i A RESOLUTION APPROVING THE PRELIMINARY PLAT
OF P. GERALD MILLS, 1600 SHORELINE DRIVE
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development
of land within the City; and
WHEREAS, the Planning Commission and City Council have
considered the application for a subdivision plat for P. Gerald Mills,
NOW,.THEREFORE, BE IT RESOLVED, that based upon all of the
information presented by the applicant and reports by the City staff,
consultants and the Planning Commission, the City Council of the
City of Orono hereby approves the preliminary plat for P. Gerald Mills
with the following conditions:
1. Five lot division according to survey by Gordon Coffin,
dated July 12, 1978 (revised as received by City on
December 29, 1978).
2. Lots 3, 4, 5 will be riparian to Lake Minnetonka
(Tanager Lake) by means of direct shoreline access.
3. Lots 1, 2 will be riparian to Lake Minnetonka (Smiths Bay)
by means of ownership of lakeshore outlots.' Outlot B shown on
the December 29, 1978 drawing shall be divided to provide
a separate outlot for lots 1 and 2 and said outlots shall be
legally combined for tax purposes with respective lots 1 & 2.
4. Access shall be by means of a private road platted, as
Outlot A. The existing road may be used except for a new
entrance to'be 22 ft. wide located where shown. The new
entry shall be constructed prior to final plat approval or
a developer's agreement shall be entered into to provide
,for such construction. Upon completion of the new entry,
the existing entry shall be removed.
A Road and Utilities.Easement shall be granted to the City
,over Outlot A. The Council specifically notes that the
existing 15 ft. wide roadway is a minimal width which would
�• not be permitted except for the extenuating existing
circumstances in this particular'situation.

5. The existing cottages on lots 3 and 4 shall be removed
prior to issuance of building permits for new residences
on these respective lots.
6. County Road 15 shall be platted 66 ft. wide as
existing.
7. The applicant shall provide all documents and
information for final plat approval on or before
January 23, 1980.
