WHEREAS, Peter A Thorkelson, a single person, (hereinafter "the
applicant") is the owner of the property located at 440 Big Island within the City of
Orono (hereinafter the "City") and legally described as follows:
Lot 1, Scriver' s Subdivision of Lot E Morse Island Park and Lot 6 and the
South Half of Lot 7, Morse Island Park Second Addition, Hennepin
County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicant has made application to the City of Orono for a
conditional use permit per Orono Municipal Zoning Code Section 78-567 to allow private
sewer improvements through platted public right-of-way.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #03-2939.
2. The property is located in the RS, Seasonal Recreation Zoning District.
3. The Planning Commission reviewed this application at a public hearing
held on September 15, 2003 and recommended approval of the conditional
use permit based on the following findings:
a. The applicant's property is a non-contiguous lot separated by platted
public right-of-way.

b. Due to limited space on the parcel where the home is situated and in
order to serve the property with private sewer the drainfield must be
located on the inland property.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the applicant and the public, and the effect of the proposed
conditional use permit on the health, safety and welfare of the community.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants a conditional use permit per Orono Municipal Zoning Code Section 78-567 to
allow construction of a private sewer line through platted public right-of-way, subject to
the following conditions:
1. Council approval is based on the plan submitted by the applicant and annotated by
City staff, attached to this Resolution as Exhibits A and B. Any amendments to
the plan which are not in conformity with City codes will require further Planning
Commission and City Council review.
2. The applicant acknowledges that placement of septic system connection pipes
within the right-of-way is at their own risk. The system should be constructed so
as to minimize the possibility of damage by vehicular traffic on the right-of-way.
3. Applicant shall, prior to placement of improvements within the right-of-way,
execute a hold harmless agreement which releases, indemnifies and holds
harmless the City and the public from any and all claims or causes of action
arising out of the use or alteration of the platted right-of-way by applicant or their
invitees.
4. Authorities granted by this resolution run with the property not with the applicant,
but are permissive only and must be exercised by obtaining a building permit for
the new construction within one year of the date of Council approval, or the
conditional use permit will expire on that date (September 22, 2004).

5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
6. The undersigned applicant has read, understood and hereby agrees to the terms of
this resolution and on behalf of the applicant and the applicant's heirs, successors
and assigns, hereby agrees to the recording of this resolution in the chain of title
of the property.

structures, fences, boats, vehicles, dock parts, junk or debris shall be build, stored,
parked or kept at any time within any platted right-of-way ... except as specifically
authorized by a permit issued under this Subdivision.
✓ 10.31.S(E) Permit Exceptions: Persons whose record lot established by
Subdivision 6 consists of tax parcels divided by platted, unopened public right-of-
way may incorporate and use such right-of-way as part of their yard without a
permit, provided no permanent structures are erected or maintained within the
right-of-way.
✓ 10.31.S(G) Permit Limitations: A permit issued under this Subdivision shall
not grant or vest any property rights to use of the public right-of-way or other
public property, or in any improvements made thereto.
✓ 10.3 l .5(H) Hold Harmless: As a condition of issuance of any permit, the

Background
The property is located on Big Island and zoned Seasonal Recreation District (RS) with a
minimum lot size of 5 acres. The lot is a legal lot of record and is a combination of two
non-contiguous parcels totaling 1.024 acres. The applicant, in updating the private septic
system, was notified by City staff that a conditional use permit would be required in order
to run a private sewer line beneath the platted public right-of-way for the purpose of
connecting the drain field (located on the interior parcel) to the lakeshore parcel where
the home is located.
Conditional Use Permit Analysis
City zoning code requires a conditional use permit for installation of private sewer lines
within the public right-of-way per Section 10.31 Subdivision 5.

I am sending you the application you need to get approval to cross the public right-of-way. You
need to get a Residential Accessory Use Conditional Use Permit (CUP). The fee for this is
~nd must be taken to Planning Commission and City Council. Please get this
~on in to us by June 18, 2003 to get on the July 21, 2003 Planning Commission Meeting.
If you have any questions please give me a call at 952-249-4600. As for suggestions for piping
everyone thought if you put it in deep that you should not have any problems with PVC pipe. I
have seem people put a 2 inch PVC pipe inside a 4 inch PVC in order to give it some added
protection.

We have attached a Detail "A" specifying how to protect your proposed crossing of the roadway
on your Big Island property. The ductile iron pipe will protect the sewer line from being crushed
and the styrofoam insulation will protect it from freezing. We had done a survey of the property
for you in 1999 and Eco Systems Engineering has designed an on site sewage treatment system
for you. The Eco Systems Engineering drawing shows the location of the proposed crossing.

We have attached a Detail "A" specifying how to protect your proposed crossing of the roadway
on your Big Island property. The ductile iron pipe will protect the sewer line from being crushed
and the styrofoam insulation will protect it from :freezing. We had done a survey of the property
for you in 1999 and Eco Systems Engineering has designed an on site sewage treatment system
for you. The Eco Systems Engineering drawing shows the location of the proposed crossing.

Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or
to be stored shall be as set forth in this section.
Subd. 2. Information required to be given individual. An individual asked to supply
private or confidential data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system; (b) whether he may refuse or is legally required to supply the requested data;
( c) any known consequence arising from his supplying or refusing to supply private or
confidential data; and ( d) the identity of other persons or entities authorized by state or federal
law to receive the data. This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision m
the individual income tax or property tax refund instructions instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored data on individuals, and
whether it is classified as public, private or confidential. Upon his further request, an
individual who is the subject of stored private or public data on individuals shall be shown the
data without any charge to him and, if he desires, shall be informed of the content and meaning
of that data. After an individual has been shown the private data and informed of its meaning,
the data need not be disclosed to him for six months thereafter unless a dispute or action
pursuant to this section is pending or additional data on the individual has been collected or
created. The responsible authority shall provide copies of the private or public data upon
request by the individual subject of the data. The responsible authority may require the
requesting person to pay the actual costs of making, certifying, and compiling the copies.
The responsible authority shall comply immediately, if possible, with any request made
pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays,
Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request within that time, he shall so inform the individual, and may have an additional five
days within which to comply \Vith the request, excluding Saturdays, Sundays and legal holidays.
Subd. 4. Procedure \Yhen data is not accurate or complete. An individual may
contest the accuracy or completeness of public or private data concerning himself. To exercise
this right, an individual shall notify in writing the responsible authority describing the nature
of the disagreement. The responsible authority shall within 30 days either: (a) correct the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individual; or (b) notify the individual that
he believes the data to be correct. Data in dispute shall be disclosed only if the individual's
statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the
provisions of the administrative procedure act relating to contested cases.
