It was the opinion of the Planninq Commission DIVISION
members that minimum lot size in areas that do 466S Bayside Roars

two acres per lot. In addition, it was felt

in this situation. The interpretation was that
the 1S0' setback requirement was passed to prevent
one property o► iier from infringing on tae rights
of another, and not to limit someone from dividing 71
their property when the setback is acceptable to
all affected property owners. ►
Searles moved, Elliott seconded, that the division
of 1.9 acres from Parcel 1412, Sec. 6, be approved,
subject to a variance from the moratorium and
t.►e Village Attorney's interpretation. of the set-
cack requirement for the stable. Notion, Ayes (7) -

Elliott moved, Guthrie seconded, that a variance VARIANCE

and width requirement as well as a variance from

the area was platted before the existing zoning
ordinance, and sewer is available.

2. A drainage plan must be provided to avoid

Tae Kvalstens have submitted an application for CONDITIONAL USE PEMIT

Van Nest recalled that this property nay- originally
zoned commercial and when it was rezoned to half -
acre lots, the understanding was duplexes could

was determined that another duplex would certainly

Butler moved, Welsh ;cconded, to table the
division of Harold Anderson, 4665 Bayside
Road, until after the comprehensive plan
has been approved. Upon approval of the
comprehensive plan, this request will be
sent back to tiie Planning Commission for
their comments and review and then forwarded
to the Council for further consideration.

1120 North Snore Drive. The variance is
ranted for the lot size and a variance
is also granted for the building moratorium.
The hardship that was recognized is the fact
that there is no more available land to
bring the lot up to the proper size. Motion,

The Planning Commission tabled Mr. Starkey's request until
a preliminary plat is filed with the Zoning t!;-,inistrator.
Gasch moved, Elliott seconded that a verIarce of 4,130' be
granted to the lot legally described as, Plat 42220, Parcel
37GO because It was in existance before the present zoning
ordinance and since it is consistent w!th the neighborhood.
Ar. Harold Anderson has requested permission to divide 2
acres off of an existing 10 acre lot which is legally des-
cribed as Plat 41306, Parcel 1412. Kallestad moved, Elliott
seconded that the Planning Commission schedule a public
hearing for iday 20, 1974, Ayes (7) Nays (0).
The petitioner has requested a variance to allow the con-
struction of an addition onto his present home. The home
Is 30' from the road right-of-way. The present setback re-
quirement is 35' 1n this area, and tor. Anderson would like
to keep the addition in line with the present home. Gasch
moved, Rake seconded that a varlaice be granted because of
the location of the existing home. Ayes (7) Nays (0).
Mr. Riebel has applied for a 15111ding permit to construct a
storage building for farm machinery and hay. According to
the ordinance, such a building would be classified as a
stable and animals would be allowed to be housed within
such a structure. Mr. Riebel wcwld like to locate this
structure 120' from the property line, and, therefore, needs
a variance. The petitions- claims that It would be impos-
sible 13 put the building 1501 from the property line with-
out removing a great number of trees. Gasch moved, Pesek
seconded, that a variance be granted if the Zoning Adminis-
trator can determine that there Is indeed a problem with
either the terrain or trees in locating the structure 150'
from the property line. If no hardship Is evident, the ap-
plication should come before the Planning Commission in Aay.

At the present time, the homo located on Plat 43480, Parcel
500, is only 5' from the property line. Mr. Ber-kland would
like to construct a basoment under the existing home. This
does require a variance slnc i the setback requirement Is 101.
Pesek moved, Curtis seconded that a variance be approved
since the neighbors expressed no objection to constructing
a basewnent under a structure that does not now presently con-

In September, 1972, the Orono Council approved the Mark One John Zimmer b
Subdivision. Mark 1 consists of six 2 acre lots which at that Melvin Dale
time met the I acre toning requirement. At the present time, Variance
the petitioner owns 5 lots and would like to know if a variance
will be granted to allow construction of homes on each of the

presented the Notice of Pu►.Iic Hearing, the Certificate of Aall-
ing, and the Affidavit of Publication.
The Planning Commission agreed that a simple subdivision with a
variance for the setback of the barn and for a 1.9 acre lot Is
justified and all future property owners will buy -the property
with full knowledge of the location of this barn. If Hr. Ander-
son were to comply with the strict letter of the law, he would
create a lot with an unusial and undesirable shape. After all
persons were afforded an opportunity to be heard, the Public
Hearing was closed at 7:45 P.M.
Kullberg moved, Curtis seconded, that the simple subdivision
with a variance for allowino a 1.9 acre lot and a variance from
the required 150' setback for a stable be granted conditioned
on the payment of a 5% park fee on the 2 acre site, and that
the remaining 8.1 acres be combined with the property to the
east. Ayes (7) Nays (G).
Chairman VanNest opened the Public Hearing E. 7:45 P.M. for the Hugh Harrison
property legally described as Plat 41620, Pa =el 3000. The Subdivision
Zoning Administrator presented the Affidavit of "l-blication,
the Notice of Public Hearing, and the Certifica—, cf Mailing.
The Zoning Administrator explained to the Plann:i,^ C-Vnission
that the staff felt that It was essential that a r.:h!ic right-
of-way be provided to the proposed 2.5 acre parcel, and that
the narrow strip of land which provides lake access should be
widened from 301 to 501.
Mr. Lahti - 11hat would be the purpose of extending Long Lake
Blvd. as a public road, and how would it be done since the pro-
posed lot is separated from the public road right-G -way at the
present time by a private easement?

ition, I would be willing to widen the 301 strip, but I would like
to keep It as narro- as possible.

subdivision to Hugh Harrison and that a 50'

The Zoning A(Iministrator stated that although this item was
not on tl-e -igenda he would like to bring this matter to
their attention. Mr. Anderson has been into the office
and inquired about the anount of Park Dedication Fee due
an his subdivision which was approved in 1973. The
Toning Administrator felt this proposal should be
reviewed by the Commission.
After a brief discussion, }tassel moved, ffannah seconded,
that this subdivision proposal be resubmitted. Motion -
Ayes (S), Nays (0).
There was some discussion to consider denying any chick
pond proposals. The Planning Commission felt that
removal of aquatic vegetation in any marsh area would
destroy the filtration of storm eater provided by
marshes.
The Commission considered setting up standards and
clarification of parks. The Commission determined that
(parks) as a permitted use in residential districts
is too broad a term. Ordinance should be amended.
After a brief discussion, the Commission determined this
was definitely a commercial operation, and there are
cornercial zones for an operation such as this in Orono.
Hannan moved, Dunlap seconded, to recommend against
amending the ordinance for dog boarding or kennels in
any residential zone. Motion - Ayes (S), Nays (0).
?Member Dunlap submitted her comments to the Zoning
Administrator. Other members stated that their comments
would be forwarded soon.
Richard Tuthill and Richard Hassel presented a preliminary
plan and model of the 21 unit PRD concept over 21 acres
of land in Minnetonka Beach and Orono. This location is
north of County Road #IS and east of the Texaco Station
at the intersection of County Road # 19 and 015. The
proposed density would not exceed the zoning requirevents.
The preliminary model indicated that there would be
approximately 3-S units in Orono.
The applicants presented the proposal in order to get
some direction from the Plarming Ccrun.ssion. Other
than determining the actual location of the structures,
the Commission indicated general approval of the concept.

Mayor Brad Van Nest noted that these structures
would require a variance, as we'.l as a building
permit in that this would create ;none than one
permanent structure on one lot, again, expanding
storage areas at marinas which wotild seem t:o be
unre?:onable. Mayor Van Nest concluded that there
appe,:Ts to be ;nany questions that remain unanswere
and staff will require addi'_ional time to research
all the information required to justify Mr. Tiork's
request.

Mr. George Johnson, 835 Partenwood Road, addressed
the City Council stating that there are some
concerns that the Council should address themselves
to:
1. The City Council cannot grant permits for
temi.orary cor,.struction.
2. If the City of Orono should allow Mr. Hork
to install the racks, the City is inviting
a lawsuit.
Mr. George Johnson felt that there was much public
concern in allowing the marinas to expand their
operation at this time.

the request of Dan Oas, 3297 Casco Circle, to
waive special assessments, until the Council
meeting of May 9, 1977 f-,r further information.

1974 Subdivision - Never Recorded
Mr. Anderson wRs in my office recently inquiring why his plat was denied recording
at the County. I explained to him Chat when I received the County's request to
confirm tho subdivision approval, I found he had never paid his Park Dedication
Fee so I informed the County that all conditions were not met for plat approval.
In ,-evieu—ig his plat, I discovered several irregularities:
1. The split of 10 acres into 2 sites in a 2-acre zone - one of the
lots does not meet the 2 acres.
2. No final plat on record.
3. The back 8 acres appears landlocked.
4. Accessory building (pole barn) on large lot without main
structure.
S. Barn does not meet required ISO' lot line setback.
6. No Park Dedication Fee paid.
When I found this I suggested he submit a new plan. fie was quite upset and refused,
so I took the material to the Planning Commission for recommendation to Council for
some direction. The Planning Commission recommended this proposal be resubmitted.
I'm enclosing copies of the Planning Commission and Council minutes from 1973 and
1974 when this proposal was originally made.
COUNCIL MEETING - April 27, 1977
Directed Staff to inform Mr. Anderson to resubmit subdivision application. New
proposal must meet zoning requirements and eliminate landlocked area to the rear.
Current park dedication fee and application fee.
STAFF - May 5, 1977
Letter to Mr. Anderson informing him a new subdivision proposal would be required.
The original application from 1974 had expired (statute of limitations).

SKETCH PLAN REVIEW
Mr. Olson has submitted an application for a two lot subdivision
originally submitted and approved by Council (May 28, 1974) by
Harold Anderson, 4665 Bayside Road. The original application
was never finalized because Mr. Anderson did not complete specific
obligations to the City.
The two lot subdivision now involves a 1.9 acre lot and a 17.3 acre
lot. Mr. Olson requests an area variance for the 1.9 acre lot and
a setback variance for the pole barn. Hardships following code
requirements to the letter would result in an unusual and odd shaped
lot. The pole barn is Ol from Anderson's south property line (150'
required for a barn - 10' required for an accessory building). '"he
pole barn is 2,400 s.f., the State Building Code requires 10' setback
from the lot line or the building must be structurally altered to
meet code. A one hour fire wall is required and all openings within
the wall enclosed. The lot line could be moved 3' to the north along
building line and a compensatory southern shift in line could give
the necessary two acres. The septic inspector will inspect the
existing systems. Park fee to be determined.
Items for consideration: 1. Determine use of pole barr►.
2. Can Planning Commission determine a more
feasible division line?
PLANNING COMMISSION MEETING - NOVEMBER 27, 1978
Staff reviewed the need to either move lot line at least 3 additional
feet along building line or to require applicant to make necessary
structural changes in the building to meet the code. Planning
-1maission advised that ;t would be economically more feasible to
at lot line and, in addition, the lot line should be adjusted to
_...g the lots to the 2-acre minimum requirement. Planning Commission
gave conceptual approval to the subdivision subject to north lot line
realignment. Public Information Meeting scheduled for 1-22-78.

Planning Commission recommends preliminary approval of the application
for subdivision by Robert Olson subject to the following conditions:
L. Applicant submitting an accurate survey of the subject property
designating setbacks of all structures.

MINUTES OF A PLANNING COMMISSION MEETING HELD ON JANUARY 22, 1979
The Planning Commission met on the above date. ATTENDANCE
Present were the following members: Chairman Hassel, 7:30 P.M.
Hurr, Wilson, Frahm and McDonald. Mabusth repre-
sented the City staff.
The upcoming joint Council/Planning Commission COMPREHENSIVE
meeting dates were verified as: PLANNING COMMENTS

Hassel announced the Public Information Meeting
on the Subdivision Request of Robert Olson.
Mr. Olson was present. Mabusth stated she had the
Affidavit of Publication and Certificate of Mailing.
The lot line affecting the pole barn (pertaining
to fire safety code requirements) has been adjusted
to be 10' from the pole barn. However, it will
still require a variance for not meeting the setback
required for farm buildings from the property line
(150'). A variance will also be required for the
chicken coop. It was questioned whether a varian
should be granted if the chicken coop was not bei
used. Mr. Olson stated it was not on his property
and, although the owner was not present, he did feel
it was being used for storage. He did not know how
the owner would feel about removing it, but felt he
would agree to have it made a legal non -conforming use.
The Planning Commission had trouble verifying all the
variances that would be required due to the omission
of several buildings on the survey by Gordon Cc fin.
Mr. Olson stated that Mr. Coffin was aware of the
omissions and was preparing an accurate .,urvey noting
all buildings. Mabusth stated that the septic system
inspector had not seen any problems, however, due to
the time of the year, the exact location of septic
tanks and drainfield could not be determined.

for the pole barn. Hardships following code require-
ments to the letter would result in an unusual and
odd shaped lot. The pole barn is seven feet from
Anderson's south property li-e (150' required for a
barn - 10' required for an accessory building). The
pole barn is 2,400 sq. ft., the State Building Code
requires 10' setback from the lot line or the building
must be structurally altered to meet code. A one
hour fire wall is required and all openings within the
wall enclosed. The lot line could be moved three feet
to the north along building line and a compensatory
southern shift in line could give the necessary two
acres. The septic inspector will inspec� the existing
systems. Park fee to be determined.

Staff reviewed the need to either move lot line at
least three additional feet along building line or
to require applicant to make necessary structural

I have finished reviewing your homeowners insurance because
of the recent collapse claim submitted to Milwaukee Mutual.
I would like to point out that although premium increases
have been negligible in the past several years, the insur-
able value of all types of dwellings has skyrok.keted. Des-
pite this phenominal growth in the value of properties and
residential construction in particular, many homeowners have
failed to protect their investment by purchasing adequate
amounts of insurance. The maior consequence of this is that
in the event of a total loss --such as can occur in a fire
or tornado --owners might find their insurance money woefully
inadequate to rebuild their homes.
An addit nal problem of underinsurance is the fact that all
homeowners policies have a "replacement cost clause" whirr
essentially says that if at the time of a loss the insurance
limit is 80 per cent or more of the replacement cost, the
policy will pay the full replacement cost of repairs. Other-
wise it will pay only a portion of the replacement cost of
repair! with a deduction for depreciation, which would reduce
the payment to something less than the full cost of repairs.
This so-called 80 per cent clause is often misunderstood by
people thinking that they only have to insure for 80 per
cent of the value of their dwelling, whereas all companies
recommend that 100 per cent to value be maintained.
In reviewing the collapse claim on your appurt,.,ant structures,'
we have applied the figures from a Construction Cost Index
furnished by an appraisal company and found that the amount
of insurance you are now carrying is inadequate and would
fall under the SP per cent factor referred to above. While
the Construction Cost Index indicates a construction cost of
$7.00 per square foot, the insurance company adjuFtor has
indicated t.iat it could run higher than that.

figure is adequate. Would you please recompute what it
would cost to rebuild this building, since our reLo rds indi-
cate the replacement cost could be $16,800.00, and "djust
the amount of insurance up to at least 80 Per cent to this
replacement cost.
Please rememfer that if you make any changes in your Property
to let us know so that we can make necessary changes in your
policy.

A RESOLUTION APPROVING THE PLAT OF
BAYVIEW FARMS
WHEREAS. the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development
of land within the City; and
WHEREAS, the City Council has consiaered the application
for a subdivision plat by Robert S. Olson, the subdivider; and
WHEREAS, the subdivider has competed all requirements of
the platting regulations of the City, including:
Utdication of drainage and utility easements on the plat.
Dedication on the plat of rights of way for public streets
and roads, shown as County Road No. 84.
Dedication to the City of a Flowage and Conservation Easement
(Exhibit A) providing for limitations on the use of wetlands
and/or drainageways described therein.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City or Orono hereby approves the plat of Bayview Farms, Hennepin
County, Minnesota; subject to the following conditions:
This plat approval also incl,ides approval of setback
variances for the barn on Lot 2, Block 1 and the shed on
Lot 1, Block 1 which do not meet current required setbacks
from property lines. Existing setbacks not to be further
reduced: 30 ft. rear setback for shed; 10 ft. front,
40 ft. east side and 6E ft. west side setback for barn.
The aforesaid plat shall be filed with the Hennepin County
Recorder's Office on or before June 11, 1980 together with
a certified original copy of this Resolution and an
executed copy of Exhibit A as noted above.
