The rights of individuals on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individuaL An.individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; (e) any known consequence arising from his supplying or refusing to supply private or confidential data; and (d) the identity of other persons or entities authorized by state or federal law to receive the data. The property was subdivided in 1979 granting approval of certain setback variances for an existing barn and shed adjacent to the newly proposee division line. The structures have not been located on the conceptual plan, but it would appear that the barn would now be located within Lot 7. At the time of the subdivision (review Exhibit E) the barn structure was 'to conform to all animal ordinances'. Obviously the structure did not meet the required 150' setback at that time and could not be used for the maintenance of animals. Based on the ordinance amendment of that section since 1979, the applicant would have a choice of meeting a '?5' setback for the maintenance of animals for private use only. If the t•arr is to be used for quasi commercial use (the hoarding of animals), the barn woulc' have to neet 150' setback from the proposed lot line. The existing house tas been showr. on Uot 1 a:;d appears to meet the required 50' front and 30' side setback. -he prelirinary plat must show structures to remain on the property in relation to proposes4 lot lines. Zoning File #1498 February 15, 1990 Page 2 of 2 Gaffron cautions that the majority of the site is in%+ slopes and may present problems if mound systems are required. Lots 2, 3 and 4 dry buildable area must be exclusive of designated wetland areas. Access is the crucial issue for this subdivision review. Staff has been advised that the applicant does not wish a road extension to the south, nor to the west. Staff would ask members to review Exhibits A and F. Exhibit B should be familiar to Planning Commission members as it was used during the review of the White subdivision application in late 1988 (preliminary subdivision approval expired 9/89). The County found access to the property to be extremely difficult. The only acceptable access to the site was at the western edge of the property on Bayside Road. Access from North Shore Drive was not feasible to the White property. Tf the White property is to be subdivided at some future date, it would make good planning sense to acquire access to the White property through a we:t corridor from the subject property. Please review of Exhibit F, a conceptual road plan for this immediate area. Tt will be staffs strong recommendation to take a future linking access corridor to Lhe south of the property to j(in in a future network of roadways linking North Shore Drive a North Arm Drive. Applicant need only provide future road outl(,ts to the west and south. The plat itself may be a cul-de-sac road. Planning Commission should provide directives to the applicant concerning the following issues: 1. Future access corridors: A) to the west; B) to the south. 2. Will the City allow owner of Lot 7 (previously Lot 1), Bayview Farms to retain access onto Bayside Road. 3. Resolve of structure referred to as pole barn: 75', 150' or will it remain as merely a storage structure? Tf it remains as a storage structure, it must be 50' in from the plat road. 4. Mabusth replied that it is her understanding that Mr. Waade will be cc-istr cting a road to City specifications. Kel iey sugg� :ted to Mr. Waade that he may wish to consider putting gates at wildhurst Trail. Mr. Waade asked how the Planring Commission would react to a request for entrance gates? Kelley replied that he has recommended denial of a previous applications for gates. Bellows said that Mr. Waade's concept of putting gates across a cul-de-sac would defeat the purpose of the cul••de-sac. Mr. Waade said that he could opt for separate entrances with individual gates and omit the cul-de-sac entirely. Mabusth informed Mrs. Waade that the City requires a c-ul-de- sac. Mrs. Waade asked if there would be any opposition to monuments without a gate? Hanson informed Mrs. Waade that monuments are limited to a 3.5' height. Bellows added that the monuments must be placed out of the City's tight -of -way. The Planning Commission agreed that they would be inclined to vote favorably provided the issues regarding gates and monuments are addressed. #1498 JOPii MCDOWELL 4645 BAYSIDE ROAD SKETCH PLAN REVIEW OF SUBDIVISION Mr. Richard W. Sathre was present on behalf of Mr. McDowell. . and Mrs. Bob Olsen 4645 Bayside Road, were also present. Mr. Sathre sair that the Olo, , r-side in one of the existing home on the property. There are two parcels of land involved with this subdivision. He said that they are hoping to create 7 lots and maintain the two residential lots. In regard to the existing barn, Mr. gathre said they will either need to bring it into conformance with the setbacks or take it down. Kelley asked f there were and animals in the barn at this time? 13 MINUTES OF THE PLANNING COMMISSION MEETING FEBRUARY 20, 1990 #1498 JOHN MCDOWELL CONT. Mr. Olsen replied '-hat there are currently horses in the barn. Kelley asked if Lot 7 will meet the area requirements to maintain horses on the property? Mr. Olsen replied that if the barn is to remain, it would be used for storage; not li.estock. Mr. Sathre said that soil testing has not been done. With regard to access, Mr. Sathre said that they would like to keep the "country lane" character that exists in Orono. The access they are showing is +-tie same location of the Olsen's driveway. He said that Hennf r. County has indicated that they prefer that access. Kelley indicated that the proposal looks fine, with the exception of a possible outlot being included for future expansion to the south Mabusth asked if the Planning Commission would like to see a future access to the west provided. Kelley asked the Planning Commission for their opinions regarding the configuraton of Lot 6. Mr. Sathre said that he tried to locate the road on the highest ground to provide natural walkout sites. He said normally he would have designed Lot 6 differently, but due to there being a different property owner for Lot 7 he is proposing to locate the property line as shc,wn. Mr. Peter Rennebohm, 4565 BaysidP Road, said that he just recently purchased his home and is sorry to see this subdivision occur. He said that lie is concerned about the proposed southern access. Mr. Armstrong replied that his mother is the owner of the property to the south and when it is subdivided, access will be necessary. Hanson added that it is a policy of Orono to have minimum, external connections to streets and maximum internal ;rivate development of road systeins. Brown added that the pLr-jt,3e of the policy is to minimize the number of curb cuts onto collector roads. 14 MINUTES OF THE PLANNING COMMISSION MEETING FEBRUARY 20, 1990 Bellows said that the policy also provides for a future transportation plan for the City, rather than designing dead-end roads. Kelley said that a further consideration is that should the City take over snowplowing the road, it is best to have straight, through roads, rather than dead-end roads. Councilmember Callahan said that with the pending McDowell and Parten subdivisions, the City became aware of the fact ttit a transportation plan is needed for that area. He said that zhi s may be the only opportunity to develop a transportation plan. Michael Mueller, an area rea ltor, asked whether developing a transportation plan is what Orono really wants to do? He said that it becomes more difficult to access the collector roads because traffic on those roads increases everytime the City provides a quicker way to get from point A to point B. He said that because of that, people have a tendency to use the interior roads more often and that detracts from property values. #1499 PETER P. CHOW 2505-07 RELLY AVENUE SKETCH PLAN REVIEW OF CONDITIONAL 'ISE PERMIT Mr. Brad Johnson was present on behalf of Mr. Chow. Mabusth briefly explained the applicant's proposal for a duplex. Mr. Johnson said that Mr. Chow had purchased the property with the old fire station w: th the intention of building a structure on the property in which he could live. He said that it would not be practical to remodel the existing structure, but would prefer to construct something that would be more characteristic of the neighborhood. Mr. Johnson showed a sketch of the type of duplex proposed. Cohen indicated that he had no objection tr e duplex being located on that property. Brown said that what currently exists cn the property is an eye sore. Mabusth asked the Planning Commission if they would be willing to grant variances to the duplex section of the Code? it was the gvneral consensus of the Planning Commission that they would have no objections to granting variances to the Cade. 15 MINUTES OF THE PLANNING COMMISSION MEETING FEBRUARY 20, 1990 #1499 PETER P.
