Nelson, Chairman <br />Eberhardt Company <br />Box 1385 <br />Minneapolis, <br />Minnesota 55440 <br />Re: Fagerness Marsh, 1800 Fagerness Point Road <br />Dear Mr. Nelson: <br />Your letter of July 18, 1978 to Mayor Van Nest was discussed at <br />the August 15, 1978 City Council meeting. The Council declined <br />your offer of the land finding it to be apparently encumbered <br />with private easements v.!,ich would be of no benefit to the public. <br />In addition, the Counci termined that Eberhardt Company as <br />land owner is responsil- or complying with those ordinances <br />which require annual lit:.asing of joint use or multiple docks. <br />Licenses are required from the City and from the Lake Minnetonka <br />Conservation District. Refer to the attached application form <br />and copy of Orono Municipal Code Chapter 74. <br />Be advised that such multiple docks are no longer permitted in <br />this zoning district. The burden of proof will be on Eberhardt <br />Company to show that the easements were properly created and <br />recorded prior to adoption of the current code. Eberhardt Company <br />will be responsible for removing the docks or for obtaining the <br />required licenses prior to March -5, 1979. <br />Please contact me if you have any questions. <br />Sincerely, <br />tnP.
