OF A LOT LINE REARRANGEMENT FOR PROPERTIES

\VHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and ·
WHEREAS, the City Council of Orono (hereinafter ''City Council'') has adopted
subdivision regulations for the orderly, economic and safe development ofland wi'thin the City; and
WHEREAS, the City Council has considered the application for a subdivisiori of a
lot line rearrangctnem by Gregory B. O'Co1mor and Richard W. Fruen (hereinafter "the applicants")
of prope11ies legally described as:
The East 20 feet of Lot 5, and all of Lots 6 and 7, Scriver's Subdivision
of Lot "E", Morse Island Park, Hennepin County, Minnesota according

Commission held a public hearing on July 18, 2005 at which time all persons desiring to be heard
concerning this application were given ihe oppmiunity to speak thereon; and
WHEREAS, the applicants have completed or have agreed to complete all
requirements of the City for a metes and bounds subdivision of a lot line rearrangement for division
and c.ombination purposes, resulting in the relocation of the common lot boundary between the
properties, as shown in the survey anached as Exhibit ''A" arid resulting in a new iegal description for
each parcel as shovvn in Exhibit "A"; and

\VHEREAS, the lot line rearrangement request is intended to resolve a historical
encroachment issue and result in fonnal City approval of a. deed exd1~nge that occi.irred,in 1986, but
which never received City approval. The cabin on the Easterly :Paree\ encroaches approximately 1.4'

locared within rhe new eastem oarcel and 8.6' from rhe new lor line. While rhe cabin will not meet
the City standard of a l O' side iot line setback> the encroachment over the lot line is eliminated.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Orono hereby approves the lot line l'ean-w1.ge1nen.t of the above referenced p1·opextyby the. applicants
as shown on the certificate of survey by J a.mes H. Parker, a licensed surveyor of Advanced Surveying
& Engineering Co. dated November 4, 2004, as attached in Exhibit "A", subject to the following
conditions:
l. Applicants shall provide a title opinion for the properties confinning ownership and
encumbrances.
2. Nothing in thi.s approval shall be construed as gr3nting varia11.ces to setbacks, h~rdcover or
other building location, lot size or developmem standards established by the City of Orono.
3. The aforesaid division sho'-vn on rhe attached Certificate of Survey shall be filed by rhe City
of Orono with either the Hennepin County Recorder's Office or Registrar of Titles Office on
or before February 8, 2006 together with a certified original copy of rhis resolution.
4. The approval granted by this resolution shall expire if the division has not been filed by the
date specified above. 1n that event, it will be necessary to fik a new application with the City
of Orono for subdivision review.

Gundlach stated the restriction on the signage was included in the resolution that was mailed to the
applicant prior to approval of the resolution at the last council meeting.
Valeiius indicated she was not aware that language was included within the resolution or she would have
brought it up at the last council meeting.
Gundlach noted the applicant was not present at the last meeting.
Peterson reiterated it was her understanding that the office space would not be a high volume business
that would require signage.
Murphy commented that this application has grown considerably over the course of the past few months.
Sansevere stated he would approve the signage since it is allowed in the B-1 District.
Peterson inquired whether the Planning Commission should review this change.
Gaffron stated in his opinion it is not a significant enough change to warrant bringing it back before the
Planning Commission.

Application Summary: Applicants request approval for a lot line rearrangement between these
two recreational parcels.
Each lot contains a seasonal cabin. 410 also has a shed and an extensive retaining wall system
holding up the steep bluff at the lakeshore. No new construction or activity is proposed. The lot line
rearrangement is intended to resolve a historical encroachment issue that applicants thought had been
resolved via a deed exchange in 1986, but which never received City approval. The cabin on 400
Big Island encroaches approximately 1.4' onto 410 Big Island. The 10' property exchange leaves
one corner of the 400 Big Island cabin 8.6' from the lot line, where 10' would be required, but staff
has concluded that requiring applicants to revise all their deeds and past actions to gain the extra 1.4'
is not justified.
There are no existing utility or drainage easements along the shared lot line, and due to the
topography, staff finds no public value in requiring such easements.
Planning Commission Recommendation
Planning Commission reviewed this at a public hearing held on July 18 and on a vote of 7-0
recommended approval as proposed.

Jurgens inquired why the encroachment is not being eliminated or reduced.
Gaffron stated the 1.4-foot encroachment goes back approximately 20 years but was never formally
approved by the City. ·
Rahn moved, Bremer seconded, to recommend approval of Application #05-3128, Gregory
O'Connor and Richard Fruen, granting of a lot line rearrangement for the properties located at
400 and 410 Big Island. VOTE: Ayes 7, Nays 0.
5. #05-3133 BRUCE AND ELIZABETH NUSBAUM, 3480 NORTH SHORE DRIVE,

Elizabeth and Bruce Nusbaum, Applicants, were present.
Rahn stated to his recollection he does not remember the Planning Commission ever approving a side
setback variance of 3. 7 feet for a new accessory sh'ucture without there being some type of hardship being
demonstrated. Rahn noted this lot is already over in strnctural coverage and stated that he has concerns
with the proposed structure being a story and a half. Rahn indicated he would recommend that the
building meet the I 0-foot side yard setback requirement if it is going to be a story and a half and that the
size of the structure be limited to 440 square feet.
Rahn stated he might be willing to approve a side setback variance if the garage were the standard height
but that he is not willing to approve the present proposal. Ralm stated in his opinion the driveway sho1,1ld
also be 20 feet in length from the curb to the garage door in order to allow a full-size vehicle to park in
that area.
Curtis pointed out there is 20 feet from the proposed garage to the curb cut.
Mr. Nusbaum indicated it is 18 feet to the property line from the proposed garage.
Ralm stated he had the understanding there was a 15-foot rear yard setback being requested.
Curtis indicated there is approximately 20 feet from the curb cut to the garage due to the angle of the
property.
Gaffron recommended making the 20-foot driveway from the edge of the roadway to the edge of the
garage a condition of approval.

Since no construction activity is proposed, staff has not required hardcover calculations nor
construction plans for either property. Applicant has advised that there are no septic system impacts
resulting from this rearrangement, although the applicants are exploring the possibility of a shared
septic system for future needs.
There are no existing utility or drainage easements along the shared lot line, abd due to the
topography, staff finds no public value in requiring such easements.

We are in receipt of your survey in regards to the 1 0' strip which was conveyed in 1986 from Fruen to
Granrud but never approved by the City. In reviewing the files for these addresses I find that I had sent
a letter to Robert Granrud in 1998 and a letter to Robert A. Lafleur in 2004 regarding how to proceed.
Copies of those letters with supporting information are attached.
The process for approval of lot line rean·angement involves one meeting with the Plaiming Commission and
one meeting with the City Council. The process typically takes about 2 months from the application date.
The cunent owners of 400 and 410 must jointly make the application.
ThePlai11ring Commission meets once a month. The submi_ttal deadline for the next application period is
Wednesday, May 18 for applications that would be scheduled for a June 20 public hearing at the Plamring
Commission. Tlris would then be forwarded for City Council action on either June 27 or July 11. If you
need an extra month to prepare your application, the next deadline would be June 22 for a mid-July
Planning Commission hearing and Council action in late July or early August.
I'm enclosing a subdivision application packet, with the necessary submittal info1mation highlighted.
Because not all information in the packet applies to a simple lot line reaiTangement, following is a summary
of the infonnation you must provide:
1. Application Fom1 and Disclosure filled out and signed by all involved property owners.

Steve Bohl of Bohland Development, Inc. requests rezoning and preliminary plat
and general concept plan approval via the Planned Unit Development process for
a residential subdivision to create 11 lots on 1 block at a density of approximately
3 units per acre from property located at 190 Willow Drive South and 177
Glendale Drive, RR-lB zoning district.
Peter Eskuche on behalf of Brad & Cheryl Jones, 2545 North Shore Drive, LR-
lA zoning district, requests a lot area variance and conditional use permit to
permit construction of a new residence on an existing lot 1.53 acres in total area
with 0.92 acres dry buildable where 2.0 acres is normally required and to permit
approximately 900 cubic yards of fill when normally no more than 500 cubic
yards is permitted without a conditional use permit.
Bruce & Elizabeth Nusbaum, 3480 North Shore Drive, LR 1 C zoning district,
requests a side setback variance, a structural coverage variance to allow 1,750 s.f.
of structural coverage where 1,500 s.f. is normally allowed and 1,705 s.f.
currently exists, a hardcover variance within the 75' -250' zone for 30.8%
where 25% is normally allowed and 29.7% currently exists, and a hardcover
variance within the 250' -500' zone for 41.8% hardcover where 30% is allowed
and 4 7 .9% currently exists to allow the construction of a new detached garage.
David Park of Durabilt on behalf of Ricl)ard & Patricia Crosby, 2705 Walters
Port Lane, LR -lB zoning district, requests hardcover variances for 14.2%
hardcover within the 0-75' zone where 0% is normally allowed and within the
75' -250' zone for 61.7% hardcoverwhere25% is normally allowed and 61.7%
currently exists in order to construct an attached 16' x 17' garage.
Allen & Deanna Munson, 3165 North Shore Drive, LR-lB zoning district,
requests a conditional use permit to allow fill in excess of 500 cu. yards and an
average lakeshore setback variance to construct a new single family residence at
the same setback as the existing home.
Troy R. Broitzman, 1860 Shoreline Drive, LR-IA zoning district, requests an
average lakeshore setback variance in order to construct a new single family
residence.
Robert & Victoria Jaffray, 540 Barrett Avenue, RR-I B zoning district, request
a front yard setback variance to permit a front yard setback of 25' when 50' is
normally required and 25' currently exists in order to construct a garage addition

zoning district, requests a lake setback variance, a variance for 2,685 s.f. of
strnctural coverage where 1,909 s.f. is normally allowed and 2,741 s.f. currently
exists and hardcover variances for hardcover within the 0 -75' zone of 32.9%
hardcover where 0% is normally allowed and 32.6% currently exists and within
the 75' -250' zone of 29.5% hardcover where 25% is normally allowed and
31.4% currently exists to permit the removal of a detached garage and
constrnction of an attached garage with living space above.
19. #05-3139 Hill School of Minnesota, Inc, 2180 North Shore Drive, RR -IB zoning
district, requests side yard and side street setback variances in order construct an
addition for office space, and a conditional use permit amendment to expand the
school, and allow a temporary trailer on the property for use during construction.
