" K ��-� �. . � NO. -�4�� . �' '� A RESOLUTION ORDERING ABATEMENT OF HAZARDOUS k � � m `� BUILDZNG ACTION AT 1290 SPRUCE PLACE �'' �''��' �� LEGALLY DESCRIBED HEREIN WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and ' WHEREAS,' James- Archer of 4917 York Avenue South, Minneapolis, Minnesota is the tax payer of record of the property located at 1290� Spruce Place, Ororio, hereinafter referred to as "the Archer property" , legally described as: . � - Lot 4, Block 10 Saga Hi11 Revised - - - WHEREAS,' the City Council of the City of Orono, having duly considered the matter pursuant to Minnesota. Statutes Sections 463. 15 to 463. 261 hereby finds that the above described Archer property is � unhabitable and contains unsanitary and hazardous conditions which constitute a p�blic nuisance and which makes this property hazardous to the public health and safety as follows: _� . _ , :'-�--; . , 1) Municipal sanitary sewer is provided for the property, and according to the records is not hooked up to sewer. 2) Existing well on property is not in operating order - a new well would be needed. ':���3) There is no running water inside the building and -,�' plumbing fixtures have been vandalized and broken. . 4) Chimney is in state of deterioration and dilipatitation. 5) Door 'and windows are broken and lett open. 6) Deck is in state �of deterioration and dilapitation. 7) Porch is in state of deterioration and dilapitatiori. 8) Complete structure is in a state of deterioration. 9) Orders to repair or remove structure were issued by the Building Official on June 16, 1982. This order has not been complied with. . NOW, THEREFORE BE IT RESOLVED as follows: _�'`': Page 1 of 2 r' • � . ..:,:'.:�., . -�,_.�...,� . � c�t� o� oRONo , � _ � �£�� � � � ` ` RESOLUTION OF THE CITY COUNCIL ;.. . �� ` 4' � NO. + 1403 .. e °� a,- � �='� , :�.:.� . �' �� 1) That the City Council of the City of Orono, pursuant to the foregoing findings and in . accordance with Minnesota Statutes Sections . 463. 15 to 463. 261 hereby orders the owner (s) of the Archer property to raze and remove or repair the structure, on the property. The Council further orders that all personal property or fixtures that may unreasonably interfere with the razing be removed within 20 days of the service of this order, the City of �rono may remove and sell such personal property or fixtures at public � auction in accordance with law. "' 2) That the City Council of the City of Orono further orders that unless this corrective action is taken , or an answer is served upan the City of Orono and filed in the Office of Clerk of District Court of Hennepin County, Minnesota, within 20 days from the date of the service of this order, a motion for "�, �_, summary enforcement of this order �rill be made at . District Court of Hennepin County.. . 3) That the City Council of the City of Orono further orders that if the City is compelled to take correct�ve action herein all necessary costs expanded _. by the City will be assessed against the real esta•te , ' concerned and collected in accordance with Minnesota Statute, Section 463. 22. 4) That the City Council of O�ono hereby authorizes and directs the Mayor, City Clerk, City Administrator, City Attorney, and other officers and employees of the City to take such action, prepare, sign, and serve such papers as are necessary to comply with this order and to assess the cost thereof against the real estate described above for collection along with taxes. � • Adopted by the City Council this � day of �, 1982. —T + /� • C a✓ � � William B.
