� RESOLUTION OF THE CITY COUNCIL ..

A RESOLUTION APPROVING THE PLAT OF .
WEST FOX .
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations �for •the orderly, economic and safe development
of land within the City; and
WHEREAS, the City Co,�uncil has considered the application for
a subdivision plat by Merrill H. Gibbs, , the subdivider; and ,
WHEREAS, the City Council and the subdivider have entered
• into a settlement agreement whereby the City relinquishes any claim
to a public cartway over the east 16 .5 feet of Lot 36, Auditor 's
. Subdivision No. 230 in exchange for an easement from the subdivider
over the east 12 feet of Lot 36; and
WHEREAS, the subdivider has completed all requirements of
the platting regulations of the City, including: �
1. Completion of all the requirements of Resolution #1407
' 2 . Dedication on the plat of right of way for a pubZic street
shown as Count.y.:. Road No. 84
3. Dedication on the plat of drainage and utility easements
4. Dedication to the City of a Flowage and Conservation
Easement providing for limitations on the use of wetlands
and/or drainageways described therein and shown on the
plat as "drainage easements"
5. Creation of a 12 ' wide outlot shown on the plat as
Outlot A, said outlot to remain in common ownership with
Lot 2, Block l, West Fox
6 . Concurrent with the creation of Outlot A, the subdivider
has granted a non-exclusive perpetual easement to the .
City over and across Outlot A, West Fox, limiting the
City' s use as follows:

a) A footpath easement for pedestrian access to and from
Lake Minnetonka
b) An . access easement during the months of December,
January, and February only, of each year, for passenger- •
type automobile, truck, and �a�x •access to and from Lake
Minnetonka
c) An easement for City maintenance vehicles for the purpose
of inspection and maintenance of the easement area
� . Payment to the City for the legal review and recording
of the plat and all documents related thereto in the
amount of $100 .00 •
• NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Orono hereb.y approves the plat of West Fox, Hennepin County,
Minnesota, subject to the conditions that the aforesaid plat shall be
filed, by the City of Orono with the Hennepin County Recorder' s Office
on or before March 27, 1983 together with a certified original copy
of this Resolution and executed copies of the documents noted above.
The approval granted by this Resolution shall expire if the
plat has not been filed by the date specified above. In that event,
it will be necessary to file a new application with the City of Orono
for subdivision review.

. regular meeting held on September 27 , 1982.
