The following documents must be recorded in the order indicated below per the City Attorney Soren Mattick and prior to the sale and recording of the Doubek's mortgage. 1. RENNEBOHM and SHARON A. RENNEBOHM, husband and wife, by their Attorney-in-Fact, John B. Biglow (collectively, the "Owner"). RECITALS: A. Owner is the fee owner of the real property legally described as Lot 1 and Lot 2, Block 1, Bayside Berry Farm, Hennepin County, Minnesota (the "Property"). B. Each of the two (2) lots within the Prope1iy (each hereinafter a "Lot") has a primary and an alternate conforming septic system drain field site located thereon (the "Drain Field Sites") which locations have been approved by the City of Orono, Minnesota (the "City") and in connection with the development of the Property, the City requires that the Drain Field Sites be protected from inadvertent damage or destruction. NOW THEREFORE, in consideration of the foregoing, Owner hereby declares that in order to protect the Drain Field Sites, no Owner shall permit, and said Owner shall take such actions as are reasonably necessary to prevent others from, driving, placing or parking any cars, trucks, or earth moving equipment on the Drain Field Sites located on such Owner's Lots. Additionally, no Owner shall construct any driveway, erect any building, or permit any earth moving equipment on the Owner's Lot without first: 179314v4 1. During construction, erecting a clearly visible fence around the Lot's Drain Field Sites which shall be placed at least twenty (20) feet from the boundary of the Lot's Drain Field Sites to act as a buffer for protection of the Lot's Drain Field Sites from earth moving activities and equipment; and 1 2. Erecting a clearly visible fence during construction along that part of the Owner's lot line that is between an adjacent owner's sewage treatment site and the areas on the Owner's lot which are accessible to earth moving equipment. This Declaration shall run with the Property, shall be binding upon Owner, their respective heirs, successors and assigns, and may be terminated only upon written agreement with the City of Orono. Creation and maintenance of non-hardcover walking paths may be allowed. B. Cutting, mowing or removing shrubs or other vegetation, and cutting, destroying or removing trees greater than four inches in diameter, except for tree disease control by or as directed by a governmental agency and except by special permit for maintenance; as a part of an approved vegetation management plan; and, to maintain, repair and reconstruct any stormwater ponds and facilities within the Easement Premises. Grantor may remove brush, diseased or dead trees of any size, buckthom and noxious weeds. C. Excavation or :filling or material alteration of grade, including changes to the size, depth or contour of the wetland; dredging, mining or removal of earth, loam, peat, gravel, soil or any other natural material. D. Free roaming of domestic animals (i.e. horses, sheep, chickens, etc.). E. The deposit of waste, yard waste, or debris. F. Activity detrimental to the screening of the neighboring properties. G. Application of fertilizers, whether natural or chemical. H. Application of chemicals for the destruction or retardation of vegetation. I. The application of herbicides, pesticides, and insecticides, except for noxious weed control by or as directed by a govermnental agency. J. Outside storage of any kind. K. Activity detrimental to the preservation of the scenic beauty, vegetation, and wildlife. Rights of the City. Grantors, their heirs, successors and assigns, further grant to the City the affirmative right, but not the obligation, to do the following on the Easement Premises: A. Preserve, improve, and enhance the slope, trees, vegetation, and natural habitat by altering, clearing, and removing trees or other vegetation, by changing the contour of the land, and by planting trees or other vegetation. B. Enter upon the Easement Premises at any time to enforce compliance with the terms of this Agreement. Reservation of Rights of Grantors. Gran.tors reserve for themselves and for their heirs, successors and assigns and their invitees, the right to enter upon the Easement Premises 2 4. 5. 6. 7. 8. and to do and perform on the Easement Premises such acts as are not inconsistent with the easement rights granted to the City herein. Such uses shall be deemed to include, but not be limited to planting of trees, flowers, and other vegetation consistent with a conservation easement; walking along trails and paths; bird watching; the study of nature; and all other acts of a similar nature or purpose. Grant of Flo wage Easement. Granters hereby grant, gift, quit claim and convey to the City a perpetual flowage easement and right and privilege to trespass with water over and upon any or all of the Easement Premises. Release. Grantors hereby remiss, release, acquit and forever discharge, forever, the City and any and all of its officers and employees of and from any and all claims, demands or causes of action of any kind or nature whatsoever which may arise or accrue by virtue of any flowage or trespass with water over and upon any or all of the Easement Premises within the terms of this Agreement. No Implied Easement. None of the Easement Premises shall be implied to include the drainage and utility easements as dedicated on the plat of Bayside Berry Farm, Hennepin County, Minnesota (the "Plat"). The Easement Premises shall only include the area depicted on the Plat as the "Drainage Easement:' No Public Interest. Nothing contained herein or the dedication in the Plat shall be construed as creating any use rights in the general public or as dedicating for public use any portion of the Easement Premises, except as expressly described in this Agreement. Amendment. This Agreement may be amended only by an instrument signed by the City and the Grantors, or its respective heirs, successors and assigns in interest to the Easement Premises. C" C: -· ---· )> 0 ::, Council Exhibit D CITY OF ORONO RESOLUTION OF THE CITY COUNCIL 6462 NO. _________ _ A RESOLUTION APPROVING A PRELIMINARY PLAT FILE NO. 14-3694 WHEREAS, Peter Rennebohm and Sharon Rennebohm, a married couple (hereinafter the "Developers") are the owners of the property within the City of Orono (hereinafter the "City") addressed 4565 Bayside Road and legally described as The Northwest Quarter of the Northeast Quarter of the Northwest Quarter of Section 6, Township 117 North, Range 23 West of the 5th Principal Meridian, Hennepin County, Minnesota (hereinafter the "Property"); and WHEREAS, .on September 17, 2014, the Developers filed a complete application with the City for preliminary approval of a two (2) lot residential plat of the Property; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, on October 20, 2014 the Orono Planning Commission held a public hearing regarding the application at which time all persons desiring to be heard concerning the application were given the opportunity to speak thereon; and WHEREAS, on October 20, 2014 the Planning Commission reviewed the application and recommended on a vote of 7 to O that the City Council grant preliminary plat approval; and WHEREAS, the City Council reviewed the proposal at a regular meeting held on November 10, 2014, and hereby makes the following findings with regards to this application: FINDINGS 1. This application was reviewed as Zoning File #14-3694. 2. The Property is zoned RR-1 B Single Family Rural Residential District, which requires a minimum lot area of 2.0 acres and minimum lot width of200'. The Property totals 10.17 acres in area of which 9.07 acres is considered as dry, buildable land and 0.59 acres is wetland; 0.51 acres is proposed to be dedicated as right-of-way. 3. The Property is guided in the 2008-2030 Orono Community Management Plan (CMP) for single family residential use at a density of 1 unit per 2 acres. The proposed layout contains 2 residential lots on 9.07 non-wetland acres, for an overall density of 1 unit per 4.5 dry acres (0.22 units per acre). The proposed plat includes 2 residential building lots, each of which will be accessed via private driveways extending southerly from Bayside Road (a.k.a. CSAH 84). Lot 2 will utilize the existing driveway currently serving the Property and Lot 1 will construct a new driveway. 5. Proposed Lot 1 contains 2.24 dry buildable acres; and proposed Lot 2 contains 6.83 dry buildable acres. 6. Lot 1 is proposed to have 389 feet of frontage along the Bayside Road; and Lot 2 will have 278 feet of frontage along Bayside Road. Each proposed lot contains a building site which meets the RR-1 B setback requirements of 50' front and rear and 30' sides. 7. The proposed lots will be served by individual on-site sewage treatment systems and private wells. Each lot has been tested and shown to have primary and alternate conforming septic system drainfield sites. 8. Two delineated wetlands exist on the Property. One wetland straddles the lot line between Lot 1 and Lot 2 and the other is located in the northwest corner of Lot 2. Both wetlands will be subject to the standard wetland preservation requirements including granting of Wetland Flowage and Conservation Easements. 9. The Planning and Park Commissions recommended the Developer grant a 10-foot easement along Bayside Road for future trail purposes. A trail easement will be granted as part of the subdivision along the northerly 10 feet of the Property for potential future City trail construction. 10. Both proposed lots will contain suitable area meeting all established setback requirements to allow the construction of single family residences. CONCLUSIONS, ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby grants Preliminary Plat Approval for a 2-lot plat per the Preliminary Plat survey/drawing by Gronberg & Associates dated 11/04/14 and attached hereto as Exhibit A, subject to the following conditions: 1) The Preliminary Plat approval granted by this Resolution shall expire one year from the approval date (November 10, 2015). 2) Approval is subject to Minnehaha Creek Watershed District (MCWD) approval and permits as required. Final plat approval shall not be granted until the Developer has provided evidence that all required MCWD permits have been obtained. The development is subject to the standard Park Dedication Fee for 1 new lot x $5,550.00 per lot= $5,550. b) Storm Water and Drainage Trunk Fee. The development is subject to the standard Storm Water and Drainage Trunk Fee of $3,840 per acre x 2.57 total acres (Lot 1 only) = $9,868.80 (*Fee will be determined based on the current Fee Schedule at the time when the final plat application is made.) 5) Approval of the Final Plat is subject to compliance with the existing and ongoing recommendations of the City Engineer. 6) In order to facilitate preparation of the final documents, as soon as feasible, the Applicant shall submit to the City written legal descriptions for all required easements as noted herein. 7) Easements Required. a) Drainage and Utility Easements shall be dedicated to the public on the final plat 1 0' along all exterior property lines, and 5' either side of interior property lines, except such easements shall be increased to accommodate drainage where required, subject to City staff approval. b) A Wetland Flowage and Conservation Easement shall be granted over wetlands and wetland buffers on the Property. c) A Public Trail Easement shall be dedicated over the northerly 10 feet of the Property. Harris stated Staff really helped him understand and navigate through the complicated dual process of the wetland and floodplain regulations between the city and MCWD. Levang moved, Bremer seconded, to adopt RESOLUTION NO. 6461, a Resolution Granting Variances to Municipal Zoning Code Sections 78-305, 78-1279, and 78-1288, and a Conditional Use Permit Pursuant to Municipal Zoning Code Section 78-966, for the property located at 1165 Ferndale Road West. VOTE: Ayes 4, Nays 0. 8. #14-3694 PETER RENNEBOHM, 4565 BAYSIDE ROAD -PRELIMINARY PLAT- RESOLUTION NO. 6462 City Planner Curtis stated the applicant is requesting preliminary plat approval to create one new, 2-plus acre buildable lot from the original 10-plus acres. Both of the lots would be served by individual driveways onto Bayside Road as well as private septic systems and private wells. At the October meeting, the Planning Commission voted 7 to Oto recommend approval of the preliminary plat as proposed contingent upon the Consulting City Engineer's approval of the revised plans, consistent with what Staff recommends, and with the following conditions: 1. Dedication of a 10-foot wide trail easement along Bayside Road overlapping/within the to be dedicated perimeter drainage and utility easement; and 2. Submittal of a conservation design report and proposed conservation easement areas. The applicants have requested the Council to consider a reduction in the required payment of the Stormwater Drainage Trunk Fee. They would like the Council to consider payment based only on the acreage of the new two-plus acre lot to be split off of the original property. Their rationale for this reduction is that the original property can be subdivided further in the future and additional stormwater drainage trunk fees could be collected at that time. The Council should consider the applicant's request regarding the payment of storm water drainage trunk fees and direct Staff accordingly. The applicants have submitted an abbreviated conservation design plan which addresses some areas for tree preservation as well as identifies invasive buckthom which may be removed. The conservation design plan has been reviewed and the City Engineer has provided comments. Staff finds that the lessened level of detail submitted within the conservation design plan may be appropriate considering the uniqueness of the property, the density of the subdivision, and the fact that the property owners have planted approximately 5,000 trees on the property over the past 20 years. Staff recommends approval of the preliminary plat according to the draft resolution. John Bigelow stated he is Peter Rennebohm's son-in-law, and that he would like to address the Council briefly on the stormwater and drainage trunk fees. Code 82-47 refers to the stormwater drainage and trunk fees schedule, and in there it talks about a new development or a redevelopment of an existing parcel, but it also talks about the use of land . Bigelow stated he has heard that Orono's policy is to set the fees based on the entire parcel or both parcels in a subdivision. Bigelow stated in this case there is a 10-acre parcel where a 2-acre parcel is being carved off, and that in his view the new development that is likely to occur here will just be on the 2-acre parcel. The existing eight acres will still continue to be a single parcel and continue to have a single-family home on it. No new development will occur on that 8-acre parcel. Bigelow stated their position is that it would be more fair and appropriate to use the two acres as the parcel for determining the fees . In addition, the 8-acre parcel really is subject to potential subdivision in the future and it would be more appropriate for the City to then assess or impose the fees on any subdivisions in the future. Bigelow stated he also had a chance to review the Riley subdivision located at 3405 High Lane, Plat Resolution No. 6140, which was approved in 2012. Bigelow stated the reason he is bringing that up is the subdivision is very similar to this scenario. In the Riley subdivision, they had nine acres and were carving off two acres. The Rileys also argued the point that the fees should be reduced and that they should be treated somewhat differently than other subdivisions because of the uniqueness of the property and the fact that this single-family home will not create any environmental impact to the property. They also argued that the City could impose the fees at the time the larger parcel was further subdivided . Bigelow stated in the Riley decision, the City Council correctly moved for a reduction in fee , and that he would ask that the Council take that into consideration and use that as rational for granting a reduction in this situation. Bigelow noted the Rennebohms have been Orono residents for the last 42 years plus. The Rennebohms are not professional developers and that it would be fair for the Council to calculate the fees based on the two acres. The Council also heard reference to the amount of trees planted on the property. Approximately 5,000 trees have been planted on the property, which helps demonstrate that they have been good stewards of the property. Peter Rennebohm, Applicant, stated the property originally was an alfalfa field at the time they purchased the property in 1989 . Their vision at the time was to reforest it with seedlings from the DNR, and over the years approximately 5 ,000 trees have been planted, with approximately half of those trees surviving. Rennebohm indicated he also had tree movers come in and move them about the property once they became bigger. Rennebohm stated it has been his vision, desire, and love to preserve what is there and to create an environment for wildlife and birds. Rennebohm stated it is his hope that the next owners would maintain that vision. Levang stated she remembers buying apples from them for a number of years and that she misses that. Levang asked what the real possibility is of another lot being carved out of the 8-acre parcel. Levang stated when she looks at the septic requirements; it appears to be pretty difficult. Levang asked if Hennepin County is saying no to the driveway situation. Curtis stated Hennepin County has recommended they share a driveway. Staff has requested Hennepin County clarify that but they have not at this point. Curtis indicated it would be Staff's preference that if Hennepin County was going to deny it, that they would specifically say that. Levang asked if Hennepin County insists on a shared driveway whether Staff would be amenable to that. Curtis indicated Staff would want to take a look at that to see how the other lot would be served. Curtis asked whether they would require an outlot. Gaffron stated it would just be an easement situation and that the plat would not need to be changed. McMillan noted the location of any additional septic sites would be further limited by a shared driveway. Mack noted the wetland buffer regulations would also present another challenge and substantially limit the potential number of additional new lots , if ever, in the future. McMillan stated in addition to the stormwater fee , the other issue is whether the conservation areas make sense. McMillan stated the City has gone back and forth with small conservation easements and that she does not see it as a necessity to make it a conservation easement given the smaller size of it. McMillan stated if the applicants still want to have it in a conservation easement with a signed agreement that would be fine. Bigelow stated he would be in agreement that the proposed conservation easement would not be necessary given the amount of trees that have been planted . Rennebohm stated he also would prefer not to do that. Levang asked if they will be doing any buckthom removal. Rennebohm noted there was one large oak tree that came down and that is when the invasive species started taking over. Rennebohm indicated there is no buckthom over in the southeast comer. Levang asked if the adjacent land has some conservation easements and if that is where they meet in the comer. Curtis stated Bayside Meadows is kind of a rectangular parcel and there are conservation easements all around the perimeter and the wetland area. McMillan noted the applicants are not talking about totally carving up the property and are merely splitting off one lot. McMillan stated this type of situation might have been overlooked at the time the language was created. Gaffron indicated it is similar to the Riley application and that the applicants will be leaving the major portion of the property with the existing house intact. Gaffron indicated Staff did discuss this in a work session and that Staff hopes to have time over the winter to bring in some revisions to the code . Mattick stated in this particular instance there is an existing home and this subdivision is creating a new two-acre lot. Mattick stated in the scenario where two new homes were being constructed , the City would not waive that fee. VOTE: Ayes 4, Nays 0. 9. #14-3695 DAVID FOX, 1095 FERNDALE ROAD WEST -VARIANCE RENEWAL - RESOLUTION NO. 6463 Community Development Director Mack stated the property is located at 1095 Ferndale Road and the applicant is requesting renewal of variances and a conditional use permit originally grated in 2009 and then renewed in 2011 . Those approvals allowed the construction of a replacement residence , a conditional use permit to rearrange the floodplain on the property, and variances for lot area and width, lakeshore setback, average lakeshore setback, floodplain setback, and hardcover in the 0-75 foot zone . That work was never started and the Council is basically being asked for renewal of those variances and conditional use permit. A wetland delineation was conducted by Svoboda Ecological Services on September 13 111, 2014. Two wetlands were delineated on site. Wetland 1 was classified as a Type 2 Wet Meadow. Wetland 2 was classified as a Type 2 Wet Meadow. MCWD staff conducted a site visit to review the wetland bounda1y on October 20, 2014. Due to presence of upland vegetation and a topographic break within the area delineated as Wetland 1, the boundary was adjusted. Svoboda Ecological Services sent an updated map that shows the adjusted bounda1y (attached). MCWD was in agreement with the boundary flagged as Wetland 2 in the field. Wetland 2 is drained by a ravine that is displayed on the attached map. MCWD approves the wetland boundary as documented in the updated Figure 5 (attached) and wetland type that was documented in the delineation repmt. This decision is valid for five years. A future project located on this property may require a permit from the MCWD.
