City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1734 <br />A RESOLUTION GRANTING A VARIANCE TO <br />MUNICIPAL ZONING CODE SECTION 10.22, SUBDIVISION 2 <br />AND SECTION 10.25, SUBDIVISION 6(b) - FILE 1892 <br />WHEREAS, Thomas 0. Mortenson (hereinafter "the applicant") <br />is owner of the property located at 1971 Fagerness Point Road within the <br />City of Orono (hereinafter "City") and legally described as follows: <br />Lot 6, Fagerness, Hennepin County, :Minnesota (hereinafter <br />"property"); and <br />WHEREAS, the applicant has applied to the City for a variance <br />to Municipal Zoning Code Section 10.22, Subdivision 2 to allow the <br />construction of an addition to his existing house whist-. will increase <br />the hardcover in the 75-250' lakeshore setback zone to 30% where on1v <br />25% hardcover is allowed, and a variance to Section 10.25, Subdivision <br />6(B) to locate the structure 24' from the rear lot line :where a 30' <br />setback is normally required. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as zoning file A892. <br />2. The property is located in the LR-lC Single Family <br />Lakeshore Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on February 19, 1985, and recommendeC approval of the <br />proposed variances as amended. allowing a maximum of 30% <br />hardcover in the 75-250' zone rather titan the 32.1% <br />originally proposed, based upon the followi►.,-- findings: <br />a) The existing house is located partly within the 0-75' <br />setback zone and partly within the 75-250' zone. <br />b) The proposed removal of an existing sidewalk will <br />decrease hardcover in the 0-75' zone t-om 13.2� to <br />12.6%. <br />c) The proposal will result in the removal of the <br />existing non -conforming detacheA garage which is <br />locates: partially on the neighbo*ing prop^rty and <br />partially on City right-of-way. <br />page 1 of 5 <br />
