HomeMy WebLinkAboutResolution 4655 7503065 O Ow CITY of ORONO 4 RESOLUTION OF THE CITY COUNCIL NO. 4 6 : � ESTrI� A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 10.25, SUBDIVISION 6 (B) FILE NO. #01-2675 WHEREAS, Donna Lile (hereinafter "the applicant") is owner of the property located at 2765 Ethel Avenue within the City of Orono (hereinafter "the City") and legally described as follows: Lot 7, Block 3, Casco Heights, Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on May 21, 2001, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the applicant applied to the City of Orono for variances to Municipal Zoning Code Section 10.2.5, Subdivision 6(B) to permit a 1.6' encroachment into the required 15' setback to the south side property line adjacent to Casco Avenue to permit construction of a gabled dormer above the existing entrance of the house. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 401-2675. 2. The property is located in the LRA C (1/2 acre) One Family Lakeshore Residential Zoning District. 3. The Orono Planning Commission reviewed this application on May 21, 2001 and recommended approval on a vote of 4 to 0 for variances based upon the following findings and hardships: A. Variances were granted, in 1969, to lot area and lot width to permit the existing house to be built in its current location. Page 1 of 4 / 0 0 CITY of ORONO RESOLUTION OF THE CITY COUNCIL �t�kE 0 NO. 4655 B. The applicant is proposing to only replace a deteriorating porch and add a gabled dormer above it. The porch has deteriorated over the years and has become a safety hazard. The dormer is to be added above the porch and provide cover from inclement weather. C. The dormer is decorative and will not add additional living space to the residence. D. The property is located within the 500-1000' hardcover setback zone. The expansion of the roofline will not increase hardcover. Also, structural lot coverage will not increase with the roofline expansion. E. The front door of the residence needs steps/porch for entry/exit. The dormer addition will keep the steps from becoming a safety hazard by directing roof runoff to the sides. 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. '4 6 5 r> �kESH0 CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to Municipal Zoning Code Section 10.25, Subdivision 6(B) to permit a 1.6' encroachment into the required 15' setback to the south side property line adjacent to Casco Avenue to permit construction of a gabled dormer above the existing entrance of the house., subject to the following conditions: 1. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (May 29, 2002). 2. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 3. The undersigned applicant has read, understand and hereby agrees to the terms of this resolution and on behalf of herself, her heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property.
