Officially signed as City Clerk of Orono, Minnesota and the seal of the ci on April 22, 2024. CITY OF ORONO RESOLUTION OF THE CITY COUNCIL A RESOLUTION APPROVING THE PLAT OF CUMBERLAND FILE NO. LA24-000004 WHEREAS, the City of Orono (hereinafter the "City") is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, Thomas J. Ryan (hereinafter the "Developer") is the owner of the property addressed 2245 Watertown Road which includes the following: Pius 34-118-23-33-0056, 03-117-23-22-0001, 03-117-23-22-00021 03-117-23-22-0022, and 03-117-23-22-0021 legally described as: Attached as Exhibit A (hereinafter the "Property"); WHEREAS on October 24, 2022, the Developer applied for Preliminary Plat approval to combine and plat the Property into two buildable lots. WHEREAS; at its regular meeting on November 13, 2023, the Orono City Council granted approval for the Preliminary Plat per the findings and conditions of Resolution No. 7425 by a 4 to 0 vote; and WHEREAS, on January 1, 2024, the Developer applied for final plat approval for the Property; and WHEREAS, the Developer has agreed to comply with all conditions of Resolution No. 7425 and has completed or has agreed to complete all other requirements of the platting regulations of the City. NOW, THEREFORE, BE IT RESOLVED, based upon the findings of Resolution No. 7425, the Orono City Council of the City of Orono does hereby approve the plat of CUMBERLAND, Hennepin County, Minnesota (a copy of which is attached as Exhibit B), subject to the following conditions: M. Development within CUMBERLAND is subject to the Conclusions, Orders, and Conditions enumerated within Preliminary Plat Resolution No. 7425. 1 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL A2. Dedication on the plat of the perimeter Drainage and Utility Easements as required in Resolution 7425, A3. Dedication on the plat of the Drainage Easements as required in Resolution 7425 shall be granted over all wetlands, creeks, and buffers on the Property. A4. Permits Required. a. Grading and Right -of -Way permits are required before construction of the new driveway serving Lot 2. b. MCWD Erosion Control and Stormwater Management permits, if applicable. A5. Before the commencement of any construction, the construction limits shall be marked with adequate fencing to prevent any construction damage or disturbance of any trees and vegetation outside of the construction limits area. The Developer shall identify trees to be preserved on site, shall mark them on a site plan, and shall take extraordinary measures such as fencing, signage, etc. to ensure they are not disturbed. A6. A title opinion for the Property and certified copies of all recorded easements currently affecting the Property shall be submitted. A7. Payment of Development Fees Required: $500 a. Final Plat Application Fee: $550. b. Park Dedication Fee: $0 c. Stormwater and Drainage Trunk Fee: $0 A8. The approvals granted in this Resolution shall become effective only when all conditions of approval requiring actions by the Developers have been satisfied. A9. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, Community Development Director, and City Engineer that all requirements of the platting regulations have been satisfied. A10. The aforesaid plat shall be filed by the City of Orono with Hennepin County on or before August 14, 2024, together with a certified original copy of this resolution and executed copies of the easements and covenants pertinent thereto. 2 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL A11. Violation of or non-compliance with any of the terms and conditions of this resolution may result in the termination of any authority granted herein. A TTCCT.
