Henry tluhich, Building & Zoning Administrator, SUBDIVISION stated that Kern Hoppe, Robert Bathke, and 2608 & 2610 Mapleridge Christopher Dahl, 2608 & 2610 Mapleridge Lane, Lane o-re requesting approval of a subdivision consisting of property line rearrangement. The existing house is on existing Lot 19. Existing Lot 8 is unbuildable because placement of a structure to meet the City setback requirements (including 75' lakeshore setback) would locate it within an existing private vision easement granted to Lot 19. Rearrangement of the lot lines would protect the lakeshore view of the existing house while allowing construction of the proposed residence. Rearrangement would meet all lot area, width, and setback regulations on both proposed lots. A private driveway easement would be required. About a year ago, Mr. Bathke was denied a variance from the 75' required setback from the lagoon on the property. The proposal would provide adequate area to meet the required setbacks for a dwelling. The lot area also qualifies. The lot width, however, would require a variance of 20' as i� would be 120' wide (140' required). Ilylars and hardshells will be necessary for final approval. The park dedication fee will also apply. A public hearing was scheduled for June 8, 1976. Lot area - Lakeshore setback ,,...' Street setback - hardcover restrictions Mr. Hanson is requesting the above variances to build a new home to replace the one that was recently completely destroyed by fire on Lot F. This pro- posal would be on improvement to the previous situation in that the new location is further from the lakeshore. There should be some concern of precedence on Big Island, however. Mr. Hanson also owns lots G and 3 which consist of an additional 17,771 sq. ft. We could also consider vacating the street if access to other properties would not be obstructed. The streets consist of an area of approximately 9,000 s-(. ft. If all this area were combined, there would be a total of approximately 55,000 sq. ft. (87,120 sq. ft. required). We could, however, maintain the required 75' setback from the shoreline. These are only sug- gestions since I have never been on the island. A site inspection will be necessary before determining a reasonable solution. The builder did indicate that the existing drain field for the septic system is presently located in the street area. Massengale moved, Searles seconded, to approve the preliminary grading a—] foundation permit of certain areas which will be graded pursuant to a plan being adopted, bui no grading in other areas which are not shown on the present plans being adopted. The City Staff and Council reviewed the COMBINATION OF LOTS application for Mr. John Pembroke, 4111 Oak 4111 Oak Street Street, who combined three lots into one. It was noted that these three lots had one sewer assessment for the three lots. Staff noted that because of the availability of municipal sewer, these lots could be combined into one buildable lot. If the sanitary sewer had not been available, these lots would be substandard and therefore no development could take place thereon. Council - members noted that this was one of the advantages of the sanitary sewer pipe as installed for the substandard lots. Butler moved, Massengale seconded, to approve the combination of three lots into one buildable lot for John Pembroke, 4111 Oak Street. Motion, Ayes (5) - Nays (0). Mr. Howard Mleagher presented a resolution adopted LAKE MINNETONKA by the Lake Minnetonka Association to Mayor ASSOCIATION RESOLUTION Searles which stated that: "The undersigned, Richard A. Hassel, Secretary of the Lake Minnetonka Association, a Minnesota nonprofit corporation, hereby certifies that the following resolution was duly adopted by action of a majority of the directors of the Association at a meeting held on June 10, 1976: Resolved: That the Lake Minnetonka Association is deeply concerned about maintaining adequate water safety on Lake Minnetonka. At this time, insufficient funds have been allocated by the Hennepin County Sheriff's Department in order to continue an adequate water safety patrol program. In past years, the Hennepin County Sheriff's Department has taken on the responsibility of providing, and has in fact provided, effective water safety activities on Lake Minnetonka. At the present time, however, this county program has all but stopped and as a result, a cz_tical problem in the form of a void of regulating water safety on Lake Minnetonka has been created. The result of this void raises fear that the inevitable result will be personal injury and the possible loss of life to those persons using Lake Minnetonka. Therefore, the Board of Directors of the Lake Minnetonka Association strenouslj encourage the reiristitution of the Hennepin County Sheriff's Department Water Patrol on Lake 1-tinnetonka to a strength and level which will provide effective and efficient water safety on Lake Minnetonka and, further, the Lake Minnetonka Association urges the 15 municipalities which are members of the Lake Minnetonka Conservation District to support this position in whatever ways may be within their power. Therefore, the Board of Directors of the Lake Minnetonka Association strenously encourage the reinstitution of, the Hennepin County Sheriff's Department !-later (Continued) MINUTES OF A PLANNING CCWISSION MEETING HELD JULY 19, 1976 - PAGE 2 Hank Muhich stated that a meeting had been held earlier today at the Village Offices between John Holmquist of the Minnehaha Creek Watershed District; Rod Hillstrom, Ryan Construction; Rick Sathre, City Engineer; Dick Benson and hank Muhich. The Minnehaha Creek Watershed District was concerned that the proposed grading and drainage plan could result in higher rate and lower quality runoff than now exists. At this meeting, it was agreed that a french drain system would eliminate this problem. This system would consist of digging 4-S' trenches and adding a layer of 3" rock through the lower area under the surface grating. Quality would be controlled by grading down to a finer material before going into the storm sewer. Rod Hillstrom and Frank Zelley of Ryan Construction were present at the meeting. They submitted a statement regarding fulfilling M.C.W.D. requirements for the rate and quality of runoff. They will work with this system and submit for approval. Hillstrom informed the Commission that there would be sane water retention on the roof, but only for a short period of time. Pesek moved, Guthrie seconded, to approve site plan and elevation based on the stipulation that it satisfies the Minnehaha Creek Watershed District and our city engineer as an adequate filter system. Dunlap suggested that any erosion problems be corrected as they come up. The Zoning Administrator informed Ryan Construction and the Commission that the unpaid sewer and water unit charges assessed against the property would have to be paid before the building permit is issued. John Lambin, contractor, and George Hanson were present. Lambin presented the plans to the Commission for the con- struction of a new home. They pleaded hardship to the land because of an approximate 2S' drop. The:-e was some discussion regarding moving the street. Dunlap moved, Pesek seconded, to approve this variance subject to changes in the plan whereby the two remaining substandard parcels would be eliminated. The Zoning Administrator informed the Conmission that because of the cancellation of the July 6th meeting, he had conducted a telephone poll of the Council and Commission Members to get the necessary approval of this variance. Guthrie moved, Hannah seconded, confirm- ing the telephone poll which was taken last week by Flank Muhich and approving the request for variance.
