Variance approval is limited to the extent shown on approved plan and as noted in the
approval resolution. Changes in approved plans are subject to further review by the City.
Variance approval expires one year after date of approval. Permit application must be submitted

Mr. and Mrs. Stinson were present.
Mabusth explained that applicant is proposing a principle structure addition to the lakeside of the
residence along with a deck reconstruction adjacent to that addition. She explained further that the
greatest concern is that this addition of the principle structure extending into the average Iakeshore
setback could allow neighboring structures to expand lakeward without need of variances. Structure
does meet the 75' setback however.
Hurr asked why there is no date or signature on the survey provided and questions whether Council
should use and depend on this survey.
Mr. Stinson stated that this was the survey the building inspector provided to him.
Kelley stated he would like to know from the applicant in writing what the hardship is.
Hurr stated she would like to know if there were any stipulations added at the time the deck was
installed.
It was moved by Kelley, seconded by Callahan, to send application back to the Planning Commission
and have the applicants present the revised proposal and updated survey and state their hardships.

Mrs. McKinney and her daughter, Gayle Siegler were present.
Mabusth explained that applicant is applying for a conditional use permit to allow the continuation of
a nonconforming duplex use. She went on to explain that Planning Commission members viewed the
property and felt it appeared to fit in with neighboring residences. The Planning Commission also
questioned whether the City could legally not approve the Conditional Use Permit. There was no
deadline for applying for a conditional use permit to allow the continuation of a nonconforming use in
the code.
Hurr asked when the property was sewered.
Mabusth stated it was sewered sometime in the early 1960's.
Mayor Callahan asked if the City can enforce the owner-occupancy status of the property.
City Attorney Staunton stated that he would have to review the information.
There was discussion regarding the various possible off-street parking spaces in addition to the two-
stall garage and where they could be placed.
It was moved by Kelley, seconded by Jabbour to table action until the City Attorney can review the
case and determine whether the City can enforce the owner-occupied status. Ayes 4, Nays 1. Hurr
voted nay, stating that she feels the use should be allowed because there was no deadline required in
which residents had to apply.

Mabusth explained that applicant seeks approval to permit installation of a new foundation under an
existing detached garage require side and street setbacks and hardcover variance. The proposal will
reduce the already excessive structural lot coverage on the property. Planning commission
recommended approval.
Hurr expressed concern about inadequate documentation in that the survey does not show all
improvements.
It was moved by Hurr, seconded by Kelley, to adopt Resolution #3339 for applicant Jeffrey S. Leech,
720 North Arm Drive for setback, hardcover and lot coverage variances to permit the installation of a
new foundation beneath the existing detached garage. Ayes 5, Nays 0.

A RESOLUTION GRANTING A VARIANCE
TO MUNICIPAL ZONING CODE
SECTION 10.03, SUBDIVISION 9 (B)
FILE NO. 1859
WHEREAS, Jeffrey D. Mueller (hereinafter "the applicant") is the owner of the
property located at 222 Bederwood Drive within the City of Orono and legally described as
follows:
Lots 30 and 33, and Lot 35 except the north 6' thereof, Auditor's Subdivision
No. 203, Hennepin County, Minnesota (hereinafter "the property"); and
WHEREAS, the applicant has applied to the City for a variance to Municipal
Zoning Code Section 10.03, Subdivision 9 (B) to permit the total reconstruction of a detached
garage to be placed in front of the front line of the principal structure on the property where the
code would require that the structure be placed at or behind the front line of the principal
structure.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, -
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #1859.
2. The property is located in the LR-lA Lakeshore Residential Zoning District
requiring two acres in area. The property consists of approximately 37,794 s.f.
or . 79 acre in area.
3. The Orono Planning Commission reviewed this application on September 20,
1993 and recommended approval of the proposed variance based upon the
following hardships and unique findings:
A. The existing house is located to the rear of the long, narrow lot.
B. The elevations to the east of the property are steeper and to relocate a
garage to the rear would require major land alterations and result in an
increase in hardcover.

C. Placement of the garage within the hill minimizes the impact of the
structure within the street yard.
D. The City has received no negative comments from adjacent property
owners.
4. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial property
right of the applicant; and would be in keeping with the spirit and intent of the
Zoning Code and Comprehensive Plan of the City.
5. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicant and the effect of the proposed variance on the health, safety and
welfare of the community.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the findings noted above, the Orono City Council
hereby grants a variance to Municipal Zoning Code Section 10.03, Subdivision 9 (B) to permit
the reconstruction of a detached garage within the street yard of the property to be placed in
front of the front line of the residence structure where no such encroachment is allowed, subject
to the following conditions:
1. Prior to City issuing a building permit for construction, applicant shall apply for
the legal combination of Lot 30, Lot 33 and Lot 35 except the north 6 feet
thereof, Auditor's Subdivision No. 203, Hennepin County, Minnesota.
2. Authorities granted by this variance run with the property not with the applicant,
but are permissive only and must be exercised by application for a building
permit within one year of the date of Council approval, or this variance will
expire on that date (October 11, 1994).

3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
4. The undersigned applicant has read, understood and hereby agrees to the terms
of this resolution and on behalf of himself, his heirs, successors and assigns,
hereby agrees to the recording of this resolution in the Chain of Title of the
property.
Adopted by the City Council of the City of Orono, Minnesota at a regular meeting
held on the 11th day of October, 1993.

accessory structure IS 4,800 s.f. mstead of the allowable 3,000 s.f. Smith added that if the
property was ever subdivided, the owner would take responsibility for those structures. Also
required is the updated survey, and the understanding that maximum allowable horses on this

Mabusth explained that the applicant seeks approval of a setback variance that would allow
an accessory structure to be placed in the front of the front line of the principle structure. The
structure will also require a side setback variance. The improvement involves a complete
replacement of the detached garage within the street yard of the property. It will be built within
the current building envelope.
Mabusth asked the applicant whether he could move the structure over enough to meet the side
setback.
Mr. Mueller agreed that he could do that.
It was moved by Rowlette, seconded by Berg, to recommend approval of application #1859
for Jeffrey H. Mueller, 222 Bederwood Drive for accessory structure built in front of the front

HEARING
Mrs. McKinney was present and accompanied by her daughter, Gayle Siegler.
Mabusth explained that property is located in Navarre Heights on Livingston street. Mrs.
McKinney purchased the property in May, 1962 when triplex use would have been permitted.
It was always used as a rental property. There have been zoning amendments since whereby
only single family residential use would be allowed. Mrs. McKinney is applying for a
conditional use permit per Section 31.100 of the 1975 Code. Mrs. McKinney seeks approval
of two residential units; one to be owner-occupied and the other a rental apartment. The
majority of neighbors that called were satisfied to hear that the property would be owner-
occupied duplex and ·only one neighbor pref erred to see the property revert to single family
dwelling status.
Commission members felt the property was visually appealing and if the property did revert ·
to single family, the exterior of the structure would not be altered in anyway.

Brief Review of Application
Applicant proposes the total replacement of a detached garage located within the street
yard requiring side setback variance and a variance that would allow the accessory structure to
be placed in front of the front line of the existing residence. As new structure is to be installed
requiring foundation and retaining wall, applicant was asked if structure could be moved
approximately 1 ½' so that structure could meet the required 10' side yard setback. Applicant
concurred that he would be able to complete the realignment and satisfy the code.
The Planning Commission adopted the hardship noted by applicant and as set forth in the
staff memo and recommended unanimous approval of the one remaining variance that would
allow the structure to be placed in front of the existing residence. The enclosed approval
resolution has been drafted for Council's review and action.

Description of Request
Applicant seeks setback variances for the reconstruction of a 24 'x30' garage located
within street yard. Garage is in a serious state of disrepair and in need of replacement. The
City has received no comments from adjacent neighbors. Structural improvements are at 7.8%
and hardcover is conforming. As already noted above, the 500 s.f. of neighbor's shed has been
credited against applicant's hardcover. Review Exhibits E and F, the structure will once again
be relocated within the hill minimizing visual impact of structure. Roof will be at a 4-12 pitch
at a maximum peak height of 12'. Structure will not exceed the height of the existing principal
structure.

CITY OF ORONO -NOTICE
The Planning Commission will hold public hearings in the Council Chambers at 2780 Kelley
Parkway on Monday, September 23, 1993 for the purpose of reviewing the following land use
applications:
1. #1854 Troy Anderson of 1490 Long Lake Boulevard, seeks approval of side and rear
setback variances for an attached 2-stall garage addition.
2. #1855 Paul E . Bowman of 3458 North Shore Drive, seeks approval of a side setback
variance to allow the installation of second floor over the existing single story residence .
3. #1856 Mark & Jenny Prueter of 3215 Crystal Bay Road, seeks approval of a height ,
average lakeshore setback, rear and side setback variances and hardcover variances for
a rear addition to the existing residence and the installation of a third story where only
two and half stories are allowed within the residential zoning district. The final structure
will not exceed the allowed building height of 30'.
4. #1857 James L. Stinson of2623 Casco Point Road seeks approval of hardcover and side
· setback variances for a proposed 12x18' addition to the lakeside of the residence and an .
adjacent 12x21' deck.
5 , #1858 John & Marla Meridith of 3685 Watertown Road, seek approval of an area
variance for an indoor riding arena at 4800 s.f., considered an oversized accessory .
structure where the code will allow only a 3000 s.f. structure. The applicants also seek
approval for an area variance to the . total allowed area for accessory structures on a
property that exceeds 9 acres in area.
6. #1859 Jeffrey D. Mueller of 222 Bederwood Drive , seeks approval of a side setback
variance and a variance that would allow a detached structure to be located in front of
the principal structure in the street yard. The new garage will replace an existing garage.
7 . #1860 Zelma H. McKinney, 3599 Livingston Avenue has applied for a Conditional Use
Permit that would allow the continued use of the residence as a duplex, where only single
family residential use is allowed. The rental use of the property has existed prior to the
current zoning and is considered a non-conforming use.
8. #1861 Jeffrey S. Leech of 720 North Arm Drive seeks approval of hardcover, front ,
and side setback variances to allow the installation of a new foundation for an existing
garage located within the street yard of a lakeshore property.
9. #1863 Robert G . Luesse of 3249 Casco Circle has filed an amended variance application
seeking approval of a garage addition that would be located 2 '4" from the side lot line
rather than 3' as originally proposed to the City .
10. #1864 Irwin Jacobs the owner of 1700 Shoreline Drive applied for a Conditional Use
Permit to allow the construction of a caretakers residence at his residential property.
11. #1865 David Owen of 2248 Shadywood Road seeks approval of side and street setback
variances to allow structural repairs to an existing garage located within the street yard
of the lakeshore property.
12. James & Joann Jundt the current owners of 1400 Bracketts Point Road have applied for
the following land use applications:
a. #1866 Applicants seek approval of a Conditional Use permit for a caretaker
apartment within the existing residence structure.
b. #1867 The applicants have applied for lakeshore setback and hardcover
variances to allow a second access stairs to the lake where only one stair structure
is allowed.
c. #1868 Applicants have filed a Conditional Use Permit to allow a guest house
use to continue on the residential property.
13. #1870 Stephen & Randi Carlson of 1185 Arbor Street seek approval a front/street setback
variance for a 1 0x24' addition to the existing garage to the north side of the residence.
14. #1871 Taylor/Lauer Homes seek approval of an average lakeshore setback and hardcover
variances within the 75-250' setback area for living room, screen porch, and garage
additions to the existing residence located at 1725 Bohns Point Road.
15. #1873 Jack Edwards of 1340 Rest Point Circle seeks approval of hardcover and street
setback variances for additions to the existing garage located within the street yard of the
lakeshore property.

RIGHTS OF SU&JECTS OF DATA
Subdivision L Type of data.. The rights of individuals on whom the data is
stored or to be stored shall be as set forth in this section.
Subd. 2. Information required to be given individua.L An. individual .asked to
· supply private or confidential data concerning himself shall be informed of: (a) the
purpose and intended use of the requested data within the collecting state agency,
political subdivision, or statewide system; (b) whether he may refuse or is legally
required to supply the requested data; (c) any known consequence a.rising from his
supplying or refusing to supply private or confidential data; and (d) the identity of
other persons or entities authorized by state or federal law to receive the data. This_
requirement shall not apply when an individual is asked to supply investigative data,
pursua.p.t to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue ma olace the notice re uired under this
subdivision in the individual income tax or orooerty tax re und instructions instead 01
on those forms. ·
-Subd. 3. ---Access to data by--individual. Upon request to a responsible
authority, an individual shall be informed whether he is the subject of stored data on
individuals; and whether it is classified .a.s public, private or confidential. Upon his
. further request, an individual who is the subject of stored private or public data on
individuals shall be shown the data without any charge to him and, if he desires, shall
Se informed of the content and meaning of that data. After an individual has been
shown the private data and informed of its meaning, the data need not be disclosed to
him for six months thereafter unless a dispute or action pursuant to this section is
pending or additional data on the individual has been collected or created. The
responsible authority shall provide copies of the private or public data upon request by
the individual subject of the data. The responsible authority may require the
requesting person to pay the actual c~sts of making, certifying, and compiling the
cooies.
~ The responsible authority shall comply immediately, if possible, with any request
made pursuant to this subdivision, or within five clays of the date of the request,
excluding Saturdays, Sundays and leg-al holidays, if -immediate compliance is not
possible. If he cannot comply with the request within that time, he shall so inform the
individual, and may have an additional five days within which to comply with the
request, excluding Saturdays, Sundays and legal holidays. ---
Subd. 4. Procedure when data is not accurate or eomplete. An individual may
contest the accuracy or completeness ·of public or private data concerning himself. To
exercise this right, an individual shall notify in writing the responsi.ble authority
describing the nature of the disagreement. The responsible authority shall within 30
days either: (a) correct the data found to be inaccurate or incomplete and attempt to
notify past recipients of inaccurate or incomplete data, including recipients named by
the individual; or (b) notify the individual that he believes the data to be correct.
Data in dispute sh.all be disclosed only if the individual's statement of disagreement is
included with the disclosed data.
_ The determination of the responsible authority may be appealed pursuant to the
provisions ~f the ad.-ninistrative procedure act relating to contested cases. . •
