DRAINAGE AND UTILITIES EASEMENT
hereinafter referred to as "Grantor(s)", and the City of Orono, a municipal corporation, its
employees, interests and assigns, hereinafter referred to as "Grantee".
WITNESS, THAT Grantor(s), in consideration of the sum of One Dollar ($1.00)
and other good and valuable consideration given by Grantee, the receipt of which is
acknowledged by Grantor(s), do(es) hereby grant, bargain, sell and convey to Grantee, its
successors and assigns, a perpetual easement for drainage and utility purposes, including the
right to construct and maintain the same, together with the right of the public for access over,
above, under and across the land located in the State of Minnesota, County of Hennepin, legally
described as follows:
See attached Exhibit A which is made part of this document.
In addition to any other remedy the Grantee may have, the covenants and
restrictions contained herein may be enforced by injunction.
Grantor(s) covenant that they are in fee title to the above property, have a lawful
right and authority to convey and grant this easement, and that the land is free from all
encumbrances except:

That part of the following described property lying within Outlot C, Bayview Farms Second
Addition, Hennepin County, Minnesota EXCEPT that part lying within the north 123.00 feet of the
west 148.50 feet of said Outlot C:
That part of Outlot C, Bayview Farms Second Addition, Hennepin County,
Minnesota being a strip of land 10.00 feet wide and being 5.00 feet on each side of
and adjacent to the following described centerline: Beginning at a point on the west
line of said Outlot C distant 123.00 feet south, as measured along said west line from
the northwest corner of said Outlot C; thence North 89 degrees 45 minutes 00
seconds East a distance of 148.50 feet; thence North O degrees 36 minutes 38 seconds
West a distance of 88.00 feet and there terminating, except the west 10.00 feet of said
Outlot C.
The sidelines of said strip are shortened or lengthened to intersect the east line of the
west 10.00 feet of said Outlot C and a line drawn parallel to and distant 35.00 feet
south of the most northerly line of said Outlot C.
