafter "the applicants")are the owners of the property located at 3020 Watertown Road within the City of Orono (hereinafter "the City") and legally described as follows: That part of the South 1170 feet,as measured along the west line thereof,of the West Half of the Southwest Quarter of Section 33, Township 118, Range 23 West of the 5`"Principal Meridian,lying east of the West 869 feet,thereof,as measured along the south line thereof,Hennepin County,Minnesota(hereinafter"the property"); and WHEREAS, the applicants have applied to the City for a variance to Municipal • Zoning Code Section 10.03,Subdivision 9(D)to allow placement of an accessory structure between the principal building and the front lot line where no accessory structures are normally allowed. . �, WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on September 18,2000, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of� Orono, Minnesota: � FINDINGS � � 1. : This application was reviewed as Zoning File#2613. � ' � � 2. This property is located in the RR-1B, Single Family Rural Residential Zoning � District. . 3. The Planning Commission made the following findings of fact: � A. The location of the residence is 678'from the street toward the rear of the 12- acre property,making it impossible to place an accessory structure within the front 7 acres without a variance. B. The proposed location requires significantly less additional driveway construction than conforming locations north of the residence. C. The height of the proposed building will be significantly lower than the � height of the existing house and will be screened from the road by proposed . vegetation, therefore the visual intrusion of accessory structure will be minimized. � D. The proposed structure will be located more than 40' from the side lot line, � and approximately 200'from the front lot line,reducing its potential impact on neighboring properties. Further the proposed location is more than 200' from the nearest existing or potential neighboring residence, reducing its visual impact. ' ' S. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring properry; would not merely serve as a convenience to the applicants,but is necessary to alleviate a demonstrable hardship � or di�culty; is necessary to preserve a substantial property right of the applicants; � and would be in keeping with the spirit and intent of the Zoning Code and � Comprehensive Plan of the City.. � 6. The City Council has considered this application including the findings and recomtnendations of the Planning Commission,reports by City Staff, comments by the applicants and the effect of the proposed variance on the health, safety and welfare of the community. i � Page 2 of 5 . CONCLUSIONS, ORDER,AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.03, Subdivision 9 (D) to allow the proposed � accessory structure to be located nearer the front lot line than the principal building. Approval is subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicants attached to this resolution as Exhibit A. Any amendments to the site plan may require further Planning Commission and City Council review. 2. . Authorities granted by this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (September 25, 2001). . • 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code,shall automatically terminate . any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicants have read,understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain�of Title of the property.
