' Vin i:. i►INUTES OF A REGULAR 'iEETING HELD OCTOBER 15, 1973 Page 2 It was the opinion of the Planninq Commission DIVISION members that minimum lot size in areas that do 466S Bayside Roars not have public utilities will not be more than two acres per lot. In addition, it was felt that the 1S0' setback for stables uid not apply in this situation. The interpretation was that the 1S0' setback requirement was passed to prevent one property o► iier from infringing on tae rights of another, and not to limit someone from dividing 71 their property when the setback is acceptable to all affected property owners. ► Searles moved, Elliott seconded, that the division of 1.9 acres from Parcel 1412, Sec. 6, be approved, subject to a variance from the moratorium and t.►e Village Attorney's interpretation. of the set- cack requirement for the stable. Notion, Ayes (7) - N;tys (0). Elliott moved, Guthrie seconded, that a variance VARIANCE of 0.1S acres and 40' be granted from the size 1120 North Shore Drive and width requirement as well as a variance from Ordinance No. 149 for Parcel 2680, Sec. 7, because the area was platted before the existing zoning ordinance, and sewer is available. Searles moved, Guthrie seconded, that t:ie DIVISION & VARIANCE division of Lots 42-44 and parts of 45 and 64 3133 Casco Point Road of Spring Park, into two building sites, a variance of 5' from the width requirement of the westerly lot and a variance from Ordinance No. 149, be anproved, with the following conditions: 1. A lake setback that is compatible with the homes to the east must be maintained. 2. A drainage plan must be provided to avoid tae possibility of disturbing existing drainage. iotion, Ayes (7) - Nays (0). Tae Kvalstens have submitted an application for CONDITIONAL USE PEMIT a conditional use permit for the construction ZS95 Lydiard Circle of a duplex on Lot 2, Block 1, of Apple Hill. Van Nest recalled that this property nay- originally zoned commercial and when it was rezoned to half - acre lots, the understanding was duplexes could ue constructed there. Despite the fact that tae Navarre Task Force has recommended the reclassification of the commercial property to the nort;i of Lot 2, it was determined that another duplex would certainly fit in with the ch►racter of the area. Searles moved, Gasch seconded, that the conditional use permit be approved, subject to the Council's approval of a variance to Ordinance No. 149. ;lotion, Ayes (7) - Nays (0). AIJJJTES OF A REGULAR 'IEFTING HELD OCTOIIF.!i 249 1973 Pa ge 2 Oberhauser moved, Butler seconded, to table tAe request of Kermit Knutson for a division concerning 3640 0ayside Road until the comprehensive play. has been approved. After approval of the comprehensive plan, this request will be sent back to the Planning Commission and the Park Commission for tneir comments and review, after which it will be forwarded to the Council again for consideration. Motion, Ayes (4) - Nays (0). Councilman Dorn abstained. Butler moved, Welsh ;cconded, to table the division of Harold Anderson, 4665 Bayside Road, until after the comprehensive plan has been approved. Upon approval of the comprehensive plan, this request will be sent back to tiie Planning Commission for their comments and review and then forwarded to the Council for further consideration. ;lotion, Ayes (4) - Nays (1). Councilman Dorn Nay. Butler moved, Welsh seconded, to approve the variance for diamond Construction Co., 1120 North Snore Drive. The variance is ranted for the lot size and a variance is also granted for the building moratorium. The hardship that was recognized is the fact that there is no more available land to bring the lot up to the proper size. Motion, Ayes (5) - mays (0). ,lassengale moved, Butler seconded, to approve the division and variance of Bryne Ghostley, 3133 Casco Point Road, subject to the following conditions: 1. That the applicant provide the Village Attorney, 'fr. 'tare Miitehead, wit'i the recordable ingress and egress on the property. 2. That the applicant grant to the Village a utility easement if she driveway was found not to be big e; ..gig for a utility easement. 3. The conditions of the Planning Commission tlinutes must be complied with concerning this division and variance. 4. That the proper setback and drainage requirements be complied with. The Council felt t'►at the hardship in this particular case was that originally two lots existed in this area aad that it appears an accidential combination took nlace sometime in the past. notion, Ayes (S) - Nays (0). Gasch moved, Elliott seconded that a verIarce of 4,130' be granted to the lot legally described as, Plat 42220, Parcel 37GO because It was in existance before the present zoning ordinance and since it is consistent w!th the neighborhood. Ar. Harold Anderson has requested permission to divide 2 acres off of an existing 10 acre lot which is legally des- cribed as Plat 41306, Parcel 1412. Kallestad moved, Elliott seconded that the Planning Commission schedule a public hearing for iday 20, 1974, Ayes (7) Nays (0). The petitioner has requested a variance to allow the con- struction of an addition onto his present home. The home Is 30' from the road right-of-way. The present setback re- quirement is 35' 1n this area, and tor. Anderson would like to keep the addition in line with the present home. Gasch moved, Rake seconded that a varlaice be granted because of the location of the existing home. Ayes (7) Nays (0). Mr. Riebel has applied for a 15111ding permit to construct a storage building for farm machinery and hay. According to the ordinance, such a building would be classified as a stable and animals would be allowed to be housed within such a structure. Mr. Riebel wcwld like to locate this structure 120' from the property line, and, therefore, needs a variance. The petitions- claims that It would be impos- sible 13 put the building 1501 from the property line with- out removing a great number of trees. Gasch moved, Pesek seconded, that a variance be granted if the Zoning Adminis- trator can determine that there Is indeed a problem with either the terrain or trees in locating the structure 150' from the property line. If no hardship Is evident, the ap- plication should come before the Planning Commission in Aay. Ayes (7) Nays (0). At the present time, the homo located on Plat 43480, Parcel 500, is only 5' from the property line. Mr. Ber-kland would like to construct a basoment under the existing home. This does require a variance slnc i the setback requirement Is 101. The meeting was called to order by Chairman VanNest at 7:40 RA. All manbers present with exception of Kallestad and Elliott. Fred Curtis moved, Paul Pesek seconded, that the Minutes of t April 15, 1974, Planning Commission meeting be approved. Ayes Nays (0). / Chairran VanNest opened the Pub Iis I-JearIng at 7:42 P.M. regard- Harold Anderson ing a subdivision of 2 acres off from a 10 acre tract legally Subdivision described as Plat 41360, Parcel 1412. The Zoning Administrator presented the Notice of Pu►.Iic Hearing, the Certificate of Aall- ing, and the Affidavit of Publication. The Planning Commission agreed that a simple subdivision with a variance for the setback of the barn and for a 1.9 acre lot Is justified and all future property owners will buy -the property with full knowledge of the location of this barn. If Hr. Ander- son were to comply with the strict letter of the law, he would create a lot with an unusial and undesirable shape. After all persons were afforded an opportunity to be heard, the Public Hearing was closed at 7:45 P.M. Kullberg moved, Curtis seconded, that the simple subdivision with a variance for allowino a 1.9 acre lot and a variance from the required 150' setback for a stable be granted conditioned on the payment of a 5% park fee on the 2 acre site, and that the remaining 8.1 acres be combined with the property to the east. Ayes (7) Nays (G). Chairman VanNest opened the Public Hearing E. 7:45 P.M. for the Hugh Harrison property legally described as Plat 41620, Pa =el 3000. The Subdivision Zoning Administrator presented the Affidavit of "l-blication, the Notice of Public Hearing, and the Certifica—, cf Mailing. The Zoning Administrator explained to the Plann:i,^ C-Vnission that the staff felt that It was essential that a r.:h!ic right- of-way be provided to the proposed 2.5 acre parcel, and that the narrow strip of land which provides lake access should be widened from 301 to 501. Mr. Lahti - 11hat would be the purpose of extending Long Lake Blvd. as a public road, and how would it be done since the pro- posed lot is separated from the public road right-G -way at the present time by a private easement? ►4r. Harrison - Sine I do not anticipail subdlvidlnn my property In the future, I see no need for providing a pulpit road. In add- ition, I would be willing to widen the 301 strip, but I would like to keep It as narro- as possible. C'x,missioner Gasch - Although the property to the east of this Is marsh, establisl rig a standard of 501 of lakeshore as being the minimum allowed see„as reasonable. Since the marsh lakeshore property to the east of the 30' strip cannot be that valuable, it would seom approp- riate that we require Ar. Harrison to provide 50' of Lakeshore. JINUTES OF A REGUI"IR IlEETING HELD SAY 28, 1974 Page 2 Paurus moved, Searles seconded, to grant a VARIANCE varinace to Richard Hollander, 680 North Arm 680 North Arm Drive Drive, for the construction of a garage 22' 41585 - 1020 Lot 1. from the road right-of-way, since it is an improvement over the existing situation, but a variance from the 75' lake setback ordinance can only be given preliminary approval subject to the iiinnehaha Creek !Iatershed Distric _ giving its approval. This variance was deemed reasonable since it is a narrow lot and the variance is only a need for a deck supported by poles. As sr ,in as the Watershed District Poproves it, then a written copy of that approval must be submitted to Dexter Marston, and if it meets IIr. idarston's approval, then the staff is authorized to grant a variance. Hotion, Ayes (3) - Nays (0) . The variance for John 7.inuner & Melvin Dale on County Road #6 and Watertown Road is tabled until June 11, 1974. The variance for Albert Burkhalter and Gerben Korthius, 1066 Loma Linda, is also tabled until June 11, 1974. Mr. Anderson has been into the office and inquired about the anount of Park Dedication Fee due an his subdivision which was approved in 1973. The Toning Administrator felt this proposal should be reviewed by the Commission. After a brief discussion, }tassel moved, ffannah seconded, that this subdivision proposal be resubmitted. Motion - Ayes (S), Nays (0). There was some discussion to consider denying any chick pond proposals. The Planning Commission felt that removal of aquatic vegetation in any marsh area would destroy the filtration of storm eater provided by marshes. The Commission considered setting up standards and clarification of parks. The Commission determined that (parks) as a permitted use in residential districts is too broad a term. Ordinance should be amended. After a brief discussion, the Commission determined this was definitely a commercial operation, and there are cornercial zones for an operation such as this in Orono. Hannan moved, Dunlap seconded, to recommend against amending the ordinance for dog boarding or kennels in any residential zone. Motion - Ayes (S), Nays (0). ?Member Dunlap submitted her comments to the Zoning Administrator. Other members stated that their comments would be forwarded soon. Richard Tuthill and Richard Hassel presented a preliminary plan and model of the 21 unit PRD concept over 21 acres of land in Minnetonka Beach and Orono. This location is north of County Road #IS and east of the Texaco Station at the intersection of County Road # 19 and 015. The proposed density would not exceed the zoning requirevents. The preliminary model indicated that there would be approximately 3-S units in Orono. The applicants presented the proposal in order to get some direction from the Plarming Ccrun.ssion. Mayor Van Nest concluded that there appe,:Ts to be ;nany questions that remain unanswere and staff will require addi'_ional time to research all the information required to justify Mr. Tiork's request. Mayor Van Nest moved, ;d.r';h seconded, to table the request of the North .)-ore Marina for a structure with boat racks ntil the May 9, 1977 Council meeting. Motion, Ayes (3) - Nays (0). Mr. George Johnson, 835 Partenwood Road, addressed the City Council stating that there are some concerns that the Council should address themselves to: 1. The City Council cannot grant permits for temi.orary cor,.struction. 2. If the City of Orono should allow Mr. Hork to install the racks, the City is inviting a lawsuit. Mr. George Johnson felt that there was much public concern in allowing the marinas to expand their operation at this time. S' ECIAL ASSESSMENTS 3297 Casco Circle V/SUBDIVISION 4665 Bayside Road SUBDIVISION vs. RLS TO: Council FROM: Hank Muhich, Zoning Administrator IIATE: April 20, 1977 SUBJECT: Harold Anderson - 4665 Bayside Road 1974 Subdivision - Never Recorded Mr. Anderson wRs in my office recently inquiring why his plat was denied recording at the County. I explained to him Chat when I received the County's request to confirm tho subdivision approval, I found he had never paid his Park Dedication Fee so I informed the County that all conditions were not met for plat approval. In ,-evieu—ig his plat, I discovered several irregularities: 1. The split of 10 acres into 2 sites in a 2-acre zone - one of the lots does not meet the 2 acres. 2. No final plat on record. 3. The back 8 acres appears landlocked. 4. Accessory building (pole barn) on large lot without main structure. S. Barn does not meet required ISO' lot line setback. 6. No Park Dedication Fee paid. When I found this I suggested he submit a new plan. fie was quite upset and refused, so I took the material to the Planning Commission for recommendation to Council for some direction. The Planning Commission recommended this proposal be resubmitted. I'm enclosing copies of the Planning Commission and Council minutes from 1973 and 1974 when this proposal was originally made. COUNCIL MEETING - April 27, 1977 Directed Staff to inform Mr. Anderson to resubmit subdivision application. New proposal must meet zoning requirements and eliminate landlocked area to the rear. Current park dedication fee and application fee. STAFF - May 5, 1977 Letter to Mr. Anderson informing him a new subdivision proposal would be required. The original application from 1974 had expired (statute of limitations). TO: FROM: DATE: SUBJECT: Planning Commission and Council Jeanne Mabusth, Asst. Zoning Administrator November 21, 1978 #443 Robert Olson, 4645 Bayside Road SUBDIVISION SKETCH PLAN REVIEW Mr. Olson has submitted an application for a two lot subdivision originally submitted and approved by Council (May 28, 1974) by Harold Anderson, 4665 Bayside Road. The original application was never finalized because Mr. Anderson did not complete specific obligations to the City. The two lot subdivision now involves a 1.9 acre lot and a 17.3 acre lot. Mr. Olson requests an area variance for the 1.9 acre lot and a setback variance for the pole barn. Hardships following code requirements to the letter would result in an unusual and odd shaped lot. The pole barn is Ol from Anderson's south property line (150' required for a barn - 10' required for an accessory building). '"he pole barn is 2,400 s.f., the State Building Code requires 10' setback from the lot line or the building must be structurally altered to meet code. A one hour fire wall is required and all openings within the wall enclosed. The lot line could be moved 3' to the north along building line and a compensatory southern shift in line could give the necessary two acres. The septic inspector will inspect the existing systems. Park fee to be determined. Items for consideration: 1. Determine use of pole barr►. 2. Can Planning Commission determine a more feasible division line? PLANNING COMMISSION MEETING - NOVEMBER 27, 1978 Staff reviewed the need to either move lot line at least 3 additional feet along building line or to require applicant to make necessary structural changes in the building to meet the code. Planning -1maission advised that ;t would be economically more feasible to at lot line and, in addition, the lot line should be adjusted to _...g the lots to the 2-acre minimum requirement. Planning Commission gave conceptual approval to the subdivision subject to north lot line realignment. Public Information Meeting scheduled for 1-22-78. November 21, 1978 Robert Olson 4645 Bayside Road S lbdivision Page 2 #443 PLANNING COMMISSION MEETING - JANUARY 22, 1979 Planning Commission recommends preliminary approval of the application for subdivision by Robert Olson subject to the following conditions: L. Applicant submitting an accurate survey of the subject property designating setbacks of all structures. 2. Staff determination of variances* required: a) which structures are in violation b) degree of variance to be requested by applicant c) review number of animals housed in pole barn *Planning Commission held that structureaviolating setback requirements could be recognized as legal non -conforming uses but accessory structures in residential zones are permitted uses. The desired limitations for violating structures can be imposed at the time the owner requests a building permit for either improvement or fire damage. STAFF UPDATE - FEBRUARY 2, 1979 (Alan P. Olson) In answer to Planning Commission question 2 above, the 6 calves currently housed in the barn are permitted in this zoning district. Staff recommends approval based on Planning Commission findings as follows: 1. Preliminary plat approval as proposed. ?. Technical setback variances for existing structures, including barn and chicken coop. 3. Final plat to include: a) Dedication of right of way for County Road 84 at existing width of 33 ft. b) Dedication of drainage and utility easements along lot lines. c) Dedication of drainage easement over wetlands area on center -east side of lot with flowage and conservation easement to the City. 4. Nc park dedication fee (2 existing houses). MINUTES OF A PLANNING COMMISSION MEETING HELD ON NOVEMBER 27, 14.978 Page 5 Planning Commission made the following comments: 1. Requested marshland be designated on the drawings. How much of the 8 acres is dry buildable? 2. Commented that when a development is going to be sewered a credit would be given .for the wetlands in determining the number of units allowed. 3. Possibility of a new amendment to the code to allow attached dvpllings in a PRD development in a one -acre zone. This may be a possible, feasible, and/or a better id than granting a variance. 4. Requested info e:1.' 'I on sewer capacity of the Wayzata system to d.. +,Cne future potential. 5. Advised applicar, u contact staff if he wished to continue with the application. Mr. Scott was present. No problems with the proposed plat. Mike Gaffron, septic system inspector, ad-.Yised Mr. Scott that additional soil testing would be required to determine water table. Mr. Scott agreed to contact staff to complete this requirement. A Public Information Meeting scheduled for 1-8-79. Mr. Olson was present. Mabusth noted that the proposed division line is within 7' of the existing pole barn and that possibly the division line should be moved to comply with the 10' required setback for accessory structures. Planning Commission requested revised drawings showing the lot tin.. realignment and the compliance with the two acre minimum lot area requirement. Public Information Meeting scheduled for 1-•22-78. While the exact location of septic tanks an6 drainfields could not be determined due to snow cover, no effluent was noticed on the surface. TheQe systems may be substandard or conforming, pending final determination of location and system size. Based (.)n my inspection, the existing systems do not pose any problems for this subdivision. The upcoming joint Council/Planning Commission COMPREHENSIVE meeting dates were verified as: PLANNING COMMENTS 1-27-79 Lafayette Club - 9:00 A.M. 2-15-79 Council Chambers - 7:30 P.M. Hassel announced the Public Information Meeting on the Subdivision Request of Robert Olson. Mr. Olson was present. Mabusth stated she had the Affidavit of Publication and Certificate of Mailing. The lot line affecting the pole barn (pertaining to fire safety code requirements) has been adjusted to be 10' from the pole barn. However, it will still require a variance for not meeting the setback required for farm buildings from the property line (150'). A variance will also be required for the chicken coop. It was questioned whether a varian should be granted if the chicken coop was not bei used. Mr. Olson stated it was not on his property and, although the owner was not present, he did feel it was being used for storage. He did not know how the owner would feel about removing it, but felt he would agree to have it made a legal non -conforming use. The Planning Commission had trouble verifying all the variances that would be required due to the omission of several buildings on the survey by Gordon Cc fin. Mr. Olson stated that Mr. Coffin was aware of the omissions and was preparing an accurate .,urvey noting all buildings. Mabusth stated that the septic system inspector had not seen any problems, however, due to the time of the year, the exact location of septic tanks and drainfield could not be determined. Olson requests an area 4645 BayEide Road variance for the 1.9 acre lot and a setback variance (Continued) for the pole barn. Hardships following code require- ments to the letter would result in an unusual and odd shaped lot. The pole barn is seven feet from Anderson's south property li-e (150' required for a barn - 10' required for an accessory building). The pole barn is 2,400 sq. ft., the State Building Code requires 10' setback from the lot line or the building must be structurally altered to meet code. A one hour fire wall is required and all openings within the wall enclosed. The lot line could be moved three feet to the north along building line and a compensatory southern shift in line could give the necessary two acres. The septic inspector will inspec the existing systems. Park fee to be determined. Items for consideration: 1. Determine use of pole barn 2. Can Planning Commission determine a more feasible division line? Planning Commission fleeting - November 27, 1978 Staff reviewed the need to either move lot line at least three additional feet along building line or to require applicant to make necessary structural changes in the building to meet the code. Planning Commission advised that it would be economically more feasible to adjust lot line and, in addition, the lot line should be adjusted to bring the lots to the two - acre minimum requirement. Planning Commission gave conceptual approval to the subdivision subject to north lot line realignment. Public information meeting scheduled for January 22, 1978. Planning Commission fleeting - January 22, 1976 Planning Corinission recommends preliminary approval of the application for subdivision by Robert Olson subject to the following conditions: 1. Applicant submitting an accurate survey of the subject property designating setbacks of all structures. 2. Staff determination of variances* required: a. which structures are in violation b. degree of variance to be requested by applicant C. review number of animals housed in pole barn (Continued) REGULAR MEETING OF TILE ORONO COUNCIL, MARCH 13, 1979 Page 9 *Planning Commission held that structure violating SUBDIVISION setback requirements could be recognized as legal 4645 Bayside Road ncn-conforming uses but accessory structures in (Continued) residential zones are permitted uses. The desired limitations for violating structures can be imposed at the time the owner requests a building permit for either improvement or fire damage. Staff Update - February 2, 1979 In answer to Planning Commission question two above, the six calves currently housed in the barn are permitted in this zoning district. Staff recor^mends approval based on Planning Commission findings as follows: 1. Preliminary plat approval as proposed 2. Technical setback variances for existing structures, including barn and chicken coop 3. MINN !!A-'.• April 16, 1979 Robert S. F, Margaret M. Olson Route 2 Box 8SA Maple Plain, MN SS359 Dear Bob: I)ONATA) A. DAHL Plane: 920-8973 I have finished reviewing your homeowners insurance because of the recent collapse claim submitted to Milwaukee Mutual. I would like to point out that although premium increases have been negligible in the past several years, the insur- able value of all types of dwellings has skyrok.keted. Des- pite this phenominal growth in the value of properties and residential construction in particular, many homeowners have failed to protect their investment by purchasing adequate amounts of insurance. The maior consequence of this is that in the event of a total loss --such as can occur in a fire or tornado --owners might find their insurance money woefully inadequate to rebuild their homes. An addit nal problem of underinsurance is the fact that all homeowners policies have a "replacement cost clause" whirr essentially says that if at the time of a loss the insurance limit is 80 per cent or more of the replacement cost, the policy will pay the full replacement cost of repairs. Other- wise it will pay only a portion of the replacement cost of repair! with a deduction for depreciation, which would reduce the payment to something less than the full cost of repairs. This so-called 80 per cent clause is often misunderstood by people thinking that they only have to insure for 80 per cent of the value of their dwelling, whereas all companies recommend that 100 per cent to value be maintained. In reviewing the collapse claim on your appurt,.,ant structures,' we have applied the figures from a Construction Cost Index furnished by an appraisal company and found that the amount of insurance you are now carrying is inadequate and would fall under the SP per cent factor referred to above. While the Construction Cost Index indicates a construction cost of $7.00 per square foot, the insurance company adjuFtor has indicated t.iat it could run higher than that. .. . 9 N' 1 1.`• FAnNL .,no - 19"s .In ..a^ N 1 Olson - 2 - April 16, 1979 Bob, since you are in the construction business, you should be able to determine whether she $7.00 per square foot figure is adequate. Would you please recompute what it would cost to rebuild this building, since our reLo rds indi- cate the replacement cost could be $16,800.00, and "djust the amount of insurance up to at least 80 Per cent to this replacement cost. Please rememfer that if you make any changes in your Property to let us know so that we can make necessary changes in your policy. We thank you for the opportunity to serve you and hope that you will contact us if you have any other insurance needs since we handle all lines of insurance including automobile, life and business.
