HomeMy WebLinkAboutResolution 954f• y RESOLUTION NO. 954 • A RESOLUTION REGARDING ENFORCEMENT OF ORDINANCE 210, THE CITY OF ORONO ON-SITE SEWAGE TREATMENT CODE WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted zoning regulations, subdivision regulations and on-site sewage treatment regulations for the orderly, economic and safe development of land within the City and for protection of the public health and safety by*prevention 'of sewage pollution of ground or surface waters; and WHEREAS, as a part of these regulations, Chapter 22.20, Subd-ivision 6 of Ordinance 210, states that "No subdivision; lot division or replatting for the purpose of creating a new building site, which property includes the use of on-site systems, shall be approved by the City until a site evaluation report as required by the Design Manual has been reviewed and approved by the City engineer, and all existing systems have been inspected and certified by the City as being in compliance with this code."; and • WHEREAS, the intention of the above Section is to assure that all newly created building sites will contain soil and site characteristics suitable for proper operation of on-site sewage treatment systems; and WHEREAS, prior to.the adoption of Ordinance 210 on ._April 13, 19.78, certain subdivision applications were granted preliminary plat approval without the requirement for review and approval of on-site sewage treatment system site evaluation reports; and WHEREAS, certain of the above noted subdivision applications have not yet been returned to the City for final plat approval; and WHEREAS, under the laws of the State of Minnesota and the ordinances of the City of Orono, preliminary plat approval does not vest any rights with the subdivider prior to final plat approval; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby declares that the intents and purposes of Ordinance 210 supercede any previously granted preliminary plat approval; that full compliance with Ordinance 210 shall be required • of all subdivision applications prior to final plat approval; and that specifically wherein certain subdivision'applications,received preliminary plat approval without city.approval of septic system site evaluation reports, such reports including all required on-site percolation testing and soil borings, shall be required to be submitted to and approved'by the City prior -to final plat -approval. Resolution No. 954 • Page 2 AND, BE IT FURTHERMORE RESOLVED, that the requirements of Ordinance 210 as noted above,'*specifically including the requirement for review and approval by the City of an adequate septic system site evaluation report, shall be completed prior to final approval of the following application: 0 .
