PERivIIT PER SECTION 10.40,SUBDIVISION 4

`VHEREAS, John Collette, has an interest in, (hereinafter "the applicant") and �
William Weaz is owner of the property (hereinafter "the owner") located at 2160 West Wayzata .
Boulevard within the City of Orono (hereinafter"the City") and legally described as follows:
� Exhibit"A"attached,Hennepin County,Minnesota(hereinafter"the property"};and�
WHEREAS,the applicants have applied for a conditional use permit per Municipal
Zoning Code Section� 10.40, Subdivision 4 to permit a general office use of 208 s.f. within the
building for administrative purposes for an automobile brokerage company; and

• `VHEREAS, after due published notice and mailed notice in accordance with � .
- Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning .
Gommission held a public hearing on March 18,2002,at which time all persons desiring to be heard
concemtng this application were given the opportunity to speak thereon. � � .
NO`V, THEREFORE, BE IT RESOLVED by the City Council of Orono,

FINDINGS� .
1. This application was reviewed as Zoning File#02-2759.
2. The property is located in the B-1,Retail Sales Business District.
3. The Orono Planning Commission reviewed this application on March 18,2002 and
recommended approval by a vote of 7 to 0. �
4. The PlanninQ Commission made the followin findinas of fact:

1. At no tir�ne shall any vehicles being brokered be stored, displayed, serviced,
serviced, or parked on the property. �
2. Any future signs identifying the automobile brokerage shall be in conformance •
with the provisions of the zoning code and by the pravisions set forth by the � .
approved si�a?e plan for the property. �
: 3. Any requests to expand the use of the building for the brokerage business shall
require an application to amend the conditional use permit.
. 4. Authorities granted by the conditional use permit run with the property not with the
. applicants. �
5. Violation of or non-compliance with any of the terms and conditions of the
. conditional use permit approval shall constitute a violation of the zoning code,shall
• automatically terminate any authority granted herein, and shall be punishable as a � .�
� misdemeanor.
6. The undersigned owner and applicant have read,understand and hereby agree to the
terms of this resolution and on behalf of themselves, their heirs, successors and
assigns,hereby agree to the recording of this resolution in the Chain of Title of the
