STAFF REPORT: Mr. Anderson would like to create two lots from Parcel 1412 which would be approximately tour acres and six acres. The width of these two lots would be about 140' 8 1901. Since Parcel 1412 was created before 1971, Section 39oo2i of the Village ordinance is applicable. Section 39.021 allows the petitioner to avoid the formal slatting procedures. The proposed property line is more than the required 10' from the homes, although the barn is only slightly more than 30' from the line. This problem is greatly over- shadowed by the fact that the two residences iA be on separate lots. The petitioner claims that it would be Impos- sible to put the building 150' from the property line with- out removing a great number of trees. Ordinance should be amended. After a brief discussion, the Commission determined this was definitely a commercial operation, and there are commercial zones for an operation such as this in Orono. Richard Tuthill and Richard Hassel presented a preliminary plan and model of the 21 unit PRD concept over 21 acres of land in Minnetonka Beach and Orono. This location is north of County Road i15 and east of the Texaco Station at the intersection of County Road #19 and 015. The proposed density would not exceed the zoning requirements. The preliminary model indicated that there would be approximately 3-S units in Orono. The applicants presented the proposal in order to get soma direction from the Planning Commission. Other than determining the actual location of the structures, the Commission indicated general approval of the concept. The proposal would require platting, detailed plans for PFM approval and joint agreement with the City of Minnetonka Beach. I explained to him that when T received the County's r,.quest to confirm the subdivision approval, I found he had never paid his Park Dedication Fee so I informed the County that all conditions were not met for plat approval. In reviewing his plat, I discovered several irregularities: 1. The split of 10 acres into 2 sites in a 2-acre zone - one of the lots does not meet the 2 acres. 2. No final plat on record. 3. The back 8 acres ame:rs landlocked. 4. Accessory buildv:g (pole barn) on large lot without main structure. S. Barn does not meet required 150' lot line setback. 6. No Park Dedication Fee paid. When I found this I suggested he submit a new plan. He was quite upset and refused, so I took the material to the Planning Commission for recommendation to Council for some direction. The Planning Commission recommended this proposal be resubmitted. I'm enclosing copies of the Planning Commission and Council minutes from 1973 and 1974 when this proposal was originally made. COUNCIL MEETING - April 27, 1977 Directed Staff to inform Mr. Anderson to resubmit subdivision application. New proposal must meet zoning requirements and eliminate landlocked area to the rear. Current park dedication fee and application fee. STAFF - May S, 1977 Letter to Mr. Anderson informing him a new subdivision proposal would be required. The original application from 1974 had expired (statute of limitations).
