HomeMy WebLinkAboutResolution 1476 _ -- ;. , .� o d _ C�t� o� ORONO '`���� RESOLUTION OF THE CITY COUNCIL ���' ' NO. 14 7 6 V/ ��j,`:C�Y,.7k . . � � � � A RESOLUTION APPROVING A BUILDING PERMIT FOR JAMES DONGOSKE TO CONSTRUCT A DOCK ON LOT 6 , BLOCK 2, FOREST ARMS PLAT WHEREAS, the Planning Commission and City Council have reviewed a request of James Dongoske to construct a dock on that portion of his property abutting Forest Arms Channel; and . WHEREAS, James Dongoske must obtain a building permit from the City of Orono to construct said dock. NOW, THEREFORE BE IT RESOLVED that based upon .the. recommen- dation of the Planning Commission and th� report of the Orono staff, the City Council hereby makes the following findings of fact: l. That on February_ 3 , 1966, John Gullickson did make application to the DNR for a permit to- "dredge a channel � � along the shoreline for boat access" . 2 . That on April 26, 1966, the DNR issued a. permit to John Gullickson to "excavate and remove silt and earthen material from the bed of Forest Lake to elevation 925.0 S.L.O. in construction of a channel along the shoreline of said lake and on applicant's property to be 1,300 feet long • having a 20 foot bottom with 3 :1 slopes on and abutting. . . . for the purpose of improving navigation facilities" . 3 . Lot 6, Block 2, Forest Arms Plat has approximately 143 ' of shoreline abutting the Forest Arms Channel. • 4 . As of April 11, 1983 , Forest Arms Channel is navigable . and riparian to Lake Minnetonka. 5. The granting of the application will allow the property owner the immediate use of the available channel but does not in and of itself constitute the granting of a vested right to redredge this channel. 6 . To issue a permit for the proposed, limited dock constructior will not in any way impair the public health, safety, comfort, morals or general welfare. • 7. The granting of this building permit will not be contrary to the intent and objectives of the zoning code and Comprehensive Land Use Plan. � ' s ��i� C�t� o� ORONO • �,y�:. ''�`��:• RESOWTION OF THE CITY COUNCIL .. �•���;_ NO. 14 7 6 � �-`�- • � • • � FURTHERMORE, BE IT RESOLVED that based upon the findings noted above, the City Council hereby approves James Dongoske ' s application for a bulding permit to construct a dock as requested subject to .the following conditions: • l�. The newly constructed dock must meet all applicable standards of the Lake Minnetonka Code of Ordinance and the Uniform Building Code. 2. The applicant shall construct a 16 ' X 35 ' parall�l dock � as shown on plan submitted by the applicant. Once erected, additional permits for annual dock removal and replacement will nat be required provided the dock is always replaced in the same location and configuration as approved in the original permit. Adopted by the City Council of the City of Orono, Minnesota at a regular � meeting held April 11, 1983 by a vote of �Ayes and d Nays. G � Mary C.
