� A RESOLUTION APPROVIN� THE
� PLAT OF WILDHURST WOODS .
FILE NO. 2645 �
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, Brenshell Homes (hereinafter the "subdivider") has applied for final
� subdivision of Lot 2, Block 1,Heathercroft,Hennepin County,Minnesota,to Lots 1 - 5, Outlots A
and B, Wildhurst Woods (hereinafter "the properly"); and
WHEREAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of land within the City; and
WHEREAS,the City Council has considered the application for a subdivision o�a
• S lot plat by Brenshell Homes:(hereinafter"the subdivider"); and
WHEREAS,the subdivision has been found to meet the density requirements of the
LR-1B zoning district; and �
WHEREAS,the Environmental Quality Board(EQB)has officially notified the city
of a petition by a group of citizens requesting the completion of an Environmental Assessment
Worksheet(EAV� for the project; and
WHEREAS, under EQB guidelines, the City of Orono is designated as the
governmental unit to determine whether an EAW is required; and
WHEREAS,the Council at its regularly scheduled meeting of December 11, 2000
reviewed the EAW request and concluded that the proposed development by Brenshell Homes has �
, no potential significant environmental effects and denied the Citizen Petition for preparation of an
EAW, as documented in Resolution No. 4578; and
WHEREAS,the subdivider has agreed to complete all requirements of the platting
regulations of the City, including:
1. Completion of requirements of Resolution No. 4529, the resolution granting
preliminary plat approval.
• 2. Dedication on the lat of standard perimeter drainage and utility easements.

3. Dedication to the City of a Conservation Easement over that portion of Lots 2 and 3
below and east of the 1014' contour.
4. Dedication of a 50' corridor as a public road to be known as Garden Court.
5. Dedication on the plat of drainage and utility easements over all detention areas and
drainageways within the plat providing for limitations on the use of these areas and
shown on the plat as"drainage" and"drainage and utility easement".
6. Preliminary approval of a storm water management plan, and grading and erosion
control plan by the Minnehaha Creek Watershed District.
7. Execution of a Developer's Agreement providing for the installation of
improvements required as a condition of subdivision approval, including roads
(Garden Lane and Garden Court),drainage and stormwater facilities,sanitary sewer,
• . landscaping and posting of security to ensure that these required improvements are �
completed to the City's satisfaction, the design of said improvements subject to
approval of the City Engineer and letter of credit subject to approval of the City
Attorney. �
8. Execution of covenants establishing requirements for maintenance of stormwater
facilities.
�
9.. Payment to the City for the final plat review fee and fee for legal review and filing
of the plat, easements and covenants in the amount of$400.00.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono
hereby approves the plat of Wildhurst Woods, Hennepin County, Minnesota (Copy of Plat is
attached to this resolution as Exhibit A), subject to the following conditions:
l. EYecution of a Developer's Agreement incorporating the following conditions of
elements:
. a. Letter of Credit in the amount of 326 528 shall be submitted to the City of
Orono. The figure includes 150% of the total costs of improvements as �
specified in the Developer's Agreement.

b. Final street, sanitary sewer, grading and stormwater management designs
shall be provided for approval by the City Engineer.
c. Subdivider shall concurrent with road construction, construct stormwater
management improvements generally as shown on the Preliminary Grading,
Drainage and Erosion Control Plan reviewed and approved by the City
Engineer subject to any revisions of said plan as may be required by the City
Engineer. A final Gradin� Draina�e & Erosion Control Plan must be
ap�roved bv the Citv En i� neer prior to release of final plat for filing. Erosion
control shall be maintained over all disturbed areas until natural groundcover
is restored, adhering to guidelines found in'Best Management Practices for
Protecting Water Quality in Urban Areas'.
d. All final sewer and storm water management plans sha11 be reviewed and
• � � approved by the City Engineer prior to release of the plat for recording.
e. No building permits will be issued until the road base work initial paving and
' � all improvements as referenced in the Developer's Agreement and
Resolution No.4408 have been completed by the developer and approved by
the City.
2. Plat shall not be filed until final approval of the stormwater management plan by
the MCWD. •
3. Final covenants, easement documents and maintenance agreements shall be
approved by the City Attorney, including language within the maintenance
. agreements that would establish the City of Orono's authority to require
� .. maintenance and assess fees to the property owners within Wildhurst Woods. .
4. Payment to the City of Orono sewer and water connection fees: Based on the year
2000 Fee Schedule sewer and water connections fees are.
� Sewer $ 9,065 per unit
$ 9.065 per unit X 4 units = 36 260 �

5. Payment of Park Dedication fees in the amount of:
$ 5,300 per lot X 41ot= 21 200
6. The road as depicted on the plat shall henceforth be known as "Garden Court".
7. Subdivider shall plant boulevard trees along the private road per the requirements
of Section 11.60, Subd. 2.
8. Prior to City release of the plat for filing, applicant shall provide evidence of fee
ownership of the property in a form acceptable to the City Attorney, and applicant
� shall meet any other title requirements as may be required by the City Attorney.
9. Applicant shall provide all documents noted in this resolution and the resolution
• � approving the final plat in a format acceptable to the City Attorney prior to release �
of the plat for filing.
10. The aforesaid plat shall be filed by the City of Orono with either the Hennepin
County Recorder's Office or Registrar of Titles Office on or before June 18, 2001
together with a certified original copy of this resolution and executed copies of the
easements, deeds and final copy of the plat noted above. �
The approval granted by this resolution shall expire if the plat has not been filed by the date
specified above. In that event, it will be necessary to file a new application with the City of Orono
for subdivision review. Dated this 18th day of December, 2000.
