As of the date of this memo the City of Orono has not received a building permit. The property is 4.3 acres in size and is land locked. The access to the lot is via any of the undeveloped public roads. A major issue for the property owner is dock access. This property is one of several lots on the Island that potentially will request dock rights. The Municipal Code allows installing, maintaining, keeping or using a private dock on any platted public right-of-way when such dock has been specifically authorized as part of a permit issued by the Council. Not more than one seasonal dock will be approved for access to any one property. In review and approval or denial of such permit, the Council shall consider the width and topography of the right-of-way, the number of property owners requesting dockage at that location, the plan of the proposed dock, and conformance with City and Lake Minnetonka Conservation District dock regulations. The Council may establish reasonable standards or requirements in approving any such dock permit. Permits are not required for any person to walk on or over any platted public right-of-way or any platted public park when such use is made without altering the natural state of the land. No permit shall be required for any person whose property abuts a platted public right-of-way or a platted public park to control weeds or brush, seed, sod, mow or otherwise maintain said right-of-way or park in a neat and presentable manner. The Code states permits issued are valid for one year, shall be subject to change, alteration or revocation for cause by the Council at any time, and shall be automatically renewable on the anniversary of the date of issuance except upon written notice from the City to the permittee at least thirty days prior to the anniversary date. Any formal requests for permits on Big Island require a public hearing with the Planning Commission or the Council. Notices are handled similar to notices for conditional use permits and require a 350' mailed notice to adjacent property owners. The notices shall contain the description of the land and the proposed use. Only a few actually are developed with a dwelling on the property. The issue is whether dock access can be provided for the additional lots on Big Island. Overnight camping and day use is permitted on all lots on Big Island. A total of 15 lots have been identified as separate parcels that can be sold by the property owners at any time. Many of the existing lots without lake access are commonly owned, several by property owners with direct lake access. Issues for Discussion 1. Should the dock rights be for property owners without any other access? 2. Many of the lots are commonly owned but have not been combined into a larger tax parcel. Potentially the individual lots could be sold to several owners that may request access in the future. 3. The permit approved by the City Council (Resolution No. 2038) permitted a dock in favor of property located at 230 Big Island. A condition of approval was any other requests for docking at the Bay Place site would cause the permit to be immediacy revoked. 4. The following are uses permitted on Big Island. (Section 10.31, Subdivision 2) A. Seasonal Dwellings. One family detached dwellings used for seasonal recreational use not to exceed 180 days in any one year, and not to be the owner's "principal residence" for homestead tax credit purposes. B. One family, seasonal recreational use of land without structures, or with accessory structures only, such as tent camping or day-use only. Accessory structures permitted on land without a principal structure shall be limited to one or more of the following: a) Docks conforming to City and LMCD Code requirements b) One storage building not to exceed 120 square feet in area c) Firerings or barbeque pits d) Open deck or screen house not to exceed 300 Council Action Requested Discuss and provide direction to staff creating a policy for dock rights for inland property owners. Jabbour said the lot would not meet the 5 acre zoning requirement. He said this is a record lot that would have been granted an automatic lot area variance in 1983. Lovelace said the original property owner did not apply for the automatic lot area variance. Jabbour said he is in favor of approving the variance, but he is not in favor of providing city docks. Lovelace said there are other land-locked lots and he knows at least one has a dock on the public right-of-way. Jabbour said the City of Orono is unaware of the dock. _ Gaffron reviewed the City Code concerning dock permits on public rights-of-way. Jabbour asked to review a map of the area. He commented that it shows a dock on public land. Weinberger said a dock permit was issued to one property owner as she had used the dock prior to the code amendment regarding the RS, Seasonal Recreational District.. Jabbour asked staff to identify parcels on Big Island that do not have access to the lake. Kelley asked if the roads on the island are developed and marked. · Kelley said the City property should be ·identified in some way. VOTE: Ayes 4, Nays 0. (#9) #2466 James Renckens, having an interest in 3020 Watertown Road-2 Lot Preliminary Subdivision James Renckens and John Winston, applicants, were present. Renckens said he objects to the requirement that two outlets be created. He is concerned · about the availability of septic sites if the outlets are created. He said the site is rolling and high to the north, rolling in the middle and there is a wetland in the middle. The parcel is difficult to develop. He would like to build his home on the northern part of the property. There is one septic site in the northeast comer that he would like to use as a primary site and it would be eliminated by the 50' outlet. He said the ambiance of that comer is what attracted them to the property and that would be ruined if a road is installed. He requested that the Council eliminate the requirement for the outlets. Mayor Jabbour unseated himself for this item. John Winston said his property abuts the northeastern part of the parcel. He and his neighbors oppose the 50' outlet across the northern boundary. They are not interested in connecting Wear Lane to Crystal Creek Road. He said the original proposal for this parcel was a subdivision for five lots. This proposal is for two lots. He feels the low density is important and that the outlets are not necessary. He said they are not proposing any roadway, only a driveway corridor at the southwesterly comer of the parcel. He would like to preserve the character of this property that blends with the neighborhoods to the east and the west. He said . there is property to the north that could possibly be developed. He does not feel that Mr. Renckens should have to provide access to that property by creating Outlet B. Sanseve,re asked staff why the outlets were made a contingency of approval. Weinberger stated that the proposal creates a front lot and a back lot situation. The subdivision ordinance does not allow a flag lot to be created. The back lot is required to have 150% of the zoning district requirements and the lot does meet those requirements. The zoning code only allows access to be granted to that property through a platted outlot. The disadvantage for the property owners in this situation is the area in the outlet does not count for the lot area as part of lot 1, although the entire outlet would be in their ownership. The existing lot is 4.3 acres where 5 acres is the minimum lot size for building. The applicant has purchased the lot and plans to construct a seasonal residence in the near future. Most lots on Big Island were granted automatic lot area variances in 1983 when the island was rezoned to RS ( 5 acre). Property owners were given the opportunity to file a short application form on their individual lots to the City. All property owners returning forms to the City were granted variances by Resolution. The resolutions state each lot is a RECORD LOT and may be used for one- family seasonal recreational use without a structure; or a single new seasonal dwelling may be built; or an existing seasonal dwelling may be used, improved, added-onto or replaced; all without requiring further City Council review of lot size. The variances were granted on developed and undeveloped lots, and the one year expiration time period was waived. A previous property owner was given the opportunity to apply for the automatic variance several times in the 1980s, but never responded to the offers. In 1986 the automatic variance at no cost to the property owner had expired. This application requires the following variance: 1. Section 10.31, Subdivision 6 requires 5.0 dry acres for a lot to be buildable. The applicant's lot is under 5.0 acres and did not file for an automatic variance in the 1980s and requests to do so now. PLANNING COMMISSION RECOMMENDATION: The Planning Commission recommended by a 5 to O vote to: Approve the variance as presented. COUNCIL ACTION REQUESTED To approve or amend the enclosed resolution. Pertinent Ordinances • Section 10. 31 --RS Seasonal Recreational District Condition of Property The lot contains an old cabin that is inhabitable. The roof has caved in and walls are falling. The applicant must apply to the City for a demolition permit and remove the existing cabin prior to new construction. A small wetland exists in the center of the property. It is a non-Orono wetland. The following activities on the property must meet minimum setbacks from the wetland. Structure 26' Grading/Fill 26' Septic Sites/Well 75' Property Access Big Island contains a network of platted roads that are undeveloped. Access to inland lots is provided by the platted right-of-ways. No permits or improvements are required to use the roads. The main concern for inland property owners is boat storage since they do not have riparian rights. Private property owners are not permitted to provide dock space or boat storage on their properties for access to inland residents and guests. Although permits would not be regularly issued, the City Council can grant permits for dock space or boat storage within public right-of-ways. Not more than one seasonal dock will be approved for access to any one property. In review and approval or denial of such permit, the Council will consider the topography and development of the locality. The dock must also conform to Lake Minnetonka Conservation District and City of Orono standards. Surrounding Properties The property is a landlocked parcel without lake access. Access to the property is via platted, undeveloped roads. A road is platted that is located adjacent to the east and southern portions of the applicant's property. The west side of the parcel is the Dr. Arthur Allen Wildlife Refuge (Hennepin County Parks). The north side of the property is a year round residence that is currently occupied. #2462 David Lovelace 220 Big Island Variance 4/12/99 Page2 1. No variance was granted to permit 220 Big Island to be a legal, record lot. The opportunity to apply to the City for a "free" automatic variance has expired. 2. One property to the north exists without lake access. The lot has been in use for many years. 3. The main concern for inland property owners is boat storage since they do not have riparian rights. Private property owners are not permitted to provide dock space or boat storage on their properties for access to inland residents and guests. STAFF RECOMMENDATION • Staff recommends approval of the variance to permit 220 Big Island to be a buildable lot, and to waive the one year expiration for the variance. That David Lovelace is the owner of record of the following described property located within the RS Seasonal Recreational Zoning District of the City of Orono: Lot B, Morse Island Park, Hennepin County, Minnesota (hereinafter the property). 2. That in adoption of Ordinance No. 246, the City Council reviewed ownership, development and use patterns on the islands and determined that all the above described property combined is and shall hereinafter and henceforth be one "Record Lot" as defined in Section 10.31 of said ordinance. 3. That all the above described property when combined as one Record Lot is still less than the minimum lot size required for new lots in the RS District, but that this Record Lot is being used and/or may be used in the future for any permitted use in the RS District without adverse effect upon public health, safety or welfare. CONCLUSION The City Council of Orono hereby grants a lot area variance to the above described Record Lot based on the above findings and subject to the following conditions: 1. This Record Lot including all the above described property combined shall henceforth be continued in common ownership by the same person or persons even if recorded as separate lots or tax parcels, and it shall not be subdivided, sold in parts, reduced in area or otherwise separated without application for and approval of a subdivision by the City. This condition shall not preclude future sale or transfer of the complete "Record Lot" as a single unit. Page 1 of3 2. Granting this variance means this Record Lot may be used for one-family seasonal recreational use without a structure; or a single new seasonal dwelling may be built; or an existing seasonal dwelling may be used, improved, added-onto or replaced; all without requiring further City Council review of lot size, but subject to strict compliance with all building permit, setback, hardcover, on-site sewage treatment and other performance standards for development in the RS District. 3. Granting this variance shall not vest any rights in the property other than as specifically provided in Ordinance No. 246, and shall not preclude a future City Council from amending, modifying or otherwise limiting development rights and/or performance standards in the RS District. 5. The undersigned has read and understood the terms of this resolution and on behalf of himself, his heirs, successors and assigns, agrees that the above described property constitutes a single Record Lot; agrees that the Record Lot use may be so limited by the City; and agrees to the recording of this resolution in the chain of title of the property. Perhaps this was an oversight, or perhaps you did not wish to return the forms at that time. In either case, your Big Island property currently has NOT been officially granted variances to lot area or lot width, and you would have to file for these variances iri order to be allowed to do any building or remodeling on your property. Although nearly 2/3 of the Big Island property owners returned the proper forms to be granted the lot area variances in 198 3 (at no cost to the property owner), approximately 1/3 have not returned them, and the filing fee for a variance application currently is $150.00. Because there may have been some misunderstandings of the no-cost automatic variance procedure in 1983, you again have the opportunity to return the proper forms and be granted the lot area variance at no charge. (#7) #2462 DAVID LOVELACE, HAVING AN INTEREST IN 220 BIG ISLAND -VARIANCE, 8:25 p.m. -8:37 p.m. David Lovelace, Applicant, was present. Weinberger stated the Applicant is requesting a lot area variance to create a buildable lot on • Big Island. The existing lot is 4.3 acres where 5 acres is the minimum lot size for building. . . . . . Weinberger stated access to the lot is an issue, rioting that there are a number of platted right-of- ways within Big Island, which would allow access to the lot. In 1983, most lots on Big Island were granted automatic lot area variances when the island was rezoned to RS. The previous property owner never filed their application to have their automatic lot area variance granted, making it a record lot, and the time period has expired for a free automatic variance. Staff recommends approval of the variance to permit 220 Big Island to be a buildable lot, and to waive the one year expiration for the variance. Weinberger stated the main issue is access to the lot for docking rights. It should be noted that City Code requires that docks on Big Island are for the use of the owners and their guests and not to be loaned or rented for money. If the Applicant requested dock space, a permit would need to be issued by the City Council. City Staff is also requesting that an existing cabin, which is currently in ruins, be removed prior to construction prior to any building permit being issued. · Lovelace· stated an agreement exists where restricts construction on the north area of the property, noting he is willing to remove the old cabin that currently exists on the parcel. Weinberger remarked that an easement granted by the previous property owner as a conservation area to the north to avoid any new structure being constructed in that area, and the Applicant has agreed to file a copy of the easement with the City and have it placed it ori the title. Lovelace indicated at this time he does not have an intention to store boats on Big Island, but would like to have a permit issued to have a dock on the property. MINUTES FOR MARCH 15, 1999 (#2462 David Lovelace, continued) Weinberger stated the previous owner did have dock rights with the neighboring property owner, which was grandfathered in. Schroeder indicated that access to this lot sh~uld be granted before apprnval of this application is given. · ·. · · · · Lindquist indicated he would be willing to approve this application subject to access being granted by the City Council. Schroeder suggested that this application be tabled until access is obtained. Lovelace indicated he will not be obtaining any building permits unless access is obtained. Chair Smith inquired whether there were any public comments concerning this application. Gerald Walsh, 180 Big Island, commented that there are three public accesses available. Smith remarked that the residents are not allowed to leave their mode of transportion on the public right-of-way. Rodney Minnich, 340 Old Crystal Bay South, commented that the Applicant could buy an aquatic car. Smith stated the issue is that the residents cannot leave their mode of transportation on public land. McMillan inquired whether there were suitable septic sites available. Lovelace commented that the septic inspector has found three or four sites which will probably be suitable for his use. Lovelace stated a mound system would be required if he builds in excess of 800 square feet. Hawn moved, McMillan seconded, to recommend approval of Application #2462, granting of a lot area variance to create a buildable lot at 220 Big Island, subject to access being obtained and septic issues being resolved. VOTE: Ayes 5, Nays 0. (#8) ROBERT ERICKSON, 364 and 372 WESTLAKE STREET, LOT LINE REARRANGEMENT, 8:38 p.m. -9:10 p.m. Robert Erickson, Applicant, along with Mike Cronin, were present. Weinberger stated the Planning Commission reviewed the sketch plan for the proposed lot line rearrangement at their November, 1998 meeting. The Applicant has revised the plans slightly. Currently Lot 9, the 364 property, is a narrow parcel consisting of .65 acres, and the property located at 372 Westlake Street consists of 2.01 acres, which makes it a conforming lot. 372 Westlake Street has a residence currently situated on it, which is being occupied at the present time, along with two guest cabins. The lot was assessed for only one sewer unit although it does contain the three separate dwelling units. The existing lot is 4.3 acres where 5 acres is the minimum lot size for building. The applicant has purchased the lot and plans to construct a seasonal residence in the near future. Most lots on Big Island were granted automatic lot area variances in 1983 when the island was rezoned to RS (5 acre). Property owners were given the opportunity to file a short application form on their individual lots to the City. All property owners returning forms to the City were granted variances by Resolution. The resolutions state each lot is a RECORD LOT and may be used for one- family seasonal recreational use without a structure; or a single new seasonal dwelling may be built; or an existing seasonal dwelling may be used, improved, added-onto or replaced; all without requiring further City Council review of lot size. The variances were granted on developed and undeveloped lots, and the one year expiration time period was waived. A previous property owner was given the opportunity to apply for the automatic variance several times in the 1980s, but never responded to the offers. In 1986 the automatic variance at no cost to the property owner had expired. This application requires the following variance: 1. Section 10.31, Subdivision 6 requires 5.0 dry acres for a lotto be buildable. The applicant's lot is under 5.0 acres and did not file for an automatic variance in the 1980s and requests to do so now. #2462 David Lovelace 220 Big Island Variance 3115/99 Page I Pertinent Ordinances • Section 10.31 --RS Seasonal Recreational District Condition of Property · . . . . The lot contains an old cabin that is inhabitable. The roof has caved in and walls are falling. The applicant must apply to the City for a demolition permit and remove the existing cabin prior to new construction. A small wetland exists in the center of the property. It is a non-Orono wetland. The following activities on the property must meet minimum setbacks from the wetland. Structure 26' Grading/Fill 26' Septic Sites/Well 75' Property Access Big Island contains a network of platted roads that are undeveloped. Access to inland lots is provided by the platted right-of-ways. No permits or improvements are required to use the roads. The main concern for inland property owners is boat storage since they do not have riparian rights. Private property owners are not permitted to provide dock space or boat storage on their properties for access to inland residents and guests. Although permits would not be regularly issued, the City Council can grant permits for dock space or boat storage within public right-of-ways. Not more than one seasonal dock will be approved for access to any one property. In review and approval or denial of such permit, the Council will consider the topography and development of the locality. The dock must also conform to Lake Minnetonka Conservation District and City of Orono standards. Surrounding Properties The property is a landlocked parcel without lake access. Access to the property is via platted, undeveloped roads. A road is platted that is located adjacent to the east and southern portions of the applicant's property. The west side of the parcel is the Dr. Arthur Allen Wildlife Refuge (Hennepin County Parks). Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; ( c) any known consequence arising from his supplying or refusing to supply private or confidential data; and ( d) the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. . Subd. 3. Access to data by individual. Upon request to a responsible authority, an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon his further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority may require the requesting person to pay the actual costs of making, certifying, and compiling the copies.
