Crooker, 3401 Upton Avenue North, Minneapolis, Minnesota is the fee owner of record of property located at 4100 North Shore Drive, Orono, hereinafter referred to as "the Crooker property" , legally described as: Lot 70, Highwood Lake Minnetonka WHEREAS, the City Council of the City of Orono, having duly considered the matter pursuant to Minnesota Statutes Sections 463. 15 to 463 . 261, hereby finds that the above described Crooker property is unhabitable and contains unsanitary and haza�dous conditions which constitute a public nuisance and which makes this property hazardous .��:o the public health and safety as follows: ' 1) Municipal sanitary sewer is provided for the Crooker property, building is not hooked up to sewer and no plumbing is inside the structure.. Outhouse on rear of lot was used. 2) There is�=no running water in the structure. Municipal water is not available to the Crooker property and there is no well located on the property. 3) vo electrical service in buildinq. 4) There are no footings or a foundation under the structure. Structure is sitting on concrete blocks. 5) Structure was damaged by fire on December 28, 1981. Roof, walls and whole interior was destroyed by the fire. 6) Structure is in state of deterioration and dilapitation. 7) Orders to remove structure were issued by the Building Official on December 31, 1981, and again on July 13, 1982. Neither order has been complied with. �._.." NOW, THEREFORE BE IT RESOLVED as follows: Page 1 of 2 � �$`� 3�-� Cit o� ORONO . . �. �� , � �. ,�::. , .,. — ,T r�,� ,:� a`:' J �. � RESOLUTION OF THE CITY COUNCIL ���r NO. 1402 S. 4 h ya� � '.�, °f. �•.� o :� ..A`_ .._ , „_,-, . ` 1) That the City Council of the City of Orono, pursuant to� the foregoing findings and in accordance with Minnesota Statutes Sections 463. 15 to 463. 261 hereby orders the owner (s) . of the Crooker property to raze and remove the structures, on the property. The Council further orders that all personal property or �fixtures that may unreasonably interfere with the ; razing be removed within 20 days of the service of this order, the City of Orono may remove and sell such personal property or fixtures at public �auction in accordance with law. ' � ; , 2) That the City Council of the City of Orono further orders that unless this corrective action is taken or an answer is served upon the City of Orono and filed in the Office of Clerk of Di:strict Court of Hennepin County, Minnesota, within 20 days from the date of the service of this order, a motion for ,. �,-� summary enforcement of this order will be made at , � District Court of Hennepin County. . 3) That the City Council of the City of Orono further � orders that if the City is compelled to take corrective action herein all necessary costs expanded b.y.., the City will. be assessed against the real estate :-�> concerned and collected in accordance with Minnesota " Statute, Section 463. 22. 4) That the City Council of O�ono hereby authorizes and directs the Mayor, City C1erk, City Administrator, City Attorney, and other officers and employees of the City to take such action, prepare, sign, and serve such papers as are necessary to comply. with this order and to assess the cost thereof against the real estate described above for collection along with taxes . � Adopted by the City Council this � day of � , 1982. , � i A-.'
