RESOLUTION OF THE CITY COUNCIL

A RESOLUTION APPROVING THE RELEASE OF PART
OF THE CITY'S FLOWAGE EASEMENT OVER LOT 1, BLOCK 1,
FAZENDIN FOREST
WHEREAS, the owners of Lot 1, Block 1, Fazendin Forest
have requested that the flowage easement granted the City over the�ir
property be confined to the wetland area of their property; and
WHEREAS, said owners, Henry E. Neils and Eva R. Neils,
husband and wife , have agreed to grant the City a flowage easement
over the said wetlands subject to all the terms and conditions of the
previous flowage easement dated May 25, 197� .and filed for record
as Document No. 4497744 , Office of the Hennepin County Recorder• and
WHEREAS, said wetlands have been surveyed and certified to
lie within the West 415 feet of the North 625. feet of Lot 1, Block 1,
� Fazendin Forest; and
WHEREAS, the City Council agrees that this limitation of its
flowage easement would be appropriate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Orono and that the Mayor and City Administrator are hereby ,
. authorized to execute and deliver• a quit claim deed over that portion
of the wetlands described in the original flowage easement dated
May 25, 1.:979 upon the execution and delivery by Henry E. Neils and
Eva R. •Neils of a quit claim deed to the City over the wetlands
surveyed and legally described by Gordon• Coffin in his letter to the
: City dated, August 24, 1982. �
Adopted by the City Council of the City of Orono, Minnesota at a regular
meeting held September 13, 1982.
