A RESOLUTION APPROVING THE
PLAT OF UNDERHILL FARMS SECOND ADDITION
FILE NO. O1-2704
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of land within the City; and
WHEREAS, the City Council has considered the application for a subdivision of
property legally described Lot 3,Block 1,Underhill Farms to be platted as a two lot plat by Thomas
H. Graham and Jennifer J. Graham (hereinafter "the subdividers") and legally described as Lots 1
� and 2, Block 1. Underhill Farms Second Addition; and �
WHEREAS, the subdivision has been found to meet all standards of the RR-1B,
Rural Residential Zoning District finding that each lot is of a size and configuration that would allow
its use for a single family residence to be fully developed without the need of any variances other
than those granted herein; and
WHEREAS, the subdivider has completed all requirements of the platting
regulations of the City, including: �
1. Completion of all the requirements of Resolution No. 4506,the resolution granting
preliminary approval of the subdivision.
2. Dedication on the plat of standard perimeter drainage and utility easements.
3. Dedication of all property within 50' from the centerline of County Road 6 as right
of way.
4. Establishment of a private driveway and easement& maintenance agreement.

5. Subdividers have provided a restrictive covenant that would allow the accessory
building to remain on Lot 1 for a period of 12 months from the time Lots 1 and 2 are
no longer in common ownership or until such time a principal building is constructed
on the property if within one year of the sale of Lot 1 separate from Lot 2.
6. Payment to the City of a park dedication fee for 1 (one) new lot in the amount of
$5,300.
7. Payment to the City for the final plat review fee and fee for legal review and filing
of the plat, easements and covenants in the amount of$425.00.
8. Subdivider has submitted a Title Opinion, subject to approval by the City Attorney.
NOW, THEREFORE, BE IT RE$OLVED, that the City Council of the City of Orono
hereby approves the plat of Kokesh Farm, Hennepin County, Minnesota, subject to the following
• conditions:
1. Subdivider shall submit to the City of Orono final plat documents following approval
of said documents by Hennepin County.
2. A variance is hereby granted for Lot 1 to permit an accessory building to remain on
the lot without a principal building for a period of not longer than 12 months from
the time Lots 1 and 2 are no longer in common ownership.
3. Applicant shall provide all documents noted in this resolution and/or within
Resolution No. 4641 in a format acceptable to•the City Attorney prior to release of
the plat for filing.
4. The aforesaid plat shall be filed by the City of Orono with either the Hennepin
County Recorder's Office or Registrar of Titles Office on or before February 27,2002
' together with a certified original copy of this resolution and executed copies of the
� easements, deeds and covenants noted above.

The approval granted by this resolution shall expire if the plat has not been filed by the date
specified above. In that event, it will be necessary to file a new application with the City of Orono
for subdivision review. Dated this 27th day of August, 2001.
