� � DECLARING COST TO BE ASSESSED, ORDERING PREPARATION
OF PP.OPOSED ASSESSMENT AND CALLING FOR A PUBLIC
HEARING ON THE PFOPO5E� A�SESSTIENT FOR HAZARDOUS
EUILDING REMOVAL
. WFiEF;EAS, pursuan�. Lo Resolutions #1401 and #1402, owners of
hazardous� buildings were ordered to have said buildings removed, or
the City of Orono would make a motion for summary enforcement of the
order througn Hennepin County District Court, and that all necessary
costs expended by the City would be assessed against the real estate
concerned; and �
WHEREAS, the hazardous buildings were removed by the owners
only .after being condemned and the City did expend monies in the total
amount of $1, 863 . 53 in obtaining said condemnation; and
• WHEREAS, pursuant to Court Orders No. 797487 and No. 797173
dated March 24 , 1983 , the City of Orono may assess for certain expenses
incurred in its efforts to obtain an order to remove the hazardous �
buildings; and .
WHEREAS, the City Administrator has prepared a proposed , �
assessment roll based on said costs awarded by the Court, which
proposed assessment is filed in his office for public inspection.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Orono, Minnesota: -
l. The amount of such Court awards to be specifically
assessed as follows:
a) Property located at 4100 North Shore Drive and
legally described as Lot 70 , Highwood, Lake Minnetonka,
_ according to the plat on file and of� record in the office
of the Registrar of Titles of Hennepin County, Minnesota
to be assessed $1,040 . 50 .
b) Property located at 300 Tonka Avenue and legally
described as Lots 17 and 18 , Block 5, Bayside Addition
to Lake Minnetonka, according to the plat on file and
of record in the office of the Register of Deeds,
Hennepin County, Minnesota to be assessed $�28 .03,

' 2 . A hearing shall be held on the 13 day of June, 1983 ,
in the Orono Council Chambers, 1275 Brown Road South,
at 7 :00 P.M. to pass upon ,such proposed assessment and
at such time and place all persons owning property affected
by the improvement will be given an opportunity to be heard
with reference to such assessment.

3 . The City Administrator . is hereby directed to cause a
notice of the hearing on the proposed assessment to be
published once in the Lake Minnetonka Sun newspaper at
least two weeks prior to the hearing, and he shall state
in the notice the total cost of the improvement. He sha11
also cause mailed notice to be� given to the owner of each
parcel described in the assessment roll not less than two
weeks prior to the public hearing.

� meeting held May 9, 1983 .
