A RESOLUTION APPROVING THE PLAT OF
JOHNSTONS FRENCH LAKE SECOND ADDITION
WHEREAS, .the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe developraent
of land wi�.hin the City; and
WHEREAS, the City Council has considered the application for
a subdivision plat by Harrison R. Johnston, Jr. also known as H. R.
Johnston, Jr. and Elizabeth Crosby Johnston, husband and wife, the •
subdividers; and
. WHEREAS, the .subdivision has been found to meet all standards
of the RR-1B zoning district finding that each lot is of a size and
configuration that will allow its use as a single family residence
to be located without the need of any setback variances; and
• WHEREAS, the City and the Subdivider have entered into:� a
purchase agreement wherein by quit claim deed to be recorded �r:i:sth� t�"xe
Hennepin County Recorder ' s Office prior to the recording of this�. g�a�,
City agrees to sell and Subdivider� agrees to purchase a parcel of City-
owned land to be included within this plat, which City land is legally
described as the West 180 feet of the East 510 feet of the South 550
feet of the North 1320 feet of Government Lot 6, Section 9 , Township 117,
North, Range 23 West of the Fifth Principal Meridian.
WHEREAS, the subdividers have completed all requirements of
the platting regulations of the City, including: .
1) Dedication on the plat of drainage and utility
easements. .
2) Dedication on the plat of right of way for a public
road shown as Willow Drive.
3) Creation of a new private road shown on the plat as
Outlot E, to be known henceforth as FRENCH LAKE ROAD.

4) Concurrent with the creation of this private "
. road, the Subdivider has dedicated to the City
a Road and Utilities Easement granting to the
City permanent access, improvement and utility
easements over said Outlot; the Subdivider has
created non-exclusive ingress, �egress, drainage
and utility easements over said Outlot in favor
of all abutting and/or benefiting lots including
a declaration of certain maintenance covenants
wherein each of the abutting and/or benefiting
lot owners covenants and agrees to permanently
maintain and pay the cost of tnaintenance for
said private road. .
5) Dedication to the City of a Flowage and Conservation
' Easement providing for limitations on the use of
wetlands and/or drainageways described therein and
shown on the plat as "drainage easements" .
� 6) Payment to the City of a. Park Dedication Fee in
the amount of $1,000 .
7) Payment to the City for the legal review and
recording of the plat and all documents related
thereto in the amount of $100 .
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Orono hereby approves the plat of JOHNSTONS FRENCH LAKE SECOND
ADDITION, Hennepin County, Minnesota, subject to the following conditions :
1) All lots will access via French Lake Road with no
direct access permitted to .Willow Drive. �
2) a) Outlot A must remain under joint ownership with
Lot 2, Block l, Johnstons French Lake Second Addition.
b) Outlot B must remain under joint ownership with
Lot 3, Block 1, Johnstons French Lake Second Addition.
c) Outlot C must remain under joint ownership with
Lot 4 , Block 1, Johnstons French Lake Second Addition.

3) The aforesaid plat shall be filed with the Hennepin
County Recorders Office on or before July 10 , 1983
together with a certified original copy of this
Resolution and executed copies of the easements and
covenants described herein.
Adopted by the City Council of the City of Orono, Minnesota at a
regular meeting held January 24 , 1983. ° �
