RESOLUTION OF THE CITY COUNCIL
NO. 2740
A RESOLUTION VACATING
UNUSED PORTIONS OF DEDICATED
DRAINAGE EASEMENTS AT
725 OLD CRYSTAL BAY ROAD SOUTH
WITHIN THE PLAT OF FARVINN,
SECTION 04, TOWNSHIP 117, RANGE 23,
IN THE CITY OF ORONO, MINNESOTA
FILE NO. 1480
WHEREAS, the y of Orono is a municipal corpo:-ation
organized and existing under the laws of the State of Minnesota;
and
Y'HEREAS, on October 27, 1989, Ed and Gertz. Toth filed a
petition w:: th the City of Orono reque ting the vacation of
portions of drainage easements originF.Ily dedicated within the
plat of FARVIEW, said portions to be vacated being legally
described as follows:
The west 40' of the east 50' of the south 190' of the north
200' of Lot 12, Block 1, FARVIEW, according to the recorded
plat thereof, Hennepin County, Minnesota. Also:
That poilion of drainage easement within Lot 12, Block 1,
FARVIEW, lying west of the east 100' and northerly of the
southerly 30' thereof.
WHEREAS, after due published and posted notice, a
public hearing was held before the Planning Commission on
November 20, 1989, regarding said vacation and all interested
persons were given an opportunity to be heard; and
WHEREAS, after due standing and consideration, the
Planning Commission voted to recommend approval of the requested
vacation and the Council of the City of Orono finds that said
vacation, as proposed, is in keepirq with the public interest in
consideration of the following findings:
1. The vacation does not affect access to or use of any
adjoining property.
2. The City has not and does not intend to develop,
improve cr use the portions of dedicated drainage easements
described above.
3. The portions of dedicated drainage easements as they
exist serve no public purpose.

NOW, THEREFORE BE IT RESOLVED, t: at the petition of Ed
and Gerta Toth is hereby granted by the Council of the City of
Orono and that the portions of dedicated drainage easements
legally described above are hereby vacated. The granting of the
petition is subject to the following condition:
1. Prior to filing of this vacation approval resolution
with Hennepin County, the property owners shall grant to the
City new drainage and drainage and utilitl easements as
shown on the attached Exhibit A.
Adopted by the City Council of Orono, Minnesota at a
regular meeting held on this llth day.of December, 1989.
