Tom Barrett stated he is not aware of anything that would prevent the temporary certificate of occupancy from being extended . Nygard stated he personally is against temporary certificates of occupancy. Nygard stated some other cities allow the certificate of occupancy to be issued once the building is near completed, but require another building permit to , for example, finish the basement. Nygard stated perhaps the City Council should look at that process rather than issuing temporary certificate of occupancy. Moorse stated another option would be for the City to remove the building and to assess the costs back to the property owner. The deck constitutes hardcover and structure within 75' of the lakeshore. The deck is of similar dimension as the deck that was removed. At least two of the existing supports and footings were used for the replaced deck. The deck is located approximately 32' from the lakeshore of Lake Minnetonka, the same setback as the deck that was removed. According to historic surveys and 1999 photos of the property the lakeside deck did exist and is similar in size and dimension to the replacement deck. The deck is located above the hillside from the lake and provides access to the lakeside entrance to the cabin. Mr. Eiden has stated the previous deck had rotted to state of disrepair and was a safety hazard. The new deck was constructed above the footing and posts that supported the original deck. Planning Commission Recommendation: By a vote of7 to O the Planning Commission recommended approval of the after-the-fact variances to permit replacement of the deck. COUNCIL ACTION REQUESTED Motion to adopt the attached resolution approving variances. A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 10.22, SUBDIVISION 1 (A) AND SECTION 10.56, SUBDIVISION 16 (L) (1) FILE NO. #01-2690 WHEREAS, John Allen Eiden, (hereinafter "the applicant") is owner of the property located at 330 Big Island within the City of Orono (hereinafter "the City") and is legally described as follows: Lot 70 and the Northerly 30 feet of Lot 71, Morse Island Park, Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on July 16, 2001, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the applicant applied to the City of Orono for variances to Municipal Zoning Code Section 10.22, Subdivision 1 and Section 10.56, Subdivision 16 (L) (1) to permit replacement of a 318 s.f. deck 32' from the OHWL of Lake Minnetonka, constituting structure and hardcover within the 75' lakeshore protection setback; and NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #01-2690. 2. The property is located in the RS Seasonal Recreational Zoning District. 3. The Orono Planning Commission reviewed this application on July 16, 2001 and recommended approval on a vote of 7 to O for variances based upon the following findings and hardships: Page 1 of 5 A. Total hardcover within the 0-75' lakeshore setback would not exceed 1,120 s.f. (18%) that existed prior to removal of the previous deck. B. The previous deck had deteriorated and had become a safety concern. C. In 1983 the Council approved an automatic lot area variance that approved the lot as a record lot. The variance allows the lot to be used for one-family seasonal recreational use without a structure; or a single new seasonal dwelling may be built; or an existing seasonal dwelling may be used, improved and/or added onto; without requiring further City Council review of lot size. D. According to historic surveys and 1999 photos of the property the lakeside deck did ~xist and is similar in size and dimension to the replacement deck. 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to Municipal Zoning Code Section 10.22, Subdivision 1 and Section 10.56, Subdivision 16 (L) (1) to permit replacement of a 318 s.f. deck 32' from the OHWL of Lake Minnetonka, constituting structure and hardcover within the 75' lakeshore protection setback, subject to the following conditions: Page 2 of 5 1. The deck replacement is approved as shown on the survey attached to this resolution as Exhibit A. 2. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (July 23, 2002). 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicant has read, understand and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property. Section 10.56, Subdivision 16 (L) ( 1) -No hardcover or impervious surface shall be placed, located or constructed within 75 feet of the Ordinary High Water Level of any lake or tributary, except for stairways, lifts, landings, and lockboxes. 2. The variance allows the lot to be used for one-family seasonal recreational use without a structure; or a single new seasonal dwelling may be built; or an existing seasonal dwelling may be used, improved and/or added onto; without requiring further City Council review of lot size. A previous property owner had improved and constructed a deck on an accessory building located over the rear property line into the Meta-Comet A venue right-of-way. The structure, absent a deck, had existed in this location for many years. The previous property owner did the work without obtain a building permit. A stop work order was issued in 1991 while the work was being completed. No building permit has ever been applied and no record exists stating the City of Orono had granted a right-of-way permit for use of the public land for private purposes. The existing owner purchased the property in 1996. Staff Recommendation Staff recommends approval of the hardcover and structure variance to permit replacement of the lakeside deck based on the fact that a de-ck had existed in that location previously and the size and dimensions of the deck have not increased. Options for Planning Commission Action 1. Recommend approval of the variance to permit the after-the-fact variance that would permit replacement of the deck. 2. Recommend denial, stating reasons. 3. Marc Fritzler (alternate). The following represented Cfty Staff: Planning Director Michael Gaffron, Zoning Administrator Paul Weinberger, Zoning Administrator Wendy Bottenberg, and Recorder Lin Vee. Chair Hawn called the meeting to order at 6:30 p.m. NEW BUSINESS PUBLIC HEARINGS (#1) #01-2690 JOHN A. EIDEN, 330 BIG ISLAND, AFTER-THE-FACT VARIANCES, 6:31 p.m. -6:40 p.m. John Eiden, Applicant, was present. The Certificate of Mailing and Affidavit of Publication were noted. Weinberger stated the Applicant is requesting an after-the-fact variance to permit replacement of a lakeside deck on Big Island, constituting hardcover and structural coverage within 75' of the lakeshore. The deck is approximately 32' from the lakeshore. According to historical surveys and photos, the deck appears to be of the same size as the original deck. The owner's intention was to repair the deck; however, only the original footings could be used because of extensive deterioration. Another issue, unrelated to the variance request, is that a structure located at the rear of the property is above a platted right-of-way used for pedestrian access or utilities. A previous owner had completed a rehabilitation of the structure in 1991 and was issued a "stop work" order. No further work has been done to that structure and it has no impact on the current variance request. City Staff recommends approval of the after-the-fact variance request for deck replacement within 75' of the lakeshore constituting hardcover and structural coverage based on the fact that the deck previously existed, the existing building was located in its current location prior to current zoning standards, and some type of structure is needed to the lakeside of the building for access. Eiden stated that he had eliminated a stairway resulting in less hardcover than the previous deck. He showed a sample of the rotten floor joists to the Commissioners . There were no public comments regarding this application. Smith asked if the deck needed to be considered a rebuild rather than a repair. Weinberger responded that since only a couple of posts remained, it was considered new structure. PAGE I MINUTES OF THE ORONO PLANNING COMMISSION MEETING Monday, July 16, 2001 (#01-2690 John A. Eiden, Continued) Eiden commented that he was from Louisiana where 50% replacement was allowed. He intended to replace only 50% but found rotten wood. He used the original footings and replaced the deck in the original footprint. Smith noted that the application was essentially a replacement deck. Hawn and Lindquist commented that the Planning Commission has been fairly consistent in allowing deck replacement. Hawn expressed concern with the building in the right-of-way. Eiden commented that it was originally an ice house and is currently used as a guest house with no plumbing. Hawn asked if it were possible to move the building within the property lines. Eiden responded that it would not be worth it. Mabusth asked if the Applicant had considered the permit process for use of the unimproved right- of-way. Eiden responded that he was not aware of that process. Lindquist asked if the Planning Commissi<:m would approve use of the unimproved right-of-way. The Commissioners did not think such a request would be approved. Weinberger commented that the previous owner had started some type of request to use the right-of- way in 1995 but did not complete that request, and he suggested continuing with the permitting process. There was much activity in 1991 when the building was completely remodeled and a deck added, and then again in 1995 when the property was for sale. Hawn suggested the Applicant continue to move forward with the right-of-way issue. Lindquist moved, Smith seconded, to recommend approval of Application #01-2690, John A. Eiden, 330 Big Island, granting approval of after-the-fact hardcover and structural variances to permit replacement of the lakeside deck at 330 Big Island. VOTE: Ayes 7, Nays 0. (#2) #01-2691 J.
